US Representative Blasts ‘Slow Progress’ of Tribunal

“This is very slow progress for a court that is eight years old and has received hundreds of millions of dollars in funding from the international community.”
Ed Royce, a House Republican from California, said the UN-backed tribunal in Phnom Penh has cost millions of dollars, tried only one man, and was leaving Cambodians in America frustrated by its lack of effectiveness.

“There is an expression used in the US, ‘Justice delayed is justice denied,’” he said in an e-mail Friday. “I’m afraid that may be the case in Cambodia.”

The court has come under increased criticism for its handling of the cases against Khmer Rouge leaders, including from victims groups in the US and Cambodia.

“This is very slow progress for a court that is eight years old and has received hundreds of millions of dollars in funding from the international community,” Royce wrote in response to questions. “The US Congress has expressed its concern over the corruption and mismanagement. Unfortunately, the court is also suffering from political interference at the highest levels.”


Royce was referring to allegations that surfaced on the Cambodian side of the court, when staff complained they were paying kickbacks to keep their jobs. Prime Minister Hun Sen has publicly opposed the prosecution of two more cases at the court, while top ruling party officials have refused to comply with summonses there.

The tribunal has spent around $150 million since 2003, and only stood up in 2006, after much wrangling between Cambodian officials and the UN. In June 2010, it sentenced Duch, the former head of Tuol Sleng prison, to a commuted 19 years in prison, after a lengthy trial. That case is currently under appeal. A second case, for top leaders Nuon Chea, Khieu Samphan, Ieng Sary and Ieng Thirith, will begin in full later this year. Two more cases that would require more indictments have stalled in the court process.

Royce, who is a House member of the committees of Financial Services and of Foreign Affairs, said the Khmer Rouge was responsible for the deaths of up to 2 million Cambodians, giving survivors a desire to hold its leaders accountable.

“This horrendous crime was committed against the Cambodian people, but we all have an interest in seeing that justice is done,” he wrote.

Tribunal spokesman Huy Vannak said this week that an independent audit had cleared the court of corruption charges, but he acknowledged there have been complaints over the slow work of the tribunal as well as allegations of political influence.

But he said the court process was actually moving faster than other war crimes tribunals, while at the same time jurists are working to ensure that the process is legitimate.

“If we are careless, then such a heritage will return,” he said.

Still, Royce said, Cambodians in the US are not happy with the way the trials have gone.

Most Cambodian-Americans I’ve talked to express frustration that the tribunal is not open to the public and that there aren’t more defendants on trial, including officials in the current government,” he said.

Huy Vannak said the court was working 30 years after the fall of the regime, making some indictments impossible.

“We also know that senior Khmer Rouge leaders like Pol Pot, Ke Pauk, Son Sen and Ta Mok died,” he said. Had they lived, they could have been included in the first two trials at the court, he said.

They spent over 100 million dollars since 2003 and put just one guy in jail for 19 years after he killed thousands of innocent people . That's more like a joke to me . There is no justice in that case. In the US , some cases they will put criminals to death or keep them in jail for life even they just killed one person .

The map of US bombing targets released by Yale University’s Cambodian Genocide Program shows that more than half of the country was affected by the indiscriminate bombings. Professor Ben Kierman, director of the program, puts the casualties figure from the bombing at 150,000 deaths, while Edward Herman, a professor of Wharton School, and Noam Chomsky put the toll at 600,000 using figures provided by a Finnish Commission of Inquiry.

Based on this, we can never naively claim that US bombing led to the mass executions by the Khmer Rouge or refuted the regime's mass atrocities. But, to certain extent, the blanket bombing, which directly led to the destruction of livestock and agricultural land, could have definitely played a role in the mass starvation.

From new data released during the Clinton administration, Taylor Owen, a doctoral student at Oxford University, and Professor Kierman noted that 2,756,941 tons of bombs were dropped on Cambodia.

To put the figure into perspective, just over 2 million tons of bombs were dropped by the allies during all of World War II. The bombs dropped in Cambodia represented about 184 Hiroshima atomic bombs combined, making Cambodia the most bombed nation in the world. Based on the new data, Professor Kierman also stressed that the casualties might be much higher than his earlier predicted 150,000.

Based on this, the bombing contributed to the rise of the Khmer Rouge. The number of Khmer Rouge cadres rose from a group that had an insignificant prospect ousting the US-backed Lon Nol’s regime, roughly from 1,000 in 1969 to 220,000 in 1973.

It's about time that someone in DC have the brain to realize that they've been wasting our tax payer's money just to put one man on trial. Nevertheless, for 19 years?
I say from this day forward, we need to expedite the next case to a speedy trial to save us (tax payer) some money.
Better yet, let's check Huynh Sen's pocket.

You failed to mention the reason behind Amerca's bombing of Cambodia in 1970's. Your assessment is just one sided story. You failed to reveal that the bombing took place after your stupid king violated his neutral policy by siding with the Viets to fight American and the stupid king collaborated with the Viets to invade Cambodia just so he, the king, can revenge against Lon Nol for overthrowing him. And you failed to mention that as the result of your king's action, 2M of khmer lives were lost during Khmer Rouge's rule. Be fair by telling the whole story and not just one sided story. And I'm not upset for American's bombing as it was destined to eliminate the Viets from invading Cambodia and the Khmer Rouge from taking over Cambodia in 1970's as without bombing the Viets and Khmer Rouge would conquer Cambodia in two weeks instead of in five years.

BOMBING ON CAMBODIAN SOY DURING THE VIETNAM WAR WAS THE RIGHT OF AMERICANS TO FOLLOW THEIR ENNEMIES WHO CROSSED THE BORDER TO CAMBODIA UNDER SIHANOUK'S AGREEMENT.

IF THERE WAS NO ALLOWANCE FROM SIHANOUK, THERE WERE NO VIETS IN CAMBODIA AND THE AMERICANS DID NOT DARE TO SPEND ON SECOND OF THEIR TIME AND ONE PENNY OF THEIR MONEY TO BOMB.

Hey, I understood that S.Vietnam Air Force after Srok Khmer was declared free fire zone, they also bomb villages of Khmer people. I'm not angry at them, it was to settle some old feud that they did it, right?

I believe it was all a manufactured conflict to advance the New World Order dictated by the elitist and profit by the billions at the loss of countless lives.

We also need to thank China and Vietnam for supporting Sihanouk and Khmer Rouge until achieving victory over Lon Nol regime. Without their support Sihanouk and Khmer Rouge would not have an opportunity to kill 2M of Khmer race. Double thank to Vietnam for achieving its goal of swallowing Cambodia.
