Khmer Rouge Defendants To Remain in Custody for Trial

“If the trial keeps getting delayed further and further, Nuon Chea's lawyer team will find ways to ask the court to release our client on bail.”
The Pre-Trial Chamber of the Khmer Rouge tribunal has affirmed the indictments of four regime leaders and determined it will keep them in provisional detention ahead of trial.

The court said in a statement Thursday it has officially “ordered the accused persons to be sent for trial and to continue to be held in provisional detention until they are brought before the Trial Chamber.”

The announcement means no claims by the defense to end the trial process were admitted by the chamber.

Four seniors leaders—Nuon Chea, Khieu Samphan, Ieng Sary and Ieng Thirith—are awaiting trial for atrocity crimes, including genocide, with the trial process expected to begin later this year.


Lawyers for the accused say their clients have been detained past the maximum three-year period allowed by law.

“If the trial keeps getting delayed further and further, Nuon Chea's lawyer team will find ways to ask the court to release our client on bail,” defense attorney Son Arun said.

The three-year pre-trial detention period expired at the end of 2010, but the rules of the court are open to some interpretation.

Phat Povsean, a lawyer for former social affairs minister Ieng Thirith, said the defense can only argue about court procedures to the Trial Chamber, but the Pre-Trial Chamber's decision is final.

Why KR trials or KR Tribunal so afraid of Nuoun Chea speaking out about innocent Khmer who were killed between 1975-1979.
My research has found the following between 1975-1979 :
Pol Pot regime came to power before and during 1975-1979 by 2 totally different groups.

1. Group 1 , a group of student from Paris Included Pol Pot himself.
2. Group 2 , a group of Khmer Viet Minh, Viet Cong like So Phim former boss of Khmer Viet Minh like Heng Sarin , Chea Sim ect.. .
3.
And Khmer Viet Minh Group had more troops in their hands more than Pol Pol group.

So the killing of Khmer innocent people between 1975-1979 not less than a half of the Khmer victims were killed by those Khmer Viet Minh like So Phim ( brother number 4 as Ta Mok said when he was still alive ) .

Indirect or direct killing of Khmer innocent people between 1975-1979 were involved with :

1. Yuon ( direct )
2. China.
3. Former Soviet Union.
4. US.
So Yuon , China, Former Soviet Union and US have tried to put the blame on Pol Pot group ( of course as a General secretary of Cambodian communist party Pol Pot had to take full responsibility )
But as Khmer victim if we look closely at KR Trials or ECCC Hun Sen has done everything to slow down and has shown very clearly that Hun Hen never want to speed up this historical court for Khmer victims.
Look at what Hun Sen has done:
1. Causing corruption in ECCC.
2. Shut down the ECCC if more indictment taken place.
3. No cases number 3 and 4.
4. Keep dragging on and on.
5. A lot of thing going behind closed door of this historical court for Khmer victims.

That why this court has afraid of Nuon Chea speaking out the real cause of so many Khmer killed between 1975-1979.

And now we have those Khmer Viet Minh running Cambodia under the name of CPP.
