ICJ considers call to halt army activity in Cambodian-Thai dispute

May 31, 2011

Brussels - Judges at the International Court of Justice (ICJ) on Tuesday evening began deliberating a request by Cambodia to order a halt to all Thai military activity in the area of a disputed temple until the contentious border issue is settled.

The court did not provide a date on which a ruling is expected, saying it would be announced 'in due course.'

In April, Cambodia had asked the ICJ in The Hague to revisit a 1962 ruling that awarded the Preah Vihear temple to Phnom Penh. Thailand asked the court to dismiss the case.

Cambodia's filing was accompanied by an 'urgent' request for the court to order Thailand to withdraw its forces from Cambodian territory in the vicinity of the temple and ban all Thai military activity in the area.

It also wants to see Thailand 'refrain from any act or action which could interfere with the rights of Cambodia or aggravate the dispute in the principal proceedings.'

That is the request currently being considered by the ICJ judges.

Thailand has said that it honours the 1962 ruling and acknowledges that the 11th-century Hindu temple itself is in Cambodia. What is at issue is a 4.6-square-kilometre area near the complex that Thailand maintains was not included in the court's 1962 ruling.

That dispute goes back decades but Bangkok said it resurfaced after UNESCO in 2008 designated Preah Vihear a world heritage site, over Thai objections.

The temple has proved a flashpoint and sparked several clashes between the countries, most recently eight days of artillery and small arms skirmishes in April that killed 16 people, mainly soldiers, on both sides, and wounded around 60.

Both Thailand and Cambodia blamed each other for starting the fighting.

what siem say makes no sense because in 1962, the court didn't even have to mention the borderline as it was already official since 1907, duh! apparently, siem thugs was blinded and has no brain to understand that as their unprofessional emotion caused them to be ignorant and stupid, and so on, you know! ahbullshit not even born yet then, what the hell is he talking about, really!

shame on ah insane and arrogant siem thugs, really!

the so-called contentious border claim can only be settle by legality, i.e. using existing mechanism such as a thorough and hard look at international border treaty of 1904 to 1907, you know! that is the only acceptable one with us cambodia; we can never accept any siem's unilateral map, really! in 1962, siem started their unilateral map and although they claim that cambodia did not do anything about it, it goes without saying it's not official nor internationally recognized as cambodia did not sign nor enter into a binding agreement with siem in 1962 siem's unilateral map, you know! again, i hope the court takes a serious look into the international treaty of 1904 to 1907 to verify and clarify the international law to siem thugs, and order siem thugs to learn to live with it and get used to it because it's the law, really! law overtake siem emotion of rankling or tantrum, or it wouldn't be professional at all, you know!

everything siem said makes no sense by law to cambodia, really! it goes against the international law, etc, really!

the bottom line is the temple belongs to cambodia and cambodia reserves the rights and privileges to list it with whc, etc as we please without siem thugs' interference or opposition, really! that's the bottom line! and stop violating the 1907 treaty, ok! without this 1907 treaty cambodia can go back to reclaim all of our old khmer provinces lost to siem during our dark ages era, you know! so, the treaty 1907 treaty was to the benefit of siem thugs, not cambodia as we lost so much lands and territories like islands, seas, temple in isan, etc, etc, to say the least, really! so what is siem thugs whining or rankling about, really!

Local or international law, Thai don't give a damn about it, they only care about stealing more and more.

If you are talking about law, the whole Thailand would have been illegal as the country was robbed from the Khmer many centuries ago.

Last time they managed to persuade Japan to help them steal several provinces from Cambodia and they succeed until the defeated of the Japan Empire.

Now they are kissing more asses from some of the top English speaking lawyers to help steal Cambodian properties again.

The nastiest thing I have ever heard from the Thai crook government which it accused Khmer for invading their country or territories in the past and built Khmer temples there.

Instead of teaching their children the true facts about history they twisted fact around and taught their children lies that all Khmer were the invader and occupied Thailand.

All the Khmer temples in their country are the evidences of Khmer invasion. Not only that they said any temple near the border not under their control ought to be destroyed.

it's good to share this khmer view to the world because that is the true color of siem thugs, they are thieves in khmer people's view, really! and history shows us that they are also opportunist, wait to steal more when we see the opportunity. thank god, cambodia snd khmer people and the world for that matter won't ever allow the thieves to keep on steal from cambodia, whether we ignore it or whatever, because sooner or later the law will catch up with them, just don't sign anything with them officially though! unilateral map is always illegal in the court of law, you know, specifically in regard to siem thugs'violation of the 1907 map, really! as far as cambodia is concern that map, although a hundred years old, does not change, that's the law, really!

cambodia don't have to do anything, as long as we do not sign anything in the name of cambodia, we can always take the thuggish neighboring country that stole from us to icj. just because we did pay attention to their stealing doesn't mean we accept it or allow it, really! so much of siem thugs' logic, really! thank god the world and cambodia is become better educated as time progress. who says cambodia can't learn or chang or reform, really! i say as long as the sun and the moon shine on earth, cambodia will always be here on this planet. life does go on in cambodia, believe it or not, really! god bless cambodia.

If the ICJ comes out the verdict of ordering both sides easing troop activities at the dispute border around the temple or go further to demand troops withdraw comletely from the border. Then what Cambodia government is going to react about this? Is Cambodia going to withdraw her troops from her land?
Thai has no problem to withdraw her troops since they all along demand Camboda side to withdraw. Cambodia lose!!!
If the ICJ verdict to have Cambodia to share 4.6 km2 with Thailand, what Camboda is going to do about this verdict? Thailand gain 2.3 Km2 now Thailand is getting closer to the temple.
Cambodia lose again!!!
