Cambodian Court Sentences Khmer Rouge Prison Chief to 19 Years

VOA News
Washington, DC 26 July 2010

Court considered mitigating circumstances, such as an expression of remorse, cooperation with the court and time served
A U.N.-backed war crimes tribunal in Cambodia has found a former Khmer Rouge leader guilty of numerous crimes against humanity, and ordered him to spend 19 years in prison.

Prosecutors had asked for a 40-year sentence for former prison commander Kaing Guek Eav, better known as "Duch." But the court handed down a sentence of 35 years and then reduced it to 19, considering mitigating circumstances, such as an expression of remorse, cooperation with the court and time served.

He was found guilty for his role in the deaths of at least 14,000 people as the Khmer Rouge's chief torturer three decades ago.

Hundreds of victims of the Khmer Rouge regime gathered outside the courthouse reacted emotionally to the verdict - the first from the war crimes court.

Duch is the first of five senior Khmer Rouge leaders to stand trial for his part in the genocide committed in the 1970s. More than 1.7 million people - a quarter of Cambodia's population - died by starvation, disease, torture and execution.

Youk Chhang, director of the Documentation Center of Cambodia, which has spent more than a decade collating evidence against surviving leaders of the Khmer Rouge, says the verdict will play an enormous part in helping Cambodians to reconcile their tragic past.

Khmer Rouge leader Pol Pot died in 1998.

Duch admitted guilt but said he should be acquitted because he was not a senior leader and was just following orders. Cambodia has no death penalty.

Im am glad he will go to prison so some justice is served. Yet not TOTAL JUSTICE. How sad indeed,do people every listen to the PEOPLE. They wanted 40 years, but the courts gave him 35 then reduce to 19 years."mitigating circumstances, including remorse" what about the loss and pain do we hear their voices.

should put him in the prison for good . waste the MONEY , NO JUSTICE FOR thousands people who get killed by him.

The punishment does'nt fit the crime . According to what he has done, He should get locked up in jail for the rest of his life plus 50 years .

Anonymous said...

19 years in jail after he killed almost 20.000 people ? That's a joke .

Anonymous said...

That's fair, he was forced to torture and kill, more than half of his victims were Khmer rouges themself who killed 2 millions of Khmer republicans, mine included.
After all, the remain days of his life would be in Pailin near his children..

More leaders haven't been brought to justice and convicted of the killings,"All of the Khmer-Rough members"From the bottom to the tops no onces claim responsible for the deaths of 2.5 millions people died of torture, execution and starvation as well, they all denies the facts or they're say they din't know of the killings or torturing,Give us more justice for all.

The deserved to reduce jail term because he cooperation with the court, confession and feeling of remorse of that he did. The other KR leaders who still awaiting trial don't even admit their crime. Those people should be sentence to max life time in prison.

I have heard this somewhere:

"Killing one person is a CRIME, killing thousands is STATISTIC".

Perhaps this is the reason why it has been repeated over and over by human of all races, communists and otherwise.

I'd expect a life prison for Duch! This is a shared shame between the well-known Cambodia judicial system and the UN-back international system.

It really looks like this is more just a make-up show, rather than the real pursuit of justice!

With so much money spent on it so far, i'd rather suggest calling it a quit and use the money for the farmers' agricultural production improvement like building irrigation instead if no acceptable justice can be provided like this case.

It's just a waste of time and money. It's more like a freak show than an international court. I know that this guy was under order from top KR to send those innocent people to their death after inhumane torture but he has Maoist ideology since he was a teacher at Lycee Skoun. Believe me, I was one the students that he wanted to convert to Maoist thru one of his follower and also one of my classmates. He really gets away with 16,000 murders. Now we can see that every court in Cambodia, either Cambodian or mixed, is just a freak show, nothing to do with justice.

Cambodia, the land of EVILS.
I am so ashamed to be born Khmer.
There're few good men, but those men can't save Cambodia from the evils.

GOD and Buddha abandonned Khmers, because they are possessed by evils.
Let giant hole of the earth swallow Cambodia and let all be done with it. No more fight and no more killings against one anothers.

This evil should be send to life in prison or stone to death in the public..man!

Please, Khmers oversea, listen more to the films talking about justice, most of you have no idea about justice, you are criminal only when you commit crime voluntarily or you commit crime with negligence. Duch did not commit those crimes voluntarily either with negligence, he was imposed to do it..

19 years? is not enough for this killers and his group that shaped KR policy of that time! i hope he will die in prison by the time his 19 years is up. for khmer people, the KR people are unforgivable for what they did to the people, the country, their brutal policy, etc... that's why in cambodia, people would say an eye for an eye. i think khmer people are upset for him to get a light sentence like this! if it's up to the khmer people, this guy is dead already, that's how upset people are! you know, if you lived under the KR, you will understand what i mean; people are upset!

Anonymous said...

what i see is that court ruling will set a case into the future for those who committed atrocity again in cambodia. the court should send them a strong message that any regime who tolerate such brutality and inhumane activity like the KR will not be tolerated, period. yes, it was history now, however, we have to have some justice for the millions of victims, not to mention my country cambodia was destroyed beyond recognition, etc...!

We don't want him die quickly! we want him to suffering little by little...remembered those victims were tortured: using plier to pull the finger nails, toe nails? cut their stomach open and bled to death..? place a car tire on people neck and burn them alive..?
