Prosecution Wants Increased Sentence for Khmer Rouge War Criminal Duch

The prosecution at Tuesday’s appeal hearing for Comrade Duch, the former head of the Khmer Rouge's notorious S-21 prison, has asked the United Nations-backed war crimes tribunal to increase the jail term it handed down last year.

March 29 marked day two of the scheduled three-day appeal court hearing for Comrade Duch, the Khmer Rouge’s former chief jailer, who has asked to be acquitted and released.

Last year, the United Nations-backed tribunal sentenced Duch to 35 years in prison but reduced the term to 19 years because of time served and other factors.


The lower court had found Duch responsible for the deaths of more than 12,000 detainees at S-21 prison, which he headed between 1976 and 1979.

Displeased prosecutor

On Tuesday, international prosecutor Andrew Cayley told the seven-judge Supreme Chamber bench that the lower court’s sentence was manifestly inadequate.

He pointed out Duch’s change of strategy in the final days of his 2009 trial, when the 68-year-old defendant asked the court to acquit and release him. That represented a stunning 180-degree turn, after nine months of Duch telling judges he was "guilty but sorry."

Cayley says the lower court was mistaken to have placed so much weight on mitigating circumstances.

He cited a number of areas in which he felt the lower court had been too generous - including Duch’s numerous expressions of regret which he feels were bogus.

"In respect of remorse: the accused’s continued requests for release underscores in a case like this - involving massive criminality - the fact that the accused, to this day, lacks real sincere remorse for what happened," Cayley said.

What Duch did

S-21 prison, which Duch oversaw for three years, was a secret center where the Khmer Rouge sent thousands of perceived enemies of the revolution.

An estimated 15,000 people were tortured and interrogated at S-21 and then killed after Duch signed their execution orders.

Despite that, Duch’s lawyers told the appeal hearing Monday that their client should be freed.

They claim that Duch's case does not fall within the court's mandate because he was not a senior leader of the Khmer Rouge. They say he should be acquitted and freed.

On Tuesday, Duch’s lawyers said their client was a man who had acted under duress, expressed remorse and had not benefited, personally, from his years spent running S-21.

The defense repeated that Duch had simply been following orders and that, if he had not done what he was told to do, he would have been killed. His lawyer went so far as to describe Duch as a good man.

Life term

Not surprisingly, the prosecution disagreed. Andrew Cayley says the appeal court should increase Duch's sentence because of the gravity of his crimes.

Cayley says the prosecution recognizes Duch is entitled to some time off as compensation for being held illegally by the Cambodian authorities for years before his trial.

"But we call for the imposition of a life term, reduced to 45 years simply to take account of that period of illegal detention," Cayley explained. "But, for the purposes of history, a life term must be imposed in this case for all of the reasons I have stated. "

Duch’s appeal is scheduled to conclude on Wednesday and represents his last chance for release.

The appeal chamber will deliver its verdict in June.

Duch is not that person to go to jail, but Yuon/Vietcong Hanoi, Vietcong secret agents, Hun Sen, CPP Yuon high ranking officials are the ones to be punished and trialed for the crimes against humanity and to be jailed.

2 millions of innocent Khmer/Cambodian people were killed by Yuon-Vietcong secret agents when they pretended to be Khmer Rouges armies or soldiers or Khmer Rouges cadres. They were Yuon spies among Khmer Rouges, Lon Nol and Khmer people from 1970 to 1979.

The international communities and the UN need to know the facts, investigate more and do more researches, finding out how the Killing Fields started and who were behind all the killing of innocent Khmer/Cambodian people and foreigners.

The Vietnam politic principles were created since 1929.Khmer Vietminh were the Vietnam spies.After that Vietcong have been worked step by step to wipe Khmer people out of the Cambodia.
The Khmer Vietminh spread out all over Cambodia in 1948;some of them are working as assemblymen president,
Chea Sim,Heng Samrin,and Pen Sovann.
The Khmer Vietminh who served Vietnam
mixing with Khmer Rouge.
Pol Pot knew all the Vietminh inside his regime.So Pol Pot were scared to death;then he saw everybody being enemy to him.

Dear all Khmer on this great blogs let me draw you some attention about Duch and 2 million of Khmer lives who passed away between 1975-1979 .

But before talking about Duch let me personally condemn any kind of killing humen being especially killing innocent Khmer people .

As the victims ourselves we all know that between 1975-1979 there are 2 million lives of innocent Khmer people were killed brutally in Cambodia but not in Phnom Penh all were killed outside the capital city.

And we all know that those lives in Phnom Penh between 1975-1979 most of them were Khmer Rouge cadres and Khmer Viet Minh only a few city people who were lucky to live and worked in Phnom Penh
in the factories.

So most of those who were sent to S 21 prison ( 20 thousand ) all of them were Khmer Rouge cadres and their families and Khmer Viet Minh 98%.

For 2 million Khmer lives were not killed by Duch But were killed by other prisons ( in KR days there were about 195-196 prisons ) by starvation , overwork ect….. .

So the real killers of 2 million of Khmer people are still at large.

So no justice for 2 million of Khmer people .

3:00 AM, you need to leave him alone. You know NOTHING what and who were behind all the killing in the Killing Fields. You need to study and do research more before you think that Duch was NOT a killer because of two millions innocent victims, died or murdered. There are many killers of two millions victims between 1975-79

The owner of Golden Star Palace Chinese Restaurant at Cabramatta is former Khmer Rouge Military Commanders who murdered thousands of innocent Cambodian life during Pol Pot regime. If they condemn and bring Kaing Guek Eav (Duch) to justice why Khmer rouge court of justice should be exemption the owner of Golden Star Palace that murdered thousands of Khmer lives and took their belonging such as gold, jewelry, diamonds to Australia become very rich family and live in peace like theses. That is very unfair to human being that he murdered very cruelty and painful death.
We are Khmer people and Khmer Communities around the world would like Khmer Rouge Court of justice, KI Media, VOA, Radio Free Asia, Radio France International, Mr. Sam Rainsy, World Human Right Group, UN, World Court Of Justice, Australian Government to bring this war criminal to justice like Kaing Guek Eav (Duch).
We are human being we must not support war criminal who murdered thousands human life like this.
