Khmer Rouge Trial Missing a Marquee Defendant

More than three decades after the fall of the Khmer Rouge, the trial of some of its most senior surviving leaders – all adamant about their innocence – began today with one notable absence.

One of the four “inner circle” members of the regime accused of genocide and crimes against humanity was excused from the long-awaited trials. Ieng Tirith, wife of the regime’s international face Ieng Sary and herself minister of social affairs during Khmer Rouge rule, was deemed mentally unfit to stand trial due Alzheimer’s disease and ordered to be unconditionally released.

Though prosecutors have appealed the decision, it has raised yet again the question that victims and activists have long-feared: Will the remaining Khmer Rouge leaders fall prey to old age before they can be held to account for atrocities they are alleged to have committed?


“The impact of this long-delayed trial is a key concern,” said Ou Virak, president of the Cambodian Center for Human Rights. “At the current pace, at least one or two more of the accused are not going to see all of the trial played out.”

Ieng Tirith – a graduate of the Sorbonne in Paris and the first Cambodian to receive a degree in English Literature – was indicted for crimes against humanity, and alleged to be directly responsible for planning, directing, coordinating and ordering widespread purges. Her sister was married to leader of the regime, Pol Pot.

Judges on the tribunal unanimously found her to be mentally ill, but most Cambodian judges on the tribunal preferred that she be hospitalized and her condition reviewed in six months, rather than being released unanimously according to Clair Duffy, who is monitoring the court proceedings for the Open Society Justice Initiative. This is what the prosecution is appealing for.

The rest of the accused – her husband and the regime’s former foreign minister Ieng Sary; Noun Chea, the Khmer Rouge’s number two man after Pol Pot; and former head of state Khieu Samphan – are all older than Ieng Tirith (who is 79) at 86, 85 and 80 years old respectively. They are all alleged to be responsible for the death of an estimated 1.7 million people. Noun Chea, also known as “Brother No. 2,” was second in command to Pol Pot and is a graduate of Thammasat University in Bangkok, unlike many of the regime’s Paris-educated leaders.

After years of delays owing to both political and procedural reasons, many activists and victims say they are already disappointed by the UN-backed Extraordinary Chambers in the Courts of Cambodia (ECCC), the tribunal in charge of the trials. In 1999 – two decades after the fall of the regime – a UN Group of Experts recommended an international tribunal, warning of political interference in the Cambodian court system, but the proposal was rejected by Cambodian Prime Minister Hun Sen. After years of negotiations, the ECCC was set up in 2003.

“The process has been way too long, and will continue to take a long time,” said Mr. Ou Virak, whose father was killed by the Khmer Rouge before he was born. “The names of the three accused are all public names, names that the Cambodian people are used to hearing associated with the regime. We need to have a sense of justice and closure.” He expects the process to take at least another three to four years.

The release Ieng Tirith was ordered “unconditionally” by chamber judges of the tribunal, who cited the legal principle that all accused are presumed innocent until proven guilty.

“The release of Ieng Thirith is only one reflection of how incredibly late these trials are coming into place,” said Theary Seng, founder of the Cambodian Center for Justice and Reconciliation and herself, too, a victim of the Khmer Rouge regime, having lost her parents and spent five months in prison. She has withdrawn from the tribunal process, and instead put her energy into organizing public games of darts featuring the faces of the Khmer Rouge leaders along Phnom Penh’s riverfront – a “way of release” following victims’ frustrations with the trial process, mixed with “dark humor,” she said.

Some, though, say that the decision proves the court’s compliance with international standards of justice and fair trial.

“From a legal point of view, I was expecting this to happen” said Ms Duffy in an interview. She added that the decision, which may have been surprising to the public, was consistent with medical evidence and a good sign that the court was complying with international standards though it “compounds the concern” that justice for the victims will not be delivered before old age gets to the accused.

In a judicial process already mired by delays and controversy, many victims are already disappointed by their slow recourse to justice. But their disappointment could be even more pronounced if the Khmer Rouge leaders do not make it to the trial’s finish line.

“[Cambodians] will react more if the remaining three don’t see the end of the trial,” said Mr. Ou Virak. “They are so closely associated with the Khmer Rouge in the psyche of the Cambodian people”.

The trial commenced on Monday, Nov. 21.

If every body stop using the court as the political campaign machine, the trial would has been half way through already.

The interuptions cause from these accusations:

1. The court corruption.

2. The connection between KR and the current regime (accusation from SRP)

3. The connection between Sihanouk and the KR (accusation fron former Lon Nol Gov.)

4. The civil party filing (Theary Seng)

It is not worth it for Cambodian as a whole to let these kind of interuptions to stop the court from going forward.

The majority of Cambodian, in Cambodia and Cambodian abroad, third world countries, want to see the case going forward !!!!!!

Mass evacuation of khmer population from Phnom Pehn and the rest of the country immediately following the war in 1975 was orchestrated by the Vietcong's evil agenda to infiltrate and rob Khmer land.

Look at Phnom Pehn today....as well as along the Tonle Sap and Mekong Rivers. Vietcong continues to create environment disaster and ruin khmer lives.

first of all i would like to appologize to Ki-medai for using your site to curse Khmer sovannaphumi known as Pang Sokheun n his mistress Sokunther Som for falsely accused me...i gave them lots of warning to delete my stolen pic in their wall, n stop accusing me of created Pang Sokheoun id, but instead they ignored me times after times, n they're trying so hard to defame me....ladies n gentle men, Khmer Sovnaphumi known as( Pang Sokheoun) n his accomplish gf Sokunthear som will recieve all the curse from yeay mouth, n pres ong dong kal, included plan n car crashes where ever they're traveling, they will not be able to delivery baby, no matter what jobs they're having, they'll remain dirt poor, the lightning will strik both of them where ever they go, they both will die slowly of cow disease, if they traveled by water, they'll be eaten by sharks, if they traveled by foots they'll step on landmines, n the king cobra will bite them, n next life they'll become a two head dog..they'll die with heart attack in their sleep, when they're eating foods, they'll die of foods poisioning... all their families n relatives will receive the same curse as them.. they both have khmer blood in them, so they'll receive all of those curse for sure !!!! n if i created that Pang Sokheoun id, i'll receive the same fate....as soon as he step foot in cambodia airport my friends there will welcome him with dirty handcuff.....fuck u khmer sovvanaphumi pang sokheoun n sokunther som.....pi ach your worst nightmare!!!

I was a small boy when the mass evacuation took place. They took my grandpa, and one uncle away that night and they never returned home since. My other uncle was executed in front of our home with pool of blood on the side of the street. Sudden shock and horror has been part of our lives since....to these day!

Need real justice for Khmer victims!

What is your real name? Why don't you tell people who you are and what have you done that make Pang Sokheoun to defame you?

As I know Pang Sokheoun never involves or interests himself in any personal conflicts with anyone in facebook or even in his real life except for political issues.

It seems that you have chosen to attack the wrong person. I have seen here and in facebook those people who use many IDs with no pictures and information about themselves try to attack and defame him and Mr. Meng Ly who is a respected person in New Zealand without reasons.

I understand that those people are pro-CPP but they should be a role model as the new genernations of this country and try to change the mindsets through dialog with honesty and respect unless they want to be like the old corrupt cpp today.

I just cannot stand to answer for him because I always visit his wall daily and I also encourage him to answer if he thinks it is neccesary.

Communist Party of Kampuchea

The communist Party of Kampuchea or Khmer Rouge between 1975-1979 was a combination of Khmer Viet Minh and a Paris students group, originally by 3 figures as follow:
These 3 figures came from difference background and ideologies as fellow:

1.Tou Samouth.

2. Nuon Chea.

3. Pol Pot.

The Communist Party of Kampuchea was create by a bove 3 figures in 1960 under the name of Khmer Worker’s Party and changed to Communist Party of Kampuchea in 1966 after Tou Samouth was arrested and killed in 1962 .
As we know the Communist Party of Kampuchea was a combination of Khmer Viet Minh who some left Cambodia with Son Ngoc Minh or better know as Achar Means such Pen Sovann to Hanoi.

Those who stayed in Cambodia were Tou Samouth, So Phim , Rous Yim and many more and these senior Khmer Viet Minh had about 4000 former Khmer Viet Minh fighters under their command.

So the Communist Party of Kampuchea was a combination of 80 % of former Khmer Viet Minh and 20 % by a Paris students group such Pol Pot , Ieng Sary , Son Son.
Between 1975-1779 those Khmer Viet Minh became villages , district chiefs and Zones Secretaries such as So Phim in Eastern Zone Secrtary and Rous Yim in Northern Zone Secreatry.

So Phim and Rous Yim these 2 senior former Khmer Viet Minh were in law.
