Analysts See Role for International Court in Border Row

“Only the court can define whose land it is.”
With Thai and Cambodian foreign ministers meeting in Jakarta on Tuesday, Cambodian analysts say the best way to resolve an ongoing border dispute is to call on the International Court of Justice to clarify a decision it made in 1962.

That decision, which handed Preah Vihear temple to the Cambodians, who had filed for it, could also clarify a disputed area of 4.6 square kilometers of land near the temple, analysts said this week.

Cambodia is hoping that meetings among Asean ministers in Jakarta will bring about a resolution to the violence stemming from the dispute, including deadly clashes earlier this month.

However, proponents of the court clarification told VOA Khmer that the UN Security Council and Asean, both of which have weighed in on the conflict, are political bodies that can perhaps bring about an end to fighting but cannot fix the underlying issue of the land dispute itself.


“Whose land is the 4.6 square [kilometers]?” asked Prince Norodom Ranariddh, the head of a self-named royalist party, in an interview with VOA Khmer. “Without such a question, the Cambodian-Thai issue cannot be solved.”

Only the international court can decide, said Chheang Vannarith, head of the Cambodian Institute for Cooperation and peace.

“Only the court can define whose land it is,” he said. “Because the UN and Asean mechanisms are only political mechanisms, just to stabilize and bring peace and security along the border, they cannot find a solution as to which part belongs to the Thais and which part belongs to Cambodians.”

Cambodian officials have said that in fighting between Feb. 4 and Feb. 7, Thailand crossed into Cambodian territory, a claim the Thais have denied. The fighting forced thousands from their homes and killed at least seven Cambodians, including two civilians.

Ahead of Tuesday’s Asean talks, Cambodia said it was optimistic a lasting ceasefire can be achieved, but the question of the disputed borders remains unanswered. A number of Cambodian analysts don’t believe Asean will be able to solve the problem for the long term, pointing instead to the international court.

Thai officials have maintained they want to solve the issue bilaterally, but in the wake of February’s fighting Cambodia’s leaders dismissed the effectiveness of two-way talks and are seeking Asean’s help as a monitor to later talks.

A court official told VOA Khmer that the Preah Vihear temple case has already been decided and any clarification or re-interpretation of the decision would require an official request by both parties. As it stands, the official said, neither side has made a request.

Why do Kos Trol, sea and lands proximately over 10 000 km2 have been lost to Vietnam by who treaty? Why don’t Cambodia goverment transparencies explain to Cambodia army at front line and the whole nation about this? Why don't they include this into education system? Why?

Cambodian armies are fighting at front line for 4.6 km2 and what's about over 10 000km2 of Cambodia to Vietnam. Nobody dare to talk about it! Why? Cambodian armies you are decide the fate of your nation, Cambodian army as well as Cambodian people must rethink about this again and again. Is it fair?

Kos Trol, Sea and lands over 10 000km2 have been lost to Vietnam by who treaty at 1979 to 1985 treaty! Treaty! Cambodian army at front line as well as all Cambodian people must rethink again about these issues. Are Cambodian army fighting to protect the Cambodia Nation or protect a very small group that own big lands, big properties or only protecting a small group rather in the real name of protecting Khmer nation?

Cambodian army at front line suffer under rain, wind, bullets, bombs, lack of foods, lack of nutrition, their families have no health care help, no securities after they die but a very small group eat well, sleep well, sleep in first class hotel with air conditioning with young girls message, have super health care from oversea medical treatment, they are billionaires, millionaires who sell out the country to be rich and make Cambodian people suffer everyday as Cambodian people know already.

Who signed the treaty 1979-1985 that result lost over 10 000 km2 of Cambodia??? Why don't they transparency inform all Cambodian and Cambodian army at front line about these issues? Why don't include Kos Trol (Kos Trol size is bigger than the whole Phom Phen and bigger than Singapoor with heap of great natural resources) in education system in Cambodia.

Look at Hun Sen families, relatives; friends are billionaires, millionaires where do they get the money from if we all just get out of war with empty hands? Hun Sen always say in his speech Cambodia just get up from war, just get up from Zero with empty hands and how come they are billionaires, millionaires but 90% innocent Cambodian people are so poor struggling with living every day.

Don't go into the Thais' trap/strategy. There is no 4.6km square. It exists only on the Thais's unilateral map. The ICJ decision was final.

To stop the the dispute now and in the future Cambodia must be strong economically and militarily. No negotiation is going to solve this if Cambodia is weak, doesn't matter in any platform UN, ASEAN, ICJ....etc....The Thais will drag on this issue when ever they want to.....so don't give too much weight on the deal in Jarkata or else where.....

The bottom line is build up the military now regardless. They won't give up their ambition....it's not about the Yellow or Red Shirts not getting along with each other.....it's about Thais ambition and greed. In the real world Ambition and Greed is countered by Force - it's the only language that it can understand.

the way i see it, siem is exploiting cambodia and the world's ignorance on cambodia. don't buy into siem thugs' greed, jealousy and violation of the international law, emotional rankling, etc, etc! cambodia will only go by the international law, it's in our gene, really! of course, we will act in self-defense if attacked, you know!

Thailand bullies and looks down on Cambodia but when it comes to deal with the International organizations they please them or should I play a good guy. This is the Thai back stabbing mentality. That's why Cambodia should always be careful when dealing with ruthless people.
