Who does the Preah Vihear temple belong to?

Thailand-Cambodia conflict over ancient temple site sparks debate over borders and historic rights.

The magnificent ruins of this ancient Hindu temple, a World Heritage site since 2008, have become a bitter cause of serious border skirmishes between Thai and Cambodian soldiers. The skirmishes come amid conflicting claims over sovereignty and age-old historic rivalry.

This Hindu-inspired 11th century temple, spectacularly perched atop a mountain escarpment, hugs the border between Cambodia and Thailand.

According to Sanskrit inscriptions, the temple was once called Sri Sikharisvara, meaning "Glorious Lord of the Mountain", a dedication to the Hindu god Shiva.

Tanks and artillery have been mobilised only a few kilometres from these archaeological treasures. During an outbreak of hostilities twice this year, heavy shelling resulted in 17 dead and more than 50,000 people forced to flee on both sides of the militarised border.


When Preah Vihear temple was granted World Heritage status in 2008, Cambodia celebrated. People danced with joy in the streets of Phnom Penh. But in neighbouring Thailand, it triggered a series of angry xenophobic protests.

The Thai Patriots Network and the PAD People Alliance for Democracy (the Royalist Movement) have recently cranked up the pressure on Thai Prime Minister Abhisit Vejjajiva, pushing him towards a more hard-line stance over this festering border conflict with Cambodia in the months prior to the general election set for July 3.

A complex issue

Deputy leader of the Democrat Party Kraisak Choonhavan is alarmed by the impact of ultra-nationalism on his own government. "The PAD has been critical of the Thai government for the past two years. Now they have become jingoistic, which is very dangerous," he said.

Recent fighting between Thai troops and the Cambodian army in the disputed border area adjoining the temple inflicted minor damage and defaced part of the stone walls in early February 2011. Even the UNESCO flag of protection for ancient monuments suffered bullet holes.

Responding to rolling street protests by his former PAD allies in the capital Bangkok earlier this year, the Thai prime minister assured the public that the border clash "shows that we never fail to protect our sovereignty" and even called upon UNESCO to revoke the World Heritage listing of the Preah Vihear temple.

Dr Paul Chambers, a Thai politics specialist at Payap University in Chiangmai, told Al Jazeera, "the Yellow Shirts and the Thai Patriots' Network have succeeded in building up an ever-growing Thai nationalist frenzy in Bangkok".

With the ruling Democrat Party led by prime minister Abhisit Vejjajiva still playing the "Cambodia card", there appears to be zero chance of resolving the border dispute before the election.

Thai academic Dr Pavin Chachavalpongpun, based at the Institute of Southeast Asian Studies, told Al Jazeera that "the current conflict is not really about Thai-Cambodian conflict, it is more about Thailand's own conflict".

The background to the conflict dates back to the period of the great Angkorian Empire, when the territory of Cambodia stretched across most of South East Asia, preceding the emergence of Siam as a nation-state now known as Thailand. The 11th century temple of Preah Vihear preceded the completion of legendary Angkor Wat and Bayon temples, also renowned World Heritage sites.

When the Khmer Empire declined, a Siamese army invaded Angkor in 1431. And, in the 16th century, Cambodia again lost further chunks of territory to the invading Siamese army.

The process of losing territory to their more powerful neighbours was only arrested by the arrival of the French army that incorporated Cambodia as part of their Indochinese colonial empire in 1863.

After Cambodia regained its independence from the French in 1953, the Thai military regime occupied the temple, prompting the Cambodian head of state, Prince Norodom Sihanouk, to refer the dispute to the International Court in The Hague.

Does the court decide?

The 1962 International Court of Justice ruling between the two countries declared the temple to be a part of Cambodia. The verdict was grudgingly accepted by the Thai side and their soldiers were ordered to withdraw.

No serious challenge to Cambodian sovereignty over the temple was made for the past 46 years - until the bid by Phnom Penh to secure this temple as a new World Heritage site.

But Thailand has still staked claim to 4.6 sq km of adjoining territory surrounding much of the temple's site, which was not part of the ruling in The Hague Court.

Cambodia has appealed to the UN Security Council and the regional body of South East Asian countries ASEAN for mediation on the issue, but Thailand stubbornly insists on bi-lateral negotiations.

The issue has now been referred back to the World Court at The Hague by the Cambodian side, to rule on the disputed area.

Ultra-nationalists in Thailand hark back to the days of Field Marshal Sarit Thanarat's military dictatorship which had occupied the Khmer temple of Preah Vihear in the late 1950s. Many in right-wing nationalist circles in Thailand never fully accepted either the World Court verdict or Cambodian sovereignty over the temple.

Thongchai Winichakul, Thai Professor of History at the University of Wisconsin in the US, commented that the temple furore demonstrated that "the dark side of nationalism is dangerous as ever". The author of Siam Mapped: A History of the Geo Body of a Nation, he wrote in his book: "The Preah Vihear World Heritage case has gone beyond technicalities. It is abused to arouse the delusion that the temple belongs to Thailand, and a desire to revive the claim".

In December 2010, the Thai Patriots' Network, an extremist faction of the Yellow-Shirt Movement headed by Veera Somkhwamkid, deliberately provoked a border incident by leading a team into Cambodian territory resulting in their arrest.

The Cambodian court convicted five out of the team, and they were detained in Cambodia for immigration violations; they had entered the country illegally. They were promptly set free after the court verdict, however, Mr Veera was charged with espionage and jailed for eight years.

The jailing of Veera triggered angry anti-Cambodian protests in Bangkok. However, most Thai people living in the border areas were far more interested in trade with neighbouring people, and increased efforts to peacefully resolve the conflict.

Dr Charnvit Ketseri, historian and former rector of Thammasat University in Bangkok, told Al Jazeera that Thai extremism and anti-Khmer sentiment was based on ignorance - even among the educated. "Most educated Thai are badly informed by history textbooks of the Ministry of Education, by politicians, and by main-stream mass-media," he said.

The temple - a hostage to Thai domestic politics

Regional bloc ASEAN has noted the growing hostilities between two of its members, and Indonesia, the current chair of the 12-nation group, has made repeated offers to send observers to prevent further clashes.

Thailand had agreed with Cambodia several months ago to accept a limited role for Indonesia observers to monitor the two armies camped near Preach Vihear temple. This accord permitted Indonesian observers to be "embedded" with Thai soldiers and the Cambodian army on either side of the much-coveted temple.

More than three months after the agreement, there are still no observers deployed at the border.

However, the powerful Thai military had other ideas. Thai army chief General Prayut Chan-O-Cha declared on March 23 that "regardless of where the observers are from, we don't want them [...] in the disputed area because it's dangerous and will complicate the problem".

He reported that the Thai defence ministry, armed forces, and military commanders were opposed to international observers on Thai territory, thus rendering the ASEAN peace plan dead. Futhermore, Abhisit's civilian government was unable to prevent the army from calling the shots over how to handle the Cambodian conflict.

"Fighting has allowed the military to increase its influence in the name of protecting national interests. This is a crucial point at a time when Thai politics is so unstable," asserts Dr Pavin Chachavalpongpun.

"I think Thailand's memory of an international organisation giving legal control of Preah Vihear temple to Cambodia in 1962, will make it unwilling to allow any other intervention by outsiders, such as UNESCO or ASEAN," he added.

The Preah Vihear temple is likely to continue to be held hostage to Thailand's polarised politics long beyond Thailand's election.

At the 35th annual conference of the World Heritage Committee meeting in Paris in June, Cambodia's management plan for the temple was supposed to be on the agenda. Thailand had asked for it to be delayed until this year. Now Bangkok again insists on a further delay - until there is a settlement on the issue.

Aggressive nationalism, a politicised Thai army asserting a stronger role in politics, the current election campaign, and the country's chronic instability, have effectively derailed plans by Cambodia and UNESCO to move forward with heritage conservation to restore the temple.

There are segments of the informed Khmers inside and outside Cambodia are well aware of Siam historical distortion in raising its jingoistic and imperialistic policy toward Khmers in Siam and Cambodia.This is dangerous to the region weakened stability post world war II and Viet Expabsion wars.

The Facade of ASEAN is painted with white paint as a pacifist of fascistic market in 2015 for the richer members and profiteers like the Yellow race to exploit the poorer members like Cambodia,Laos,Burma and others.

siam is a hypocrite of its own vision in creating ASEAN in the 60's to please US defeated foreign war policy.

Bangkok banks on Preah Vihear to reap more weaponries and fund from US by exploiting its alliance treaty prior to Viet Nam Wars and slanting the conflict of border with Cambodia as a threat from the Viet Expansionist economic war toward its western neighbors in attempt to implore wealthy China charity.

why siem interfere with cambodia's listing? it's not the so-called shrub land the claim theirs, really! if you believe or buy that from siem, then you are either them or sympathetic or ally or thug-like like siem, really! that so-called siem's claim to demarcate is no more than a lame excuse and a violation of the already demarcated borderline in according to the international treaty of 1907 that created the present-day borderline of cambodia. i'm sure without this historical treaty, cambodia borderline is way beyond today's boundary because we still consider all the old khmer provinces siem stole or robbed from us, really! have you ever visit and heard of cambodia's angkor civilization? well, if you havent' i suggest you start studying that now; it's called the history of cambodia. and if you did hear or visit it, then you know that khmer empire was powerful at that time and i'm sure the boundary line of our ancient empire didn't stop at the present-day dongrak mountain range and so forth, ok! enough said already! it hurts khmer people to talk about our loss, you know! anyway, cambodia can not share our preah vihear world heritage site with siem thugs as they're dreaming we do now, ok! if any, we will open preah vihear site to all visitors, however, it doesn't mean we share ownership with siem thugs, though, ok! know the difference, ok!

why is siem and their sympathysers keep on ignoring the international treaty of 1907? only this map will decide whose the real owner as ratisfied officially by all parties. of course, we are talking legal here! that's the only way to settle the issue, not people unruly or people prerogative, really! as for cambodia, of course, one has to give proper credit to the historical fact that cambodia's ancestors built and ruled the khmer empire, definitely not siem thugs, you know! of course, civilization all over the world have its ups and down throughout history, still one can't ignore the fact, the originator of it all, really, and that was the ancestors of present-day cambodia's khmer people, ok!

don't forget too that ancient cambodia of the khmer empire and civilization used sanskrit as our official language along with our khmer language as well then, ok. it's the same thing with latin was used in the roman empire, etc and gave roots to all languages of western civilization, the same can be said about the old language of sanskrit to cambodia, you know!

anyway, cambodia has the advantage in court as we always abide by law, whether it's the international treaty of 1904 to 1907 and the icj verdict of 1962. it's siem thugs that are rankling and show contempt of court, we all know from their action and defiance, despite the already existed rules and law, international treaty, etc, etc, you know!

cambodia already knew the truth intention and motivation and drive of the siem thugs, i think not all the world know or understand it, though! i think the court should summon khmer history experts both from thailand and cambodia and even from the western world as well to help explain, educate and clear this in the court so everyone can understand the legality and historical facts, etc. otherwise, siem will not stop rankling and holding our preah vihear hostage by whipping up "cambodia card" in order to arouse their nationalism, and of course, cambodia will do the same, thus there is a danger of destablizing peace in the region, really! who wants that? icj has the responsibility to help settle this once and for all and leave nothing unclear again, whether ownership, borderline, or what have you, really. of course, do it in a legal manner, yes by using the law, not siem's bullying at cambodia, etc, etc...

preah vihear and so-called surrounding areas adjacent to it should be made to belong to the temple itself. the court should rule that 1 sq km of the area around it should be the property of the world heritage site, period, this way, siem cannot lay illegal claim to the so-called shrub land in a pretext to cling on to cambodia's preah vihear temple. and siem shouldn't be allowed to use preah vihear as a political hostage in their own siem country either,really!

also, when one talk about preah vihear temple, no one should ignore its historical facts, really! historical fact is what ties it to cambodia the most, legally speaking, really! the world cannot ignore this fact, really, because choosing to ignore it means bias and unlawful, thus ignorant and uneducated, etc, etc, you know!

I agree that Monique is not Viet.But, i don't think Sihanouk is khmer .He is either the descendant of Thai or Lao monarchy.Khmer race cease to exist long time ago.What we have now in Cambodia are either Chinese or Vietnamese origin and wanna be called as khmer.Do you think with the name like Hor nam hong,Var kim hong,lao meng khin, cheam yeap and so on are khmer ? If you think so ,you are a fool.Those above mention are yuon.That's why they are so eager to give khmer land to yuon.

1. I am not sure about you claim that Khmer race cease to exist. We need some utopsie or DNA examination before coming to this kind of IGNORANT and irresponsible claim.

2. I am not a pure Khmer origin but rather mixed between Chinese and Khmer; but I am proud to born in that country and be proud be Khmer. And i think that is important. No matter what ethnic you are but the patriotic conscience and respect to our ancestor who built that glory empire who unites us all.

3. I don't see the point of hating people because they look or have their name Viet, Chinese, Barang. It was the same mistake that the KR did. You get killed if you look Viet. You get killed if you know how to speak Viet, English, or whatever. They just simply killed everyone even their own people, including small kids who was born next to the temple.

What does it mean pure khmer race?
How do you know that they extinct? Proof: epademic, emigration, magical inihilation? Find us a reliable proof or otherwise, you would be just an IDIOTUS!

it's hard to find pure race in teh world anymore. most people all over the world are mixed race now, the best example is in america. the important thing is that people are educated and speak english and go to college and study english, etc. same with khmer language in cambodia, you know. and also, people should live by the rule of law, too, in this day and age. well, cambodia is a country, so all its citizens, whether mixed race or pure khmer or what have you are still considered khmer people and citizens, ok! just like all people in the world who now live and born in america are considered to be america citizens. that's how the world is now, really! the importance thing is keeping the khmer language and identity such as custom, culture and tradition alive, etc. that's how it has been changed in cambodia, too, ok!

i think pure people of any race on this earth is not attractive, to put it nicely, mixed race people are more handsome, if not smarter and so on, really! well in cambodia, people will also considered to be khmer because they all live and born in cambodia. and of course, they must know khmer language, culture, history, and like khmer food, etc,etc, you know! god bless cambodia and all our beautiful khmer people and citizens.

that said, siem and youn better stop stealing from cambodia, ok!

i know, what is more importance than national origin is the loyalty to cambodia, the love for cambodia, the ability to speak fluent khmer, the education and knowledge of khmer history, culture, tradition, identity, the love of khmer food, the tendency to speak in khmer language, the patriotic feeling and nationalist feeling and allegience to cambodia and khmer way is more important to cambodia than the person's look or appearance or their national background or skin colore or religion preference, etc, etc, you know! we should learn from america, really! the more education and traveling experience we have, the more we will be tolerant toward other who might look a little different from us, really! wake up, people, stop using too much race card in cambodia, it's not smart or wise or beneficial to cambodia and khmer people to do so in this day and age, ok! yes, this is not the dark ages or the KR era, ok! we are a change and reform minded cambodia. let work together to make cambodia a better, enjoyable country for all to live, work, visit, etc, etc, ok! god bless cambodia.

siem told the court that they did not disagree that preah vihear righteously belongs to cambodia, then why they fight with cambodia by sayin the court did not rule on the adjacent shrub land to preah vihear temple! makes no sense to hear what siem said because they are crooks! they said one they and do the opposite. i hope the court catch them doing that by now, really! we want justice for cambodia! and the court could help find justice for cambodia because the world court of justice is our witness, you know!

the borderlines were already created by the international treaty of 1904 to 1907, siem need to refer to it and respect it,etc. the border markers were being neglected by cambodia due to cambodia's internal strife and the KR era, etc, however, the official map itself has not changed since 1907, you know! so, for siem to violate that is so unacceptable in the court of law, really! the court should see to it that siem stop violate the 1907 map, really! cambodia can not accept siem's unilateral map that siem produced with the help of the US army cartographer. it is no more that an illegal map not abide by the agreement signed officially by both countries in 1907, you know! siem apparently kept on ignoring the 1907 treaty, although their country did sign and agreed with cambodia then. that if that is not a violation, then what is it? don't tell me cambodia agree to siem unilateral because we're not!
