Cambodian judges will be unlikely to find enough support from their international counterparts to block further indictments of Khmer Rouge leaders, observers and court officials say.
The question of more indictments has prompted Cambodian leaders like Prime Minister Hun Sen to warn of instability or war, a position echoed by Cambodian judges.
The Pre-Trial Chamber of the UN-backed court will have to decide on the indictments, which put the UN and Cambodian prosecutor at odds earlier this year.
“There are only three voices, all Cambodian judges, in support of no indictments, and two foreign judges supporting the indictment,” a tribunal observer said. “By law, if there is no super majority, or four out of five voices, the case will continue.”
Observers close to the trial in Cambodia and observing from the US say the issue of further indictments has been complicated by the government’s instance that only five be prosecuted.
The former international prosecutor, Robert Petit, who resigned last month, proposed six more indictments earlier this year. The motion was blocked by his counterpart, Chea Leang, who echoed Hun Sen’s warnings.
It has taken seven months so far for the Pre-Trial Chamber to attend to the indictment question, and in recent weeks the judges of the chamber have been unable to resolve it.
If the indictments are moved past the prosecutors’ office, they will move to the investigating judges, where they could face further complications, observers said.
There is concern that the investigating judges will not take further action, such as arrests or investigation, as they may claim they are putting their priorities toward investigating Case No. 002, of four senior leaders currently in custody.
A tribunal expert in Cambodia said that a disagreement between the investigation judges, again decided on by the Pre-Trial Chamber, must by law be done publicly, not behind closed doors, as the current decision is. That will mean, at least, the names of the six will be public.

I think sihanouk should testify and confess that he was the one who brought Cambodia to the position as we today. He should not be afraid of Hun en and Vietnamese government anymore, conisidered his age. How much does he have to live? It is time for Sihanouk to come out and tell Cambodians the truth of how he has done to Cambodia. I think Sihanouk is responsible for everything. He is guilty for above charges. If he did not come out and confess his guilt, his family and his later generation of his family will not be in clear consience.

I agree with you 100%. For instance, my whole families were faithfull for King Sihanouk because that we had live only in Cambodia but since 1970 his rule was splited in our families, 50% go to Lon Nol and rest to Sihanouk. In the Pol Pot killing fields most of those who had tendency to Sihanouk (communism) were killed. As I was young (1970-1975) I heard the Sihanouk's speech from Peking radio, most of his speech was biased about Lon Nol.
For my conclusion for king Sihanouk is that:
1. he interrested only his life and his family
2. every where must respect him as King but here
has two question:
2.1 the communist countries respected because
they used Sihanouk for Vietnam war (exp.
supoort Vietcong aginst USA and S. Vietnam)
2.2 the west countries people those have free
speech in democracy states, so that is
complecated for all of them to respect

3. During the fighting (1979-1993), his speech only hated CPP and Viet as agressor in form of military, but now every in Cambodia we see the original Vietnam and Viet in Khmers uniform and passport. Question: what kind of his political goal? He dislike S. Vietnam but allow North Vietnam, he believe foreigner than our Khmers blood? Many chinese students from Bejing and Shanghai told me that Sihanouk is not your (khmer) former king, because he mostly stay in Bejing with my Govt money.

According to research after 1979, Sihanouk has looked for Asylum in USA and France but his proposal was failured. Why, because those countries dislike him for bad thing in Cambodia?

The King didn't want to lead the country but he wanted to live a simple life in exile before 1970, but the US and UK insisted he stayed. Because no one else besides Sihanouk could lead Cambodia. Even in 1979, the US wanted him to stay in Cambodia because he still has a great impact on his people in Cambodia.
Million Cambodians still love him that's I can tell you. You visit Cambodia and see for yourself.

Why some of these people believe that King Sihanouk is running to China? The King has a very good life doing his charity work helping his poor people, and he is about to be 90 years old.
Taking King Sihanouk back to China against the west, is a reprimand or a away to say "You(US.Vietnam) cannot touch me(China)".
