[Thai] Court rejects Preah Vihear suit

Border dispute 'is not a civil matter'

The Civil Court has thrown out a suit by a group of Thai academics accusing the Cambodian prime minister and two other ministers of abusing Thai people's rights over Preah Vihear.

The suit, lodged by Thepmontri Limpaphayom and eight other scholars, accused Prime Minister Hun Sen, Deputy Prime Ministers Sok An and Foreign Minister Hor Nam Hong of violating the Thai people's rights and liberties under the Thai constitution by encroaching on the Preah Vihear temple and the disputed area around the temple ruins.

They asked the court to order Cambodia to withdraw its troops from the area. The court was also asked to order the World Heritage registrar to withdraw Cambodia's registration of the ancient Hindu temple as a World Heritage site.

The court rejected the suit, saying the issue was a dispute between two countries over the sovereignty of the area. It was not a civil matter.

The three defendants had acted in their capacity as national leaders, not individuals, in registering the historic temple as a World Heritage site, the court said. The nine plaintiffs had no authority to sue the defendants.

Meanwhile, 2nd Army commander Wibulsak Neepal yesterday said the army would cut troop levels in the disputed area but needed parliament's approval for a mandate to negotiate the issue with Cambodia,

Lt Gen Wibulsak said the army had proposed troop reductions in many parts of the disputed area but had not finalised the extent of the cuts and whether they would reach 50%.

An army source said Prime Minister Abhisit Vejjajiva and Foreign Minister Kasit Piromya met Lt Gen Wibulsak last Wednesday to ask about the border situation and discuss the possibility of reducing the number of soldiers guarding the 4.6-square-kilometre area next to Preah Vihear temple.

About 3,000 Cambodian soldiers and 2,500 Thais are now in the area.

Defence Minister Prawit Wongsuwon yesterday stressed the military would not allow the loss of Thai sovereignty over the disputed land. He said all state officials were duty-bound to protect the country's sovereignty.

Yes you're right, they just play dummy, this one among the Siamese trickies tactic that they prefer to play with Khmer Hun Sen to extend longer times posible. They beleive this way could drain Hun Sen blood to kneelling in front of their Jerky King Abdul. This way they beleive Khmer will cause Khmer running out of resources to abandone fighting then they will grap the land without fight like Surin and the others ancians Khmer provinces.
We're well aware of their intentional, we do know as well they are looking trouble to fight against us, we obviously do not have to fight untill it become necessary. Keep in mind their Jerky King is the last King of Ah Siamese Kingdom, then the Yellow and red Shirts will face off because their King and his Minister AbhiShit have been created the legacy.

They are even planning a demonstration in the 4.6 square km areas situated under Cambodia sovereignty.

That piece of land belongs to Cambodia. Here is what the Internal Court of Justice (ICJ) in the Hague stated in the decision in June 1962:

- The International Court however considers that "Thailand in 1908-1909 did accept the Annex I map as representing the outcome of the work of delimitation, and hence recognized the line on that map as being the frontier line, the effect of which is to situate Preah Vhear in Cambodian territory."

- The ICJ considers further that "Both Parties, by their conduct, recognized the line and thereby in effect agreed to regard it as being the frontier line."

- The ICJ considers that "the acceptance of the Annex I map by the Parties caused the map to enter the treaty settlement and to become an integral part of it."


The recognized line in the map is the line that looks like a parabole that many fellow Cambodians have seen.

Thai politicians and generals should tell the people the truth, that the map as used by Thailand was not an accurate one and that it was actually unilaterally made.

For information, Thailand withdrew its membership from the ICJ after being a member for only ten years during that time Cambodia brought the case of Preah Vihear to the Curt.
Thailand sent a group of soldiers to Preah Vihear in 1954, arrested the lone Cambodian policeman and slit his throad, and accupied the Temple through 1962.
