Cambodian farmers rise up over "land-grabbing"

PHNOM PENH, March 19 (Reuters) - Nearly 1,000 angry Cambodian villagers rallied on Friday to oppose what they said was land-grabbing by a local business tycoon, the latest in a series of flare-ups over land disputes in the impoverished country.

The protest in Kompong Speu, 48 km (30 miles) from Phnom Penh, came a day after irate farmers burned down makeshift wooden shelters on a sugar plantation, accusing the company of colluding with the authorities to rob farmers of their land.

Villagers who spoke to Reuters by telephone said some protesters had planned to torch offices belonging to the Phnom Penh Sugar Company, owned by Senator Ly Yong Phat, which was awarded a 9,500-hectare land concession there. The plan was later called off, they said.

Farmer Sun Theng said he had been working the land for 20 years and he and other villagers had been offered meagre compensation of between $100 and $200 for each hectare. They now faced arrest over the torching of the shelter, he said.

"Villagers didn't agree with it but the company said 'if you don't take it, you people will get nothing'. They became angry," Sun Theng said, adding that the protest would continue until there was an amicable solution.

Another farmer, Sao Choeun, added: "The company looks down on us -- how can we survive with $200 per hectare?"

BIG CONCESSIONS

In a move to attract foreign investment to improve its nascent economy, Cambodia has awarded big concessions to companies, mainly from China, Vietnam and South Korea, to run mines, power plants and farms.

Cambodia is also relying on foreign help in modernising and expanding its agriculture, mining and energy sectors to create jobs and boost exports, especially of commodities like rice, rubber and sugar.
However, that has led to a rise in what rights groups and international donors say is a trend of forced evictions by state officials profiting on the sale and lease of farmland and urban real estate for use by foreign and local companies.

Indigenous Cambodians on Wednesday urged the government to suspend hundreds of concessions awarded to foreign and local companies they say are operating on disputed land.

The issue illustrates a risk for investors in Cambodia, where corruption is rife and land deals are sometimes agreed with influential politicians and officials without going through proper legal channels.

Chheng Sophors, an investigator for local human rights group Licadho, said land disputes were becoming increasingly common and a long-term solution was needed.

"Before giving a concession, the government should study carefully the impact on the local communities," he said.

Kang Heang, the provincial governor, said the villagers had cost the company at least $20,000. He blamed rights groups, rival businessmen and politicians for stoking the unrest.

He said the land belonged to the state and the deal was transparent, adding that arrests would be made.

"This kind of thing is normal. When there's new investment, there are problems," Kang Heang told Reuters.

In my view the government needs to take steps through the casdastral authority to implement what is already in the Land Law of 2002. The heart of the problem lies with the fact that many people simply did not register, either out of ignorance or negligence, if they had uncontested possession for the 5 year period proscribed by the Land Law which allowed for those people to apply for title ownership prior to the laws passage in 2002. The new law allow for those person who did not perfect title prior to the passage of the 2002 land law to but have some of the 5 year uncontested occupancy required by the land law, to apply for title of possession from the "competent authority" meaning the cadastral authority. Title of possession should take priority over new acquisitions by those who had no right to contest based on prior occupation. In my view the Royal Government should issue a Prakas allowing for a period of say two years for those who can show a 5 year period of uncontested occupation of private government land to apply for title of ownership. This should be a platform of any party seeing solution to this land crisis in my opinion.

Land Law, Anti-Corruption Law and most laws in Cambodia are modify to protect high government officials and suppress the citizens. Hun Sen's law are just a safety shield for him and his clans to continues their corruptions. (sic!)

As much everyone knows there are outrangeous corruptions in Cambodia. Have anyone ever heard CPP's corrupted officials ever brought to justic and convicted?

So this is the price of development? Screwing up your own people? Robbing land from your own people so that you can give it to Chinese or Vietnamese companies to develop on? And then afterward, these Vietnamese companies hire Vietnamese from Vietnam to come into Cambodia & work and live on the land? What is this...Vietnamese colonialism of Cambodia?...and ah Hun Sen allows it? Not only that, but ah Hun Sen now allows these Vietnamese companies to monetarily sponsor certain battalions of the Royal Cambodian Armed Forces so that Vietnamese can further can receive protection in Cambodia?

The Khmers are not only being screwed over in Kampuchea Krom, but also in their motherland of Cambodia.

Another example why ah Hun Sen is the most treasonous Cambodian in Khmer history. More treasonous than Pol Pot & Sihanouk.

If Ah Hun Khvack is serving Khmers he will come and help these poor people, but the fact is Ah Xen is serving only Ah Chen and Ah Youns, Oh the word Ah is very beautiful in Chenese.

Thank you for the comments above in Khmer. Perhaps, this kind of messages in Khmer will get through more effectively to those 'leaders' who otherwise do not read or speak English.

40 years ago, the uprising in Samlot was turned into a folklore of popular resistance by the 'Communists' in the seventies against the Lon Nol regime.

It is noted with irony that the marking of the 18th March 1970 coup, which is being posthumously condemned by all sides for plunging the Khmer nation into misery should be coinciding with this spectre of violent seizure of people's property.

The dispossession of vulnerable people through the sales of their farms and countless public/communal lands, fishing grounds, forests etc. to make way for commercial plantations and instant fortune in land speculation has been a plague in the lives of the Khmer people, with the hardest hit being the poorest and most vulnerable among them.

Go to any village in Cambodia and one is bound to hear stories about communal and people's properties being handed over to faceless commercial interests and tycoons, stamped with the courts' legal approval. Rural folk, already faced with depleted natural resources - a legacy of war and mismanagement of previous decades - are now being stripped of their remaining assets from beneath their feet.

A naturally bountiful, resource rich land that for the greater part of its history the envy of its neighbours now perching on ecological disaster. Even during the Pol Pot era, there were still fish to be caught in rivers and lakes, and many managed to survive on this staple. Today, with the forest cleared and the lake dried up, even juvenile fish is hard to come by for rural dwellers.

A civilised society is judged by the treatment it affords to its poorest and most vulnerable members. The least that the authorities could do for these unfortunate people would be to leave them alone to get on with their lives, if no practical development scheme is in place to help them improve their livelihood.

In desperation, human beings are known to resort to desperate resolve.

a sign that cambodia is finally catching up with the world? we used to see this kind of police/civilian scuffling outside of cambodia, but now we are seeing it in cambodia; a sign that cambodia is, perhaps, slowly moving in the right direction with freedom, non-violence by police, freedom of expression, etc... it's a huge change in a short time frame. good thing.
