Court to question accused Khmer Rouge trio

Three senior leaders of Cambodia's Khmer Rouge regime face questioning at a UN-backed tribunal for the first time over their roles in the deaths of an estimated 1.7 million people when their movement held power in the 1970s.

The three defendants, all in their 80s, sat side by side in the court on Monday as the judge opened the day's proceedings.

The long-awaited trial began late last month with opening statements, and this week the court is expected to focus on charges involving the forced movement of people and crimes against humanity.


After the Khmer Rouge captured Phnom Penh on April 17, 1975, they began moving an estimated one million people from the capital into the countryside in an effort to create a communist agrarian utopia.

Atrocities

The defendants are accused of crimes against humanity, genocide, religious persecution, homicide and torture stemming from the group's 1975-79 reign of terror. All have denied wrongdoing.

They include Khieu Samphan, an 80-year-old former head of state who told the court in November he bore no responsibility for atrocities, and 85-year-old Nuon Chea, the group's second in command who has insisted he acted to protect Cambodia from invaders.

The third defendant, 86-year-old Ieng Sary, has said he will not participate in the trial until a ruling is issued on a pardon he received in 1996. The tribunal previously ruled the pardon did not cover its indictment against him.

There is concern that the accused could pass away before justice is achieved.

Pol Pot, the Khmer Rouge's supreme leader, died in 1998 in Cambodia's jungles, and a fourth defendant, 79-year-old Ieng Thirith, was ruled unfit to stand trial last week because she has Alzheimer's disease. She is Ieng Sary's wife and served as the regime's minister for social affairs.

The tribunal is seeking justice on behalf of the estimated quarter of Cambodia's population who died from executions, starvation, disease and overwork under the Khmer Rouge.

"This is the first time the accused persons will be asked questions in a public hearing about their role in the events that led to the takeover of Phnom Penh on 17 April 1975 and about the policies of the Khmer Rouge," Lars Olsen, a tribunal spokesman, told The Associated Press news agency.

Olsen said the initial testimony would take several days. After the accused have been questioned, witnesses and civil parties will be also called to testify, he said.

So far the UN-backed tribunal, established in 2006, has tried just one case, convicting Kaing Guek Eav, the former head of the Khmer Rouge's notorious S-21 prison, last year and sentencing him to 35 years in prison for war crimes, crimes against humanity and other offenses. His sentence was reduced to 19 years due to time served and other technicalities.

That case was seen as much simpler than those currently before the court, in part because Kaing Guek Eav confessed to his crimes.

Chum Mey, 80, one of only two survivors of the S-21 prison, said he did not believe the three defendants would tell the truth about what happened in the 1970s.

"During last month's sessions we heard them say only that their regime was good and worked for the entire people," Chum Mey said.

1863: Establishing the Protectorate of Cambodia, France annexed Kampuchea Krom, made a French colony out of it, and named it “Cochinchine”.

May 25, 1874: Koh Tral (Phu Quoc) which belonged to Cambodia (under the reign of King Ang Duong) was placed under the administration of the Governor of Cochinchine, i.e. under the administration of France, by the French Protectorate.

June 16, 1875: Koh Tral is attached to the inspection district of Hatien which was colonized by France. One needs to recall that in 1855, King Ang Duong reminded Napoleon III [first French President (1948-1852), later French Emperor (1852-1870)] that “the territories annexed by Vietnam located between the Western branch of the Mekong [River] and the Gulf of Siam (Hatien area) were “actually Cambodian land” (cf. A. Dolphin-Dauphin-Meunier – “History of Cambodia”, pg. 99). Therefore, Koh Tral always remains a Cambodian island, even though it is under the administration of colonial France.

January 31, 1939: the “Brévié Line” which is not a maritime border demarcation, but rather a line dividing the police and administrative authority “on the islands along the Gulf of Siam” [was established]. By this act, Koh Tral was placed, as it did in 1875, under the French colonial administration of Cochinchine. Brévié himself specified that “the territorial dependence of these islands (including that of Phu Quoc) remains entirely reserved”.

June 04, 1949: In spite of Cambodian protests and the Deferre Motion [the Deferre Motion has been part of the Bill of Transfer of French Cochinchine to Vietnam which spelled out specific rights of the Khmer Krom people], France voted a law allowing the attachment of the Cochinchine territory (Khmer territory) to Vietnam.

April 24, 1954: at the Geneva Conference, Cambodia still continued to protest against the unjust and uneven transfer of her Cochinchine lands to Vietnam by France, and reserved her right to litigate the case at the United Nations.

Khieu Smaphan said to a group of Khmer before he was arrested in late 2007 that he prefer to see ECCC in Hague, Holland insteading of establing in Cambodia.

Did you regret or remorse for fihgting against Hanoi ( Ho Chi Minh ) aginst Indochina Federation for half of your lives and end up in ECCC, no fair trial and end up with some Cambodian ( not all ) still regard you as killers between 1975-1979?

Look at Hun Sen, Heng Samrin Cheasim they all former Khmer Viet Minh and former Khmer Rouge like you they killed Khmer between 1975-1979 , they influx million of yuon into Cambodia and he became they become heroes in many Khmer eyes ( not all ) they committed corruption .

Viet is everywhere in Viet-Cambodia from farmer to technician, from nurse to doctor, from firefighter to engineer, from rubber plantation owner/worker to Hun Sen's political advisor and bodyguards including Angkor Wat's owner...You all name it and Viet is there...Khmer doesn't do squat besides getting addicted to Viet's ass in Viet-Cambodia, even foreigners are enjoying it nicely and quietly too...

Once again, whether or not all you dumb Khmer surrender yourselves to Viet, Khmer is now deep-rooted Viet, and irreversibly so already.

Hun Sen is just a dumb Viet-Khmer that can be disposed of at anytime at just a blink of an eye!

We have millions of us (legally the majority thanks to that dumb Hun Sen) that will vote for Viet-Khmer candidate legally and democratically forever, even the outside world would support and agree and as a matter of factly, there is not much the outside world can do about it...
