of the National Co-Investigating Judge

Today, as the reserve international Co-Investigating Judge Laurent Kasper-Ansermet issued a press statement without any consultation with the national Co-Investigating Judge, the national Co-Investigating Judge would like to announce as follows:

1. After the resignation of the international Co-Investigating Judge Siegfried BLUNK on October 9, 2011, a new international Co-Investigating Judge has yet to be officially nominated until now.
2. On 5th December 2011, the national Co-Investigating Judge met with the reserve international Co-Investigating Judge Laurent Kasper-Ansermet at the Office of the Co-Investigating Judges and informed judge Laurent Kasper-Ansermet that to ensure the legal correctness (in accordance with the principles stipulated in Rule 7.4 of the Internal Rules, Articles 26 and 27 of the Law on the Establishment of the ECCC and Article 3 and Article 5.6 of the Agreement) as well as to ensure the common practices applied so far on the precedent international Co-Investigating Judges, a reserve international Co-Investigating Judge must first wait for an official nomination before commencing his duties. For this reason, any procedural action taken by Judge Laurent Kasper-Ansermet is not legally valid.

Co-juge d’instruction national des CETC

Aujourdh’hui, comme le co-juge d’instruction international suppléant Laurent Kasper-Ansermet a rendu un communiqué de presse à l’insu du co-juge d’instruction national, ce dernier tient à informer les opinions nationale et internationale comme suit:

1. Après la démission du co-juge d’instruction international Siegfried Blunk en date du 9 octobre 2011 jusqu’à présent, il n’y a pas encore de nomination officielle d’un nouveau co-juge d’instruction international pour le remplacer.
2. Le 5 décembre 2011, le co-juge d’instruction national a rencontré le co-juge d’instruction international suppléant Laurent Kasper-Ansermet au bureau des co-juges d’instruction, et l’a ainsi​ informé que pour assurer la conformité légale (en vertu des principes stipulés dans la règle 7.4 du Règlement intérieur, les articles 26 et 27 de la loi portant sur la création des CETC et les articles 3 et 5.6 de l’Accord) et aussi respecter les pratiques appliquées par des précédents co-juges d’instruction internationaux, le co-juge d’instruction international suppléant doit attendre sa nomination officielle selon la procédure en vigueur avant d’exercer sa fonction. Par conséquent, tout acte procédural accompli par le juge Laurent Kasper-Ansermet n’est pas légalement valide.
