Forty-eight years after the International Court of Justice rendered its decision regarding Preah Vihear Temple on June 15, 1962, Thailand continues to blindly disobey the World Court's decision and distort the truth in an attempt regain the Khmer cultural heritage as belonging to Thailand. Thailand had 10 years to appeal the case up till 1972. Since 1962 up to the present, the Thai government had no new evidence to contest the case. It went dormant for 40 years until Cambodia initially tried to apply for a UNESCO World Heritage status on June 28, 2002 in Budapest, Hungary. Thailand wanted to be a joint applicant for the listing of Preah Vihear temple, an idea Cambodia adamantly could not accept. To do so would be like sharing one’s wife with a neighbor. On July 8, 2008, the World Heritage Committee at the 32nd session of the Committee in Quebec City, Canada, decided to add Prasat Preah Vihear as "Outstanding Universal Value", along with 26 other sites, to the World Heritage Site list, despite several protests from Thailand. Since then, the Abhisit government continues to oppose and undermine the listing.

The Cambodia-Thailand border had been clearly defined in the Franco-Siamese treaties of 1904-07 as noted in the Annex I map. There is no border dispute or overlapping 4.6 km2 areas or other grey areas along 803-km long border between the two kingdoms. Many Thai newspapers and broadcasting media intentionally distort the facts that the court ruled only the temple as belonging to Cambodia but not the adjacent land. The Abhisit government even told the press that the world court ruled only the stone temple, but not the land beneath the temple or adjacent land. This is an erroneous idea and simply NOT true per ICJ verdict of June 15, 1962.

Thai media also distorted the fact that Preah Vihear temple is a Hindu temple instead of a Khmer Buddhist temple. The Preah Vihear temple was built in 9th century and into 10th century A.D by Khmer King Suryavarman I and Suryavarman II and it was dedicated to Hindu god Shiva and his manifestations as the mountain gods Sikharesvara and Bhadresvara. As Hinduism declined in the region, it was gradually converted to use by Buddhists in the 12th century A.D. In essence, the temple became a Buddhist shine on top of 525 m cliff for over eight hundred years. Bear in mind that the first Thai kingdom of Sukhothai was established around (1238 till 1438), some three hundred years later. The reasoning behind the Thai media to use the term ‘Hindu temple’ instead of a ‘Khmer Buddhist temple’ is obvious. It would give the Thais a chance to claim something that is not theirs.

Under the Samak administration, Thailand confirmed its decision, as expressed at the 31st Session of the World Heritage Committee held in Christchurch (New Zealand, 23 June to 2 July 2007), to support the inscription of the Sacred Site of the Temple of Preah Vihear. In doing so, Thailand had hoped that the adjacent land is still under Thai jurisdiction. During Samak Sundaravej’s first state visit to Phnom Penh on 3 and 4 March 2008 at the invitation of Prime Minister Hun Sen. A month later, the Thai delegation led by foreign minister Noppadon Pattama, in the presence of a number of UNESCO eminent members, led by the Deputy Director General of UNESCO for Culture, Mrs. Françoise Rivere reviewed the joint communiqué for the inscription of Preah Vihear temple. The Kingdom of Thailand reconfirmed its support for the inscription of the Temple of Preah Vihear on the World Heritage List at the 32nd Session of the World Heritage Committee which was held in Quebec, Canada in July 2008. For its part, the Kingdom of Cambodia, in a spririt of goodwill and conciliation, accepted to inscribe the Temple of Preah Vihear on the List of the World Heritage, at this stage, without a buffer zone on the north and west of the Temple. Although this was done under Thai pressure, it does not mean that the adjacent land belongs to Thailand. After Samak was dethroned due to a cooking show, Abhisit Vejjajiva took the PM office and continued to use Cambodian Preah Vihear temple to stir Thai national sentiments against Cambodia in an effort to secure his undemocratic Prime Ministerial seat. War of words between Abhisit and Hun Sen intensified and relations with Cambodia became sour. Both countries recalled ambassadors to its respective countries. Many countries considered Abhisit as overreacting over ‘Thaksin’ as advisor to the Royal Government of Cambodia and his insistence on Cambodia to extradite Thaksin back to Thailand. Cambodia considered this as a double standard, while Thaksin enjoyed his stay in Dubai, Nicaragua, Sri Lanka, etc. without any problem. Thailand accused Cambodia of disrespecting its law, while Thailand on the other hand, never respected any international law since 1962! This, without doubts, undermines Thailand credibility in the world.

The Thai government may be able to fool its citizens regarding the World Court verdict, but it can never fool the entire world. Let's review the ICJ verdict of June 15, 1962, once again:

"In its Judgment on the merits the Court, by nine votes to three, found that the Temple of Preah Vihear was situated in territory under the sovereignty of Cambodia and, in consequence, that Thailand was under an obligation to withdraw any military or police forces, or other guards or keepers, stationed by her at the Temple, or in its vicinity on Cambodian territory."

“By seven votes to five, the Court found that Thailand was under an obligation to restore to Cambodia any sculptures, stelae, fragments of monuments, sandstone model and ancient pottery which might, since the date of the occupation of the Temple by Thailand in 1954, have been removed from the Temple or the Temple area by the Thai authorities.”

Wish all Khmer have the right to learn about our own real "Great Khmer History."
We as Khmer born live in Europe, America and Australia are very lucky able to study and did research about our history. Feel very sorry for other Khmer Descents, who live under the foreigner occupations, because they did not allow or have the same right to study our own history, language, religion and culture.

Whose Preah Vihear Temple is it, and what does it matter anyway?
Who owns the Preah Vihear Temple and surroundings?

Cambodia does. On June 15, 1962, the International Court of Justice (ICJ) ruled that, ‘the Court, by nine votes to three, finds that the temple of Preah Vihear is situated in territory under the sovereignty of Cambodia.’ The Cabinet of the time made a resolution and announced that Thailand, as a member of the United Nations, accepted the ICJ ruling.

Although Thailand protested and reserved the right to request a revision of the ruling as allowed by Article 61 of the Statute of the Court within 10 years after the date of the ruling, Thailand has never officially made any application for such a revision, nor made any request for the Court to clarify the meaning or scope of the judgment, as allowed indefinitely under Article 60.
So where have the People’s Alliance for Democracy (PAD), the Democrat Party and the nationalists been? After a lapse of 48 years, they still insist on reserving this right. Such a dogged stance can never make any difference, except by showing their own uncivilized minds.
The PAD and the Democrat Party say that Thailand has always insisted that the watershed line of Phanom Dongrak Mountain Range was the borderline between Thailand and Cambodia. Accordingly, Preah Vihear is on Thai soil. The ICJ, however, already addressed this issue in its judgment, saying that the watershed had nothing to do with the temple, as the Preah Vihear dispute had to be considered in accordance with the 1907 Franco-Siamese boundary treaty (see details below). And Thailand has never raised the issue of the watershed line in the past 48 years.

The PAD and the Democrat Party say that Cambodia won the case, but owns only the temple, and not the territory on which the temple is situated. What a distorted and craftily arbitrary reading of the ICJ’s judgment! Please read and reread the judgment. Anyone with an honest and righteous mind will never read it that way.

Who built and owned the Preah Vihear temple in the first place?
The Preah Vihear Temple was built at the beginning of the 9th century, and construction continued through the reign of King Suriya Woraman the first, 1002-1050, to be finished in the reign of King Suriya Woraman the Second, 1113-1150, when the prosperous and strong Khmer empire ruled the region 300 hundred years before the emergence of the Sukhothai Kingdom (see The Preah Vihear Temple: Politico-historical Case Study and Nationalism by Charnvit Kasetsiri, p.2)

In a nutshell, the ancestors of the Khmer people built and owned the Preah Vihear Temple in the first place.

Is it true that the Preah Vihear Temple used to belong to Thailand, and was lost to Cambodia by the ICJ judgment?

Originally, the Preah Vihear Temple belonged to the Khmer (see above). In 1431, during the reign of the King Chao Sam Phraya, the Ayutthaya army defeated the Khmer empire and seized Angkor Wat, which was then the capital. The Khmer had to move the capital to Udong Meanchay and then Phnom Penh. Since then, Battambang, Srisophon and Siem Reap, as well as the Preah Vihear Temple, were annexed to Siam.

On March 23, 1907, Bangkok’s King Rama V signed the Franco-Siamese boundary treaty with the President of France, agreeing to exchange Siam’s Battambang, Srisophon and Siem Reap, as well as the Preah Vihear Temple, for the French-occupied Chantaburi, Trat provinces and Dan Sai in Loei. Once independent from France, Cambodia claimed the Preah Vihear Temple, based on the Treaty,.
In a nutshell, the Preah Vihear Temple once belonged to Siam from the reign of the Ayutthaya King Chao Sam Phraya onwards because of the Siamese victory over the Khmer Kingdom. But Bangkok’s King Rama V returned it to France who colonized Lao and Cambodia. If there ever was a loss of Siamese territory, the land was lost since 1907, as the ICJ made its ruling in line with the Franco-Siamese Treaty.

Does Cambodia’s registration of the Preah Vihear Temple as a World Heritage affect the Thailand-Cambodia boundary? If so, how much?

The Cambodia’s registration has nothing to do with and has no effect on the boundary dispute or sovereignty between Thailand and Cambodia, as Article 11-3 of the UNESCO World Heritage Convention says that, ‘The inclusion of a property in the World Heritage List requires the consent of the State concerned. The inclusion of a property situated in a territory, sovereignty or jurisdiction over which is claimed by more than one State shall in no way prejudice the rights of the parties to the dispute.’

The legal demarcation of the boundary between Thailand and Cambodia is assigned to the Mixed Border Delimitation Commission which was set up by both countries and has nothing to do with the listing of the Preah Vihear Temple as a World Heritage site.

Why does Thailand not make a joint request with Cambodia to list the Preah Vihear Temple?

Thailand has proposed to Cambodia to make a joint request to UNESCO for the listing, but Cambodia has consistently refused, citing the ICJ judgment and claiming that it would not be able to account for such a joint request to the Cambodian people.

If the Preah Vihear Temple is listed as a World Heritage, what would be the pros and cons for Thailand?

UNESCO would provide personnel and budget for the restoration of the Preah Vihear Temple and its surroundings, as well as serve as a worldwide advertisement for the temple as a world-class tourist attraction on par with Angkor Wat.
However, due to the inaccessible sheer cliff and the present lack of proper infrastructure and facilities on the Cambodian side, access could only be made via Thailand. The possible future development of a cable car to reach the temple from the Cambodian side along with investment in infrastructure and facilities including an airport, roads, electricity, water, hotels, etc., would still take years or even decades.

So the listing would benefit Thailand’s tourism industry as well as the friendship between the two countries.

The scare-mongering by the PAD and Democrat Party within Thai society, alleging that Thailand is poised to lose territory or sovereignty, is therefore just a cheap and dirty political trick which would not do any good to anybody.

The Central Administrative Court’s injunction to suspend the Cabinet resolution and any further action supporting Cambodia’s request, as prompted by the PAD complaint, will only exacerbate the problem and damage. Hopefully, the Thai people will in the future remember this and hold accountable the PAD and the Democrat Party after the damage has already been done.

8:29am, thanks for your insight on preah vihear. although you are thai, i assume, you sound fair. we like that type of truthfulness and facts. please keep up the good work. i think your thailand needs more people like you to help it going in the right direction when it comes to preah vihear and thailand's real relationship with cambodia and khmer people. you know, most khmer people like a fair and unbiased reports like yours above. nothing irates khmer people like me more than a distorted or bias report about my beloved cambodia. god bless your for doing the right thing toward cambodia and khmer people. i guess it shows perhaps not all thai citizens are bias or have bad intention on cambodia and khmer people, but sorry to say, most of siem pad thugs are. they get no respect from a khmer person like me, really!

Thank you for your fair analysis. But I think the areas of siem reap, battambang, sisphon were lost to Siam not in 1431, but in the 18th century during the Ang Eng reign, with the accomplice/traitor Chao Fa Ben, the ancestor of Aphaiwong. \

Khmer-Thai relationship is like a parent-child relationship. The (Khmer) parent nurtured the (Thai)child, and when the deliquent child grew up, the child does not want anything to do with the poor parent in distressed...

Much has to be done to restore the bond. There is always love from the parent toward the child...and the child has an obligation to respect with love for all the years of rearing and goodness of the parent.

Thailand should have moved beyond the national identity crisis by now, since economically and miliatrily , it is far superior the Cambodia. Khmer people have no intention of reclaiming long lost past glorious empire, but we only want to keep only the lands that Thailand had agreed with cambodia in modern times, ie, from the French era.

Also, Khmwr Surin, you are too are very objective and fair. I admire you for having never forgotten your khmer roots, although many surin khmers have. Khmer surin should have more cultural contacts with khmer kandal, but not claiming autonomy or independence, or anything like that. For me, I am happy to see you are happy there. Surin is Thailand, but not Ta Moan temple, not ta Krobey temple, not sdok kak thom either. Yes, you can have Pnom Ruang, and hundred more inside thailand.
