Thailand's case to ICJ years in the making [... or it could be much sooner]

Senator for Phitsanulok Phikulkaew Krairiksh, who chairs the Senate committee on foreign affairs, has played a key role in finding a solution to the Thai-Cambodia border dispute.

She was involved in preparations to defend the country's position at the International Court of Justice (ICJ) after Cambodia asked it to interpret its 1962 ruling on sovereignty over the disputed land near Preah Vihear temple.

The panel has studied the border conflict for some time although its work has gone unreported by the media.

Ms Phikulkaew discussed the panel's work with NAUVARAT SUKSAMRAN.

What has the panel done to help the Thai legal team which gave testimony to the International Court of Justice?

Ambassador [to the Hague] Virachai Plasai assessed the situation and believed the issue would eventually end up with the ICJ.

The ambassador came under political pressure and asked to be transferred to The Hague. That happened to be the right move as he helped to prepare the country's legal team.


It took more than two years to put together the legal team and gather all the necessary information, but we worked together quietly.

Why hasn't the panel tried harder to bring information to the public? People have been fed confusing information about Preah Vihear that raised fears that Thailand would lose territory.

We might have run into problems had details of our preparations and information to be presented to the court been released. The lawyers could have been lobbied [by the other side].

The government in 2003 supported Cambodia's unilateral bid to register the Preah Vihear temple as a world heritage site.

However, the cultural side of the issue must also be taken into account. People on both sides of the border have been crossing back and forth for a long time. They are so culturally related they are almost like family.

Nobody ever thought that we would one day have to be separated by fences. This is about civilisation and all sides learning to live together in harmony.

The Preah Vihear issue also concerns the internal affairs of both countries. It is a game to woo voters and to maintain the hold on power by politicians in Cambodia.

The committee has presented the information it collected to the French senate. What was the result?

When we provided them with the information, they seemed to have more understanding. Apart from France, we have also explained to lawmakers of other countries which are members of Unesco and the ICJ. Most of them agree with the committee's position that Thailand and Cambodia should jointly develop the temple and the disputed areas surrounding it.

However, they said Thailand had done too little to explain the issue to foreign organisations.

So what should we do?

This is our weakness. Cambodia is better prepared to put its case to the world. The government must set up a central agency comprising representatives from all the agencies concerned to explain the issue to foreign countries.

How do you think the International Court of Justice will rule?

This is a fresh move by Cambodia to complete the listing of the Preah Vihear temple as a world heritage site.

Cambodia is acting with a new determination and new ambition.

=What about cultural side? Oh? All of sudden the Siem Phitsanulok Phikulkaew Krairiksh find Siem and the Khmer related like a family? Well in reality even family member will kill another family to shut the mouth! Family member will excommunicate another family member for disobeying the family! Yes bad blood do run in the family in betraying, killing, and excommunicating and you name it and the lists go on forever!

During the Vietcong invasion of Cambodia, the Siem military thugs deny entry of the Khmer refugees and push back those Khmer refugees down the hill infested with landmines and gun them down and die in the thousand and thousand! Is this what the Siem leaders want to talk about so called related like family? In addition most of Khmer refugees camps were strategically placed at the frontline used as human shield to protect Siem military thugs! Is this what the Siem leaders are talking about family related?

You Siem thugs preach peace on paper but you Siem thugs shipped your tanks, guns, and ammos to confront the Cambodia! You Siem thugs preach cultural tied with Cambodia but you Siem inherited and stole everything from Cambodia! You Siem thugs claimed to value the Preah Vihear temple at the same time you Siem thugs never hesitate to shoot over 400 round of artillery shells at the Preah Vihear temple to destroy it because you Siem thugs know that you will never going to own it!

Enough of the Siem thugs preaching do good mother fucker! By the way the Siem thugs need stop claiming the cultural tied between the Siem and the Khmer because what the Siem thugs had done to Cambodia is only destruction and the killing!

One last thing, Yes it took 2 years for the Siem thugs and bitches to put together the false information together to tell the court and the whole world and in the process during the 2 years countless life and property were destroyed by the Siem thugs and bitches!

This is just another Siem thugs twisted logic!

Senator Phitsanulok Phikulkaew Krairiksh, there is nothing to explain to whoever you want to explain to. Preah Vihear built by Khmer therefore she is belong to Khmer. Is that hard to understand that you try to cook something up and want to explan to others?. Peoplefrom both side of the border are related because you annext Khmer provinces, that does not give you right to take away Preah Vihear temple. Hec, we will take back our provinces and reunited all Khmer from Thailand if we are strong enough to do so.

You want to live in peace, stop invade my country. You can have it both way.

the last i check siem thugs rankling with khmer and steal from khmer lands, territories, temples, etc, and this fat siem girl want to say we're friends! hell, no! we're just become friends today, hell no! siem thieves stole from khmer during the dark ages, and now with their unilateral map, i hope the world know the true siem thugs' color by now, really!

if this fat siem girl is sincere about what she's saying here, then she must educate ahbullshit to stop violating the international law with cambodia, etc, ok! only then we'll consider your friendship, ok!

Thailand is doing the opposite. They are good at pointing finger at Cambodian and acting innocent. The thieved Thailand is known by Cambodia for centuries but the world is yet to discovered the true intention of this awful country.

Mr. Sam Rainsy is the sun that shine bright in all Cambodians heart and mind unlike PhD, Dr. Hun Sen murdered thousands khmer lives and cut off 30 000 km2 of Cambodia to Vietnam as personal gift and make Cambodian people suffer every day.
