Supreme Court Ruling a Rubber Stamp of Appeal Court









PHNOM PENH – 02 June, 2010

We, Members of Parliament of the Sam Rainsy Party strongly denounce the ruling of the Supreme Court today, which unsurprisingly upheld the defamation conviction of MP Mu Sochua. The Court’s affirmance, despite the sheer lack of evidence against Mu Sochua, shows the court did not base its decision on an independent and impartial application of the facts to the elements of the law, but instead bowed to political manipulation by the executive.

This conviction demonstrates that constitutional protections and rights such as freedom of expression, fair trial by an independent tribunal, and equality before the law are meaningless when they are used to challenge the powerful.

Not only was there no legal basis for a defamation conviction of Mu Sochua, but this trial has revealed additional causes for great concern about the way the judiciary is run. In this political climate, where threatening speeches against government’s critics are regularly made by high-level officials, it is clear that the lawyer of Mu Sochua’s own choosing was intimidated and that no other lawyers would have dared to represent her. This violated her right to a fair and independent trial.

Further, in a free society, the people must be allowed to hold their leaders accountable, even if that means criticism. The government’s argument that public officials should be respected and not denounced is directly contradicted by the Constitution: Article 39 of the Constitution guarantees the right of Khmer citizens to denounce public officials for a breach of the law committed during the course of their duties. The comments made by the Prime Minister were derogatory and set a bad example for how women should be treated in Cambodia; such language is unacceptable, and perpetuates a culture of misogyny and discrimination against women. If Cambodia is to progress, it must allow space for the people to speak out when they see injustice.

Ironically, as international donors meet this week to discuss giving additional aid to Cambodia, the ineffectiveness of past aid to reform the judiciary and increase democratic space for free expression was made glaringly obvious with today’s ruling. Donors must condemn the lack of reforms of the judiciary in Cambodia and the direct manipulation of the justice system by the executive branch, and place more strict demands on the government to allow judges and lawyers to exercise their roles and functions according to the rule of law. The government must be held accountable to deliver clear results in the reforms of the judiciary and its commitment to democratic principles.

We acknowledge and highly value the presence of all local and international human rights organizations, trade union leaders, teachers, youth and women during the hearing today, and we call on civil society and the international community to continue their vigilance of the current surge of defamation cases against dissenting voices, and partisan political pressure on the judiciary.

Me implicitly admire Ms Sochua's bravery and accomplishment against the CPP and SenVarman.
There is not personally or publicly ashamed for SamRainsy to unfrightfully stand strong and patriotically fight for the right and freedom as her.

It was Mrs Mu Sochua who brought the Prime Minister to court. The court found that Mrs. Mu Sochua defamed the Prime Minister.

The donors will give even more money to the Hun Sen government, no matter what is happening in Cambodia.

If they don't, China will certainly!

It is not about democracy and justice for the poor Cambodian people, but it is all about their interests in Cambodia.

You will be guaranteed that the Hun Sen government will get the money as usual and the amount may even be more than the previous- year one.

It is too sad, but too real to ignore!

The government has slowly eliminated the dissident voices.

The King thinks it smart to remain silent on all issues affecting Cambodia to preserve His monarchy for years to come, but in reality by choosing to ignore the problems relevant to His role and duty as guaranteed in and expected by the constitution, He condemns His own Kingdom to dye slowly as its relevance in modern Cambodia becomes less and less in the eyes of the ordinary Khmers.

Disgrace Mu Sochua’s problem all along, is that she is trying to be a politician. She's not, never has been and quite obviously, never will be. She should have just been herself, provide alternative policies and show Khmer people what a great alternative MP opposition she would be. Instead, her foray into being a politician has been a disaster. She comes across as pretending to be something she's not. Now, her political career is on the line and herself also in the hot water.

While the nation is facing complex economic, social and environmental issues disgrace Mu Sochua tried to promote her political stunt, aimed to get media attention. If this wasn’t such a clear demonstration of her selfish pursuit of personal ambition it would be laughable. There is no doubt that Mu Sochua has no real regard for the best interest of the nation. She is driven solely by a desire to become a “Champion of Women or a new Aung San Suu Kyi” by any means available to her, even if that has the potential to destabilize the country. Even worse, she is attempted to make trouble after she lose her case in the Supreme Court against Prime Minister Hun Sen. Will she happy going to jail or pay the fine? Everyone can bet for it.

People of integrity admit their faults, make amends and are judged fairly...Disgrace Mu Sochua is lacking in integrity and common sense and tries to change Cambodia into her own world. As long as Cambodia’s Court doesn’t issue any verdict which is fitted for her political stunt, she will screaming for the justice all day long.

Hun Sen is using Madam Mu case to convey to the society to focus on Madam Mu case instead of focusing on land grabbing or corruption about almost everything, like selling land to Viet, a secret deal with China, or oil corruption between the east or the west. Hun Sen is very smart in term of manipulation. Khmer people must be aware of every corner. People in power usually know, when, where, what and how to do things secretly, however it can not by past in the eye of the intelligence, that is why education is very important for all of our future generation to come.
