A Thai flag has also been hoisted in a disputed area near the Preah Vihear ruins, where the flying of a Cambodian flag has raised tensions, Prime Minister Abhisit Vejjajiva said on Tuesday.
Mr Abhisit said this information was included in a situation report made by Defence Minister Prawit Wongsuwon.
"We have never said that the Keo Sikha Kiri Svara pagoda should be demolished. We said only that the Cambodian flag flying over the temple should be removed.
"But, meanwhile, we have also flown our flag there," the prime minister said, but did not elaborate.
The Keo Sikha Kiri Svara temple is located in the 4.6 square-kilometre disputed area adjoining the Preah Vihear temple.
The prime minister admitted that Thai and Camboldian military forces were confronting each other along the border.
However, there should be no problems if both sides observe the 2000 memorandum of understanding, and this is the best way of solving the Thai-Cambodian dispute, he said.
Mr Abhisit said Thai and Cambodian authorities have been in contact to ease the tension and prevent possible border infringements by either side.
National army chief Prayuth Chan-ocha also said earlier today that a Thai flag had been raised in the 4.6 square-kilometre disputed area where both countries claim ownership.
"We have done that acting on orders," Gen Prayuth said.
The army chief insisted that the best way to settle the border dispute with Cambodia is by formal talks.
It is most important the problem is resolved by negotiation through the Thai-Cambodian Joint Boundary Commission (JBC), he said.
The Foreign Ministry was trying to arrange a new meeting of the JBC to discuss the matter.
The situation along the border remained normal today, and the 2nd Army was well prepared to ensure peace and order in the border area, he said.
The Cambodians had similar security measures along the border, but that did not mean the two sides were on the verge of clashing with each other, said Gen Prayuth.
“The use of force will be the last means we will turn to.
"It’s now the government’s duty to try to end the problem through talks," he said, reiterating that Thailand had not lost any territorial sovereignty to Cambodia.
Meanwhile, the Criminal Court rejected a lawsuit filed by two members of the People's Alliance for Democracy (PAD) against Prime Minister Abhisit and three other ministers for alleged negligence causing the loss of territorial sovereignty to Cambodia.
The other three named in the suit were Deputy Prime Minister Suthep Thaugsuban, Foreign Minister Kasit Piromya and Defence Minister Prawit.
The lawsuit was filed on Jan 26 by Samdin Lertbutr and Tainae Mungmajon, two of the seven Thais arrested by Cambodian soldiers on Dec 29 for illegal entry.
The two were freed after a nine-month jail sentence was handed down on them by the Phnom Penh Municipal Court, which found them guilty, was suspended on the grounds that they had already served nearly one month in jail.
The Criminal Court rejected the lawsuit, ruling that it had been filed with the wrong court.
It should be filed with the Supreme Court's Criminal Division for Holders of Political Positions under Section 275 of the constitution, the court said.
PAD co-leader Chamlong Srimuang claimed the government has a three-stage plan to disperse the yellow-shirt protest outside Government House.
Maj Gen Chamlong said the government would send senior police officers to ask the yellow-shirt protesters to unblock roads when there is actually little traffic.
The police had changed the settings so traffic lights stayed on red longer, causing people to be frustrated and blame the rally, he said.
The government would then send undercover agents into the rally to stir up confusion and conflict among the yellow-shirt group.
The final stage would be the deployment of more police and a crackdown on the protesters, he said.
"The government's attempt will fail because the PAD will not move anywhere unless the government accedes to our three demands," Maj Gen Chamlong said.
He said the government should concentrate on the Thai-Cambodian problem instead of focusing on the yellow-shirt protesters.
"As a professional demonstrator, I can affirm that our rally will not end. If our rally is dispersed today, we can start it again tomorrow.
"If the government refuses to protect our country we won't end our rally," he added.
The yellow-shirt key member said he had lost count of the number of lies Prime Minister Abhisit had made about Thai-Cambodian border issues.
The government had begun to take action only when the PAD revealed the information about the Cambodian flag being hoisted near Preah Vihear temple, he said.
He said the government should not give in too much in its dealings with Cambodia.
The PAD started its peaceful protest outside Government House last Tuesday, pressing the government to withdraw from the Unesco World Heritage Committee, scrap the memorandum of understanding on the Thai-Cambodian border signed in 2000, and expel Cambodian people from disputed border areas.

They also use this issue for their political gains. Please bring it to the UNITED PERIOD. This could be HUN SEN example:

3. The vision thing. Say what you want about Gamal Abdel Nasser and Anwar Sadat, but Mubarak's two predecessors knew where they wanted to take the country and had a plan for getting there. Nasser wanted to create a pan-Arab union under the banner of socialism and non-alignment, while Sadat sought to regain Egypt's martial pride before making peace with Israel and joining the West. As for Mubarak, what does he offer Egyptians? Crumbling infrastructure, decaying socio-economic conditions, and utter fealty to the United States.
4. Half-hearted reforms. Egyptians have grown rightly cynical at their-government's on-again off-again reform efforts, characterized by unpersuasive propaganda or Orwellian doublespeak. When they hear the word "reform," Egyptians look for the catch, such as the constitutional amendment that more or less bars independent candidates from contesting the presidency.
5. Grooming Gamal. If there's one thing nearly all Egyptians agree on, it's that they don't want to be ruled by Mubarak's British-educated son. Over the last decade, Gamal played an increasingly visible role in setting domestic policy, tying his fortunes to unpopular liberal economic reforms and wealthy businessmen who are seen as corrupt and out of touch with ordinary Egyptians. Some of the most popular chants at demonstrations in recent years were variants of "No to inheritence!"
6. Underestimating the activists. Clearly, the Interior Ministry and the police were not prepared for the surge of protesters that first hit the streets on January 25. Accustomed to small demonstrations organized by Egypt's utterly inept, fractious opposition parties, the security forces clearly expected more of the same. But the organizers behind the current uprising are networked, tech-savvy young people who obviously know how to connect with their audience and get the word out. They're not from the political parties. The police were clearly rocked back on their heels, exhausted, and outmaneuvered last Friday -- and that's when the army had to step in.
7. Cheating too much. In most of the parliamentary contests during his 30 year reign, Mubarak has allowed a token number of seats to go to opposition parties. But in the 2010 elections, the NDP's rigging got out of control, leaving only a handful of seats for the coopted Wafd Party. The Muslim Brotherhood was shut out, leaving it with no stake in the government and the patronage opportunities that go along with representation in parliament.
8. Sending in the thugs. After the police forces mysteriously dissolved Friday, reports came streaming in of looters attacking people in the streets, breaking into shops and homes, and otherwise intimidating ordinary Egyptians. Many of these thugs were found to be carrying police or state security IDs. If Mubarak's hope was to drive the middle class back into the loving arms of the state, it seems he badly miscalculated -- the protests have only gotten bigger since then.
9. Bringing in his cronies. Despite his Friday speech vowing to enact various unspecified political and constitutional reforms, Mubarak named his spy chief Omar Suleiman his vice president, dumped his cabinet, and named a retired Air Force general as his prime minister. Opposition leaders and analysts rightly interpreted this as a sign of business as usual.
This is hardly an exhaustive list, and I imagine Mubarak will make a few more major mistakes in the days ahead. What do you all think he got wrong? Please weigh in below.
Thai should be smarter by now but not!. Thai have this arrogant behaviour because of British support. So, now China, Viet and USSR... are planning to get through to Thailand by using Khmer to break through this war. If Thai is smart, they should back off from this 4.6km before they lose it all, it is called the 'domino effect' where the east against the West. The victims are those in the middle or the uneducated one...Be smarter Asian nations, in the end we belong to the earth and the earth does not belong to us.
4.6km is nothing compare to human life and dignity of individual. To win the war one has to back of and do the right thing. So, please turn around and try to work with each other as a team instead. war will not get us no where but more distruction.
In the end, it will cause more chaos and more pain and suffering to those who involved in the process of war. Overal it will also affect other nations as to who is willing to accept more refugees?
How to achieve this? by using a diplomatic dialogue with all Asian leaders. No need to argue between which country is which, as it is already been existed years ago in the world map. No need to manipulate or cheat or lies about anything that is not yours.
We need an Asain Nations Body of Maping to watch over all of them. If one makes mistake the rest of Asian will warn it or telling it to back off or otherwise a force to replace the new leader for not resting the world agreement etc...
Now, if diplomatic dialogue is not working, we then have no choice but to order more nuclear bombs, jet fighters, to protect ourselves from being attack from any other threats... Aust

Statement of the Ministry of Foreign Affairs of Thailand concerning the flag over the “Keo Sikha Kiri Svara” Pagoda
With reference to the Declaration of the Ministry of Foreign Affairs and International Cooperation of the Kingdom of Cambodia dated 28 January 2011 regarding the issue of the flag of the Kingdom of Cambodia that is flying over the “Keo Sikha Kiri Svara” Pagoda, the Ministry of Foreign Affairs of the Kingdom of Thailand wishes to state the following:
1. According to the Memorandum of Understanding between the Government of the Kingdom of Thailand and the Government of the Kingdom of Cambodia on the Survey and Demarcation of Land Boundary of 2000, the 1904 and 1907 Treaties and “other documents relating to the application” of both treaties are the relevant legal documents to determine the boundary line. Thailand therefore does not accept the assertion by Cambodia that the 1:200,000 Map is the basis for determining the boundary.
2. Cambodia also admitted in the afore-mentioned Declaration that the decision of the International Court of Justice (ICJ) of 1962 did not rule on the question of the boundary line between Thailand and Cambodia.
3. Thailand maintains that the “Keo Sikha Kiri Svara” Pagoda is situated on Thai territory, and demands that Cambodia remove both the pagoda and the Cambodian flag flying over the pagoda. This is a reiteration of the many protests that Thailand has submitted to Cambodia regarding the activities carried out in the pagoda and the surrounding area, all of which constitute violations of sovereignty and territorial integrity of the Kingdom of Thailand.
4. The Ministry reaffirms Thailand’s commitment to resolving all boundary issues with Cambodia in accordance with international law through peaceful means under the framework of the Thai-Cambodian Joint Commission on Demarcation for Land Boundary (JBC). The determination of the boundary line in the area of the Temple of Phra Viharn is still subject to on-going negotiation under the framework of the JBC.
