Prime Minister Abhisit Vejjajiva expressed confidence yesterday that the result of the battle with Cambodia at the International Court of Justice (ICJ) over the Preah Vihear Temple would be good news for his government.
"We have made a clear stand at the court that Cambodia is not able to bring the case to the court as a new case, since Thailand has already complied with the 1962 court ruling without objections from any party," Abhisit told reporters.
Cambodia and Thailand relaunched their battle over Preah Vihear at the ICJ this year despite the court ruling in 1962 that "the temple is situated in the territory under sovereignty of Cambodia". Both sides interpreted the judgement differently, leading to a border dispute.
Phnom Penh asked the court to clarify whether Thailand had done enough to comply with the court ruling to withdraw troops and personnel from the temple and its vicinity. It also asked the court to grant provisional measures to have Thai troops withdraw and to ban all Thai military activities in the disputed area.
The court opened a public hearing on the provisional measures on Monday and Tuesday at the Peace Palace in The Hague, with both Thailand and Cambodia getting the chance to give oral testimony.
In his conclusion to the court, Thai Ambassador to the Hague Virachai Plasai, as the agent in the trial, said: "Thailand did accept the court's judgement in 1962 and fully complied with it and Cambodia herself did accept that Thailand has given full compliance with the decision."
Virachai said there was no dispute between the two countries over the meaning or scope of the judgement of 1962.
"The request for interpretation is an attempt to get the court to determine something that was not decided in 1962. On that basis, not only is there no prima facie jurisdiction, there is simply no justification for moving on to any question of interpretation," he said.
Thailand asked the court to remove the case introduced by Cambodia on April 28 from the general list, he said.
Legal expert for Thailand James Crawford told the court to reject the request because Cambodia was not asking for interpretation but for enforcement. The court has no jurisdiction to rule on that case, he said.

In the case of Ho Sok (executed on 7 July, brought to Watt Lanka on 8 July); of Seng Phally, Chao Keang, Chao Tea and Thong Viccheka (executed on 5-6 July and brought by the police to Wat Unalom on the morning of 7 July - see cases number 13-16 above) and in the case of a fifth corpse which was brought to the same pagoda on the same morning, but which could not be identified, the police ordered that cremation of the bodies be conducted without question and without proper cremation permit.
Between 9 and 11 July, according to a variety of reliable corroborating accounts, the bodies of 4 and probably up to 22 soldiers were alleged to have been executed in Pich Nil and burned

ahbullshit sounds so stupid and dumb and he's a siem pm? cambodia is asking the court to interpret and clarify the case, not a new case, stupid siem thug! the purpose of cambodia asking the court this is because siem show contempt of court and thus violate its ruling, you know! and this article came out of thailand or siem country, no wonder they show bias and ignorant with exaggeration, etc! people aren't surprise to see a siem newspaper reports this bias new; just like their map, it is so unilateral the way it sounds, really!

siem did show contempt of court by rankling nonstop about it and holding grudges with cambodia to this day, even though the court have statute of limitations and ordered them to withdraw from preah vihear and surrounding areas. now tell me, that siem thugs not rankling about it; it's so obvious because they kept on bring up preah vihear as "disputed temple", and kept telling lies that the court did not rule on the 1.8 sq mile area adjacent to the ancient khmer temple, etc, etc. according to the international treaty of 1907, this area and the entire borderline between cambodia and siem was officially demarcated already, really!
i hope the court will tell siem this because apparently, siem thugs did not understand it, that's why cambodia asks the court to clarify and interpret its ruling and the court obliged, that's why we all now are talking about it, really!
