Crimes from his past come back to haunt native Cambodian

Ly Hov Khol was a young child when he and his family fled the "killing fields" in Cambodia in the late 1970s, a period when 1 to 2 million people died of starvation and disease or were brutally executed under the Khmer Rouge dictatorship.

After spending time in refugee camps in Thailand and the Philippines, his family was welcomed to the United States as refugees five years later, when Khol was 10.

While in high school, Khol, who became a legal permanent resident, got involved with a gang.

In January 1995, he acted as a lookout as another gang member entered a house, shot a man dead, and fled with stolen goods. Khol got involved with the gang in another robbery three days later.

Khol pleaded guilty to third-degree murder, robbery and conspiracy in the first case, and to robbery and related offenses in the second. He was sentenced to eight to 26 years in prison.

After serving more than 12 years behind bars and getting paroled in June 2007, Khol, now 35, changed his life. Most recently, he's been volunteering with kids, cleaning up his neighborhood South Philly park and taking care of his mother and younger siblings.

But that's all at peril now.

Because of immigration laws passed in the United States, noncitizens who commit certain crimes are automatically deportable back to their home countries, and there's no hearing before an immigration judge.

Khol's ticking deportation time bomb sounded its alarm last Friday, when he checked in with the U.S. Immigration and Customs Enforcement office, as required.

ICE detained him, and he is now at the York County Detention Center, awaiting deportation to Cambodia, which could come at the end of this month.

"I can't eat, I feeling no good," Khol's mother, Sokhoeurn Khol, 55, said amid tears last night in her South Philadelphia home, shortly before community members held a rally at a nearby park to petition for Khol's release.

"We went through a lot," Khol's sister, Jeanette Khol, 20, said. She realizes that people may not care for her brother, since he committed a crime. But "people do deserve a second chance," she said, wiping tears from her eyes.

"He did his crime, but he also did his time."

If Khol is deported, he would be returning to a country he hardly knows. He doesn't know his relatives there. He can speak some Cambodian, but can't write it. "If he goes there, it's like throwing him to a shark," said Jeanette.

David Seng, a Cambodian-American who works at United Communities Southeast Philadelphia, a nonprofit agency where Khol was volunteering and taking job-training classes, said Kohl wanted to teach youths to not make bad decisions like he did and to stay in school. Seng said growing up here can be hard on immigrant children and teens.

"A lot of them get involved in gangs for protection," he said. "They get picked on in school just because they're different . . . We don't have a lot of role models."

Khol's father wasn't in his life. Jeanette said that her brother, tall but skinny, was picked on at Furness High School.

At last night's rally at 6th and Ritner streets, about 175 people showed up - many Cambodian, including three Buddhist monks.

Mia-lia Kiernan, of the Cambodian Association of Greater Philadelphia, told the crowd: "What happened to Ly, this is happening all over the East Coast now." Six people were just detained by ICE in Lowell, Mass., she said.

Since the United States and Cambodia signed a treaty in 2002, allowing Cambodians to be deported back to their home country, ICE was "deporting a lot of people from the West Coast," she said. "Now, they're coming over to the East Coast."

I think this US law need to be changed. I personally know two people that end up like this.

This guys made a bad decision in his younger years, he needs a second chance.

Everyone has a second chance in this country but not on this case .
I am sorry for his parents but he did it to himself . Most of people like that don't listen to their parents and some of them even look down on their own parents because they don't speak english . Now its too late to realize what he did was wrong not just against the law but against his parents advise too .

Come back home, man. Your land is not there. It's here in Cambodia. If you're a good man, you can survive no matter where you end up. And tell your sister that Cambodia is not a SHARK. More than 14 million people are living here. Although this land is not as good as the USA, it's our land, our home, and most importantly our life. We struggle here in hope of a better future and we won't run away.

I don't support this US rules to deport this guy back to Cambodia, bear in mind that Cambodia is not a rubbish dump. They throw the bad guy to Cambodia, this guy he deserve what he did, send him to Iraq or Afghanistan to fight with Terrorist.

As a Cambodian, I don't agree to receive this guy. What is he going to do in Cambodia? is he going to set up a gang group in Cambodia and spoil the good environment here? Shit!!!!

He will be a Robber in Cambodia, I am 100% guarantee that he will not survive. if he commit a crime in Cambodia.

You are right what you're all said. But, part of it is the parent. We know that in getto area, it is hard to raise kids and parent need to get out of there or look for better place to live. We got to get smarter here afer we used to live in Pol Pot regime. Another thing is, how come some of khmer kids that live in getto area are okay with it. I don't know the answer is. My guessed is how kid involves and wants. When I came in USA, I was a teenager living in a bad neighborhood too. But, I choosed school to try educated myself because my parent told me too. It is what it is. In this case, it held to point out to all khmer people to be aware of what USA going to do if you break the laws. I am sorry for Kol family and the victim family. They both lost their freedom and life.

Just Imaging, how Cambodian Govt let the person who committed crime in other country to be free in Cambodia???? Think yourself.

Both country have signed an agreement, who committed crime should be punished the same. event if he is deported.

He claimed that he is a changed man now. But that does not change the consequence of his crimes committed in the US. If he carries that attitude with him back to Cambodia then good shall find him there. Part of his "change" is the ability to accept that he deserves what he deserves due to his past involvement with gangs by killing two people with his hands. If he is truly sorry for having murdered two people-than there is no danger that he will intend to murder anyone in Cambodia?

A 34 y.o person was on my caseload before he was deported to Cambodia in September, 2008. He came to USA when he was 9. His story was exactly the same way described for the person in this article.
Occasionally I still keep in touch with him through Skype and email.
life was much tough when he arrived in 2008. Now he said life less struggle with him as he learns to navigate his new life and learn Khmer language and has a girlfriend. He was lucky since he continues to get financial support from his family here every two months. He gets in touch with me for advices and ideas along with emotional support. He did graduate from new arrival transitional program run by US sponsor resettlement services.

Human being has a natural instinct to learn new skills. I feel sympathic for the family but I think Khol will just be doing fine overthere.

To all my people in the United State and in Cambodian. I respect each one of our people the same level, no matter you are higher, middle or lower class. We all created equal as a human life. Event though you very well educated here in the United State, we never get hired than their own people. The same as Cambodain, some parents are working very hard, suffered and trying many ways just to have money to send their children to school in hope of their children get better job to support the family. But, unfortunately none of those are exist, just because they known none of the insider peoople. The same thing in the US. The only different is that US is the country of the opportunity. Our country is still political corruption. Look at Hun Sen and his wife. They put their kids into good school and well education with well paid job, and that because of the money from other country support for our country. What they did, they had to take careown family 1st and let our poor people suffered. Now their children all growth with well paid and well educated. They started to help the people, just to show they are helping us. So, let us stop hated each other. Learn to love and support our own people, nobody want to make mistake or do bad. I understood in the "80 were horrifeid to adjusted the living situation in the United State. The different race whom lived here 1st though we were here to take over their places. They burned our people house, got hitted by their ganger everywhere we were going. Were never safed at all. Plus we just refugee from Thai Camp which were another abused already. I blamed on nobody when the kids turned bad. I definitely blamed on our corruption political. They the one that kicked us out from the country which were never intented or prepare ourself. I strongtly support the STOP of Deporatation and give them the chance to change. I also love my country, I only hated the higher educated people never support the poor that all. I wish the new generation insider and outsider have more educate to bring our country back to life. Please educate our children to get higher education to help our country stroger. Stop hate each other for nothing. Their was nobody at fault. Let go back to work for our country. Stop letting the other country insulted us that they can send people back when ever they need too. It's heart breaking to see his mom crying, but look at this way: America doesn't want you, if you have committed a crime. Everyone alike. Going to apply for a job? The door is more likely close for someone that have better resume than him. So Going to Cambodia may not be bad place, you know English dude. If you heart is changing, go and open a private English class in Cambodia, earn some money get marry and raise a happy family. Your mother and sister are not going to look at you with just their eyes. Take care and Mom stop crying... move on to a better tomorrow and go visiting him later for a month or two if you like. It calls a US citizen, a passport and an airplane ticket. Who knows that his future home may be the best vacation home you ever visit in the world? and good luck!

Should you look at 3:42 am as an opportunity of a life time? No only if you have to. Let's not forget that America is still the best place in the world to live and if you want to live here, watch where you're going and stay clean. It's the number 1 land of choice. Do what you want.Pursue your happiness and dream however you want, just don't disrespect of other and don't commit crime. People got hurt and killed , because of someone like you. Hope one of the boy who attend the same school, I went to, get caught and be thrown in jail. That sucker was trying to rip a bag off my hand when I got off from a subway. Guess what? He thought he got it. He ran one way and I the other, but he only got the string of it. hehehehe....I could have gone to the police, but I was too young and naive in a new land. It was in the summer and the next day school started, was in the fall. I have never seen him again. He either graduated or going to jail doing the same thing to someone else. I left Philadelphia the following year and never really care going back. Too many getho people living in Philadelphia. America has better places

If i have a son, I'd be happy to let him deport back to cambodia, he need to learn the life of where his ancestor came from. Let me ask you all or even the immigration agent that read this. If there is a survivor of the victim that he murder living in Cambodia is willing to forgive his crime?
Would they murder him as soon as he get off that airplance? Would that be just send him get murder there?

Folks - whether you like it or not this man is coming back to his birth country Cambodia.

The US and Cambodian gov't have a treaty in place to send/receive people like him.

If you don't like this treaty, then lobby both governments to change this agreement.

The US have also sent many Salvadorians hardcore gang members back to El Salvador.

There are many wealthy Chinese, and Asian Indian who would pay hundreds of thousand to come to the US and do business. Millions of people want to come to the US.

Please tell me why would the US would put up with tax wasting criminals, and not allowing those who have the ability to contribute the economy like the Chinese or Indians?

Cambodian in American - don't waste your opportunity to better yourself. Get good education. Don't associate with criminals or you too become a criminal.

Although I strongly disagree with the US Immigration Law, I do... however stronly agreed in deporting this Slumbag back to slum-land. This gangbanger have too many chance as a good citizens, but chose not to. Second chance is, when he committed his first robbery, which involved taking a life. He should of stop right there and then. But no! He decided to repeat his crime spree three days later. This piece of shit didn't give a damn about the life he took. Therefore, deporting his stupid ass is more than justifiable. He is lucky to have lived for another day. You can't say the same to his victim.
The US Law is:
1: commit crime
2: do time
3: deportation preceeding
