Four Jailed Khmer Rouge Leaders To Be Tried Together

Washington & Phnom Penh Tuesday, 17 August 2010

Lars Olsen, a tribunal spokesman, said the four will be tried together because they are charge with “the same crimes, the same criminal plans, the same evidences and [use] the same witnesses.”
The four senior-most leaders of the Khmer Rouge currently in custody at the UN-backed tribunal will be tried as a group, court officials said Tuesday.

Nuon Chea, Khieu Samphan, Ieng Sary and Ieng Thirith will be tried together at once next year, said Kranh Tony, acting administrative director for the court.

Lars Olsen, a tribunal spokesman, said the four will be tried together because they are charge with “the same crimes, the same criminal plans, the same evidences and [use] the same witnesses.”

That trial could take place as soon as March 2011, officials said.

The administrative announcement comes a day after all four were indicted by prosecutors, who sent in their final submissions on Monday. In that submission, prosecutors did not recommend that Kaing Kek Iev, the prison chief better known as Duch, should not be tried with them, although investigating judges can still determine to put him on trial.

Duch received a commuted sentence of 19 years from the tribunal last month, for his role as chief commander of the center.

The prosecutor submission calls for charges of genocide, crimes against humanity, grave breaches of the Geneva Conventions and violations of Cambodian law.

“The Co-Prosecutors believe that the evidence collected in the judicial investigation demonstrates that the Charged Persons committed these crimes through a joint criminal enterprise, the purpose of which was to enforce a political revolution in Cambodia and systematically destroy any opposition to the [Communist Party of Kampuchea] rule,” according to the submission.

Joint Criminal Enterprise is a complex legal theory that seeks to put different defendants together for trial.

Prosecutors said that through joint criminal enterprise, those charged had “enslaved the Cambodian population, deprived them of their fundamental human rights and freedoms and orchestrated mass killings of individuals that the Charged Persons and other CPK leaders perceived to be real or potential enemies of the CPK.”

Son Arun, an attorney for Nuon Chea, said Monday he would need time to read the prosecutors' decision before commenting.

Investigating judges will now review the prosecution's submission.

Can't wait until 20 years from now when a newer generation of Cambodians place Hun Sen, Heng Samrin, Chea Sim, and a few others on trial on accounts of crimes against humanity, money laundering, and treason. Hopefully, most Cambodians by that time aren't so ignorant and retarded as they are right now.

There are two kinds of Youns: Youns Pol Pot slaughtered millions of Khmers and then Youns Hun Sen came and helped Khmers but wanted some lands in exchange, and continue to have some more, so think about it your stupid Khmers. Khmers will be the same as Champa if Khmers don't stand up and do somethings.

Communist Vietnam and China were together at the start. All Cambodian people have to leave their homes and former jobs on April 17th of 1975. Mr. Hu Nim and Hu youn opposed to it. What happened to them? They got killed. Then came the late months of 1976 and 1977. The words CIA and KGB appeared at every Khmer Rouge's meeting. If anyone would have any connection to any of these two words, you'll be taken away and then be destroyed or killed. Ten of thousand of innocent people died. Simply because they were just friends. Young people in their teenagers and early twenty were removed one by one. Then came great fear, starvation and decease which paralyzed the entire population. The UN court has every right to call these monsters to ask them why they do what they did? and who gave them power and support to do all evils things in Cambodia during those years?

Removing people from their homes and jobs on April 17th of 1975 gave those monsters the biggest door to abuse Cambodian people. They can do whatever they want and however they want. The border was closed. There was zero communication going through Cambodia from the outside world and between the people. You tell us when all eyes and ears were closed to the people inside the country. Please show them the evident of what happened to Cambodian from their strangest and bazzar action, because those monsters seem like they don't know anything about it. Well Mr. Noun Chea, Kiev Samphan , Eng Sary and Mrs. Eng, it was because you have destroyed all the former staff , ruled and law that was one effectively running Cambodia humanly and peacefully. When you do away with everything they have like their homes their family and their skill, you will have none of those to defense the innocent. Therefore you allowed all short of lawless acts and criminal activities to cover Cambodia freely. The result, you have destroyed millions of people. All four of you must be punished for this horrible crime against humanity. Also your bosses must be paid as well for this great destruction of the Cambodian people. Thank you

$ 100 millions a year for two centuries paying for every person that died between 1975 and 1979 by Communist government who committed crimes against Cambodian people. Also they must denounce their regime as soon as possible and justice will be fully served in Cambodia.

Q: Who should be held responsible for the murders of Boeng Trabek inmates?
