PHNOM PENH, March 29, 2011 (AFP) - Prosecutors at Cambodia's UN-backed war crimes court on Tuesday appealed for a life term for former Khmer Rouge cadre Duch, saying he lacked remorse for overseeing the deaths of some 15,000 people.
Duch, 68, was sentenced to 30 years in prison last July for war crimes and crimes against humanity for his role at the notorious torture prison Tuol Sleng in the late 1970s.
The prison chief, real name Kaing Guek Eav, was the first former Khmer Rouge cadre to face an international tribunal and both the defence and prosecution are appealing against the punishment in three days of hearings at the court.
During his trial, Duch repeatedly apologised for overseeing mass murder at the detention centre -- also known as S-21 -- but shocked the court by asking to be acquitted in his closing statement in November 2009.
Co-prosecutor Andrew Cayley said on Tuesday that this U-turn showed Duch "to this day lacks real, sincere remorse for what happened".
The defence team claimed in their appeal on Monday that Duch should never have gone on trial because he falls outside the court's mandate to prosecute the regime's senior leaders and those most responsible for crimes committed.
They argued that their client was "just a minor secretary" following orders and he should therefore be released.
Cayley said this claim was "inconsistent" with Duch's earlier admission of responsibility for "grave crimes" committed at S-21.
"The accused's belated challenge to the legal basis for his prosecution and his request for release highlights, in my submission, the insincere, selective, and opportunistic nature of his cooperation with this court," Cayley said.
He argued that the original sentence was "manifestly inadequate" and placed undue weight on mitigating factors.
"We call for the imposition of a life term, reduced to 45 years" to take into account the period Duch served in unlawful detention, Cayley told the Supreme Court Chamber.
Prosecutors also said they want enslavement, imprisonment, torture, extermination, rape and other inhumane acts to be added to Duch's list of convictions.
Appearing in the courtroom for a second day, again wearing a white jacket over a powder-blue shirt, Duch appeared to listen attentively to the arguments and did not address the court.
At his trial, Duch was originally given a 35-year jail sentence but this was reduced for the period of unlawful detention.
Given time already served, Duch could walk free in less than 19 years, much to the dismay of many victims of the brutal 1975-1979 regime.
A ruling on the appeals is expected in late June.
Led by "Brother Number One" Pol Pot, who died in 1998, the Khmer Rouge wiped out nearly a quarter of Cambodia's population through starvation, overwork and execution.
S-21, in Phnom Penh, was at the centre of the regime's security apparatus and thousands of inmates were taken from there for execution in a nearby orchard.
Duch has been detained since 1999, when he was found working as a Christian aid worker in the jungle. He was formally arrested by the tribunal in July 2007.
Four more of the regime's former members -- including "Brother Number Two" Nuon Chea -- are due to go on trial later this year and Duch is expected to appear as a witness in the case.

He begged for forgiveness, but when he killed khmer people without trail. I think all victims were begged Duch for survive but bamboo, gun, and things beat victims to die with barbaric situation. My father was died in that regime. One of my life, I have never seen my father face because i was born only three months while my dad was killed. what i have to do? I die to cry for fair for my dad like khmer people. However, I am anxious death to know why UN and International community allow that regime like WWII or they want to dismiss khmer ethic in the world. It is not happened in Cambodia, Bosnia, One of Africa nation I dont know this country name. They, UN, all blind and motherfucker diplomacy idiot people. Now I want UN open your wide eyes to the world which country commit massacre? I think no more this issue happen again because UN will protect mild people from cruel power person. If not, when you, UN, died god will punish you to hell. Please do kind all people around the world and keep planet exist in solar system.
Duch has not to be free,he must stay for life in the prison;after his death he must get chained for 15,000 years at minimum.
For good behavior in the courtroom, the court should reduce Dutch's sentence from life to 99 years in hard labor camp. With no chance of parole.

Dear all Khmer on this great blogs let me draw you some attention about Duch and 2 million of Khmer lives who passed away between 1975-1979 .
But before talking about Duch let me personally condemn any kind of killing humen being especially killing innocent Khmer people .
As the victims ourselves we all know that between 1975-1979 there are 2 million lives of innocent Khmer people were killed brutally in Cambodia but not in Phnom Penh all were killed outside the capital city.
And we all know that those lives in Phnom Penh between 1975-1979 most of them were Khmer Rouge cadres and Khmer Viet Minh only a few city people who were lucky to live and worked in Phnom Penh
in the factories.
So most of those who were sent to S 21 prison ( 20 thousand ) all of them were Khmer Rouge cadres and their families and Khmer Viet Minh 98%.
For 2 million Khmer lives were not killed by Duch But were killed by other prisons ( in KR days there were about 195-196 prisons ) by starvation , overwork ect….. .
So the real killers of 2 million of Khmer people are still at large.
So no justice for 2 million of Khmer people .
Before the court hang him, make him pay a visit to Toul Sleng museum, otherwise all the souls won't be rest in peace.

If they condemn and bring Kaing Guek Eav (Duch) to justice why Khmer rouge court of justice should be exemption the owner of Golden Star Palace that murdered thousands of Khmer lives and took their belonging such as gold, jewelry, diamonds to Australia become very rich family and live in peace like theses. That is very unfair to human being that he murdered very cruelty and painful death.
We are Khmer people and Khmer Communities around the world would like Khmer Rouge Court of justice, KI Media, VOA, Radio Free Asia, Radio France International, Mr. Sam Rainsy, World Human Right Group, UN, World Court Of Justice, Australian Government to bring this war criminal to justice like Kaing Guek Eav (Duch).
We are human being we must not support war criminal who murdered thousands human life like this.
