Sivarak gets 7-year jail term

Thai engineer Sivarak Chutipong was sentenced to 7 years imprisonment and fined Bt 100,000 over the charged of spying on fugitive former Prime Minister Thaksin Shinawatra's flight information, Thai television reported Tuesday.

His mother Simarak Na Nakhon Phnanom who was in Phnom Penh busted into tear as the court ruled the verdict.

Sivarak was ruled guilty in accordance with article 19 of the 2005 Archives Law which cover information on national security and social order.

The Cambodian Court issued the ruling at 4:30 pm.

Thai Foreign Ministry's deputy spokesman Thanee Thongpakdee said that the ruling will deliver the ruling on Sivarak Chutipong at 4.30pm Tuesday.

Thanee said Consular Department's Deputy Director General Maturotpochana Ittirong who attended the trial in Phnom Penh called him and informed of the information.

The Cambodian court started the trial at about 8.15am on Tuesday. Sivarak was charged of spying the flight plans of Thaksin in November.

A presiding judge started the trial with Sivarak's defending and testimonies of witnesses from both sides. Earlier reports speculated that the court is possibly giving the verdict today.

Sivarak , 31, an employee of the Cambodia Air Traffic Service which controlled air traffic in Cambodia, rejected an allegation that he sent the flight plans of Thaksin to Thai Embassy's First Secretary Kamrob Palawatwichai.

"I knew the first secretary only for about two years and rarely contacted him," he told the court.

On the day that Thaksin arrived in Phnom Penh, that diplomat telephoned him and asked whether it was true that Thaksin arrived in the Cambodian capital.

"I am authorised to know that kind of information, so I checked it with a Khmer staff who confirmed Thaksin had arrived. That staff even gave me a copy of the flight plan," he said.

Sivarak said he did not pass on the copy to Kamrob.

Two other employees from the Cambodia Air Traffic Service testified that Siwarak asked them about the flight schedule.

Sivrak, was taken into court under heavy security.

Presiding judge Ke Sakhan of Phnom Penh Municipal Court said Sivarak was being tried on charges linked to "national security and public safety" related to offences committed in the capital.

The defendant's mother, Simarak na Nakhon Panom, and Thai diplomats were seen attending the trial.

The arrest took place on the second day of Thaksin's visit to Phnom Penh as an economic advisor to Cambodian premier Hun Sen and his government. The visit deepened a diplomatic crisis between both countries, following recalling of their ambassadors and first secretaries.

Cambodia expelled the first secretary of Thailand's embassy in Phnom Penh after alleging that Siwarak had passed information to the diplomat. Thailand retaliated hours later.

The feud was worsened after Phnom Penh refused to extradite Thaksin who has runaway from two-year jail term for corruption and abuse of power in Thailand.

Hun Sen announced the refusal even before forwarding Thailand's extradition request to its court for consideration.

The verdict didn't come as a major surprise for most KI commenters--with the exception of Puok Ah CPP idiots--of course, without a doubt, everyone anticipated the judge to arbitrarily rendering his ruling against the suspect in an effort to use the suspect's cupalbility as a bargaining chip for the former Thai Prime Minister Thaksin. That's why the exculpation went out the window.

As Cambodia, I am ashame that Hun Sen's court found Sivrak guilty and threatening our national security for transtering Thanksin's flight schedule, which everyone knew the date Thanksin came.

From listening to what Sivrak said and his lawyer, he is guilty. Thanksin did not come secretly. He came and he did press release. So everyone in the world knew and all media people knew that. Thai media even reported Thanksin trip to Bangkok early.

And it is Sivrak'job to know the flight schedule too. And now he is found of threatening national security. It does not make sense at all. How can he threaten national security just to get flight schedule which everyone also know?

The real reason behind arresting Sivrak is not about national security. But it is Hun Sen's dirty trick to put pressure on Thai government. Hun Sen knew Sivrak is innocent man. He has been used as tool for political war between Cambodia and Thailand. Both Hun Sen and Thanksin have benefits from Sivrak. Hun Sen can put some more presure on Thai side. As you can see these last couple weeks, Thailand softens its stand and tried to make Hun Sen happy by offering to give Hun Sen loan for road construction.

Thanksin group also gain political benefit from Sivrak by facilitting Sivrak case. Soon Hun Sen will release him by understanding his eternal friend Thanksin. By so doing Thanksin will be appreciated by Thai people and this will make Thai government (Abhasit) look bad.

Whatever benefits Hun Sen and Thanksin get, we as Khmer people learn several things from Sivrak case. First,we learn that Hun Sen is a bad man. He used dirty trick. Second, it is ashame for Khmer that the Hun Sen's corrupt court with political influenced from Hun Sen, made stupid judgement on Sivrak. Everyone in the world know that Sivrak is innocent and he is used by Hun Hen as a political tool. And when court decided that he is guilty, it just shows stupidity of Cambodia's court and injustice of Cambodia society. As a Khmer, I am ashame that we are people who do not know what right and what wrong. I am not trying to defend Sivrak. But we must give him justice and show the world that we, Khmer people also love justice.

Third, we learn that Thai government loves and care their people even one person like Mr. Sivrak. Thai government would do every thing to ensure that their people who live abroard are safe and have justice.

Fourth, we learn that Cambodian government under Hun Sen does not care of its people who live abroad. Thai soldiers kill so many Khmer people who went to Thailand. And Hun Sen does not bother to care. Khmer people go to other countries like US, France or other countries, Hun Sen government and Cambodia embassies abroad do not care of its people.

Is there justice for the Khmer people in Thailand? I think that there is nothing

If it was a khmer who did the same thing in Thailand, what would he become? I think he would be in jail for life.

Some people are so incredibly naive. This world is full of politics with moves and counter moves. It has been this way for ages in this particular region and throughout the world for that matter. Who are they kidding? In this case only him/herself. Despicable siems have been looking on us, Khmers, for centuries now for one reason or another including its hunger of expanding the territory and the jealousy of the Khmer great culture/legacies and past glories. Cambodia and Khmer people have been through many upheavals and never was in the strong enough position to stand up against anybody. Until now that we have some level playing fields and are now demanding some respects from these contemptuous siems. Enough is enough. As far as some individual with some thinking capabilities would think that the siems now deserve this kind of treatment. They are getting a taste of their own medicine. Sure enough, it doesn't taste very pleasant to them, does it? Years back, the damn siems did awful things to Cambodia and the Khmer people, did they lose any sleep? Hell No. They were laughing at and spitting on your fathers and mothers. Worse yet, they rapped and killed Khmers for fun. They still do. So don't you cry when this guy get 7 year term for something that he knew full well that he should not do. Talking about that, if that information was published and available publicly, why didn't this siem embassy official get it from the public media or newspaper? What business did the siem embassy have to directly contact and talk to the a private company working for the host sovereign nation? Any moron off the street knows that this act is no less than a covert act in obtaining a private information.

the thai govt. wanted to know when thaksin schedule back to dubai so the thai air force can intercept him in the air then bring him back down to thailand. that was the spy plan to do.
