Closing Order of Case 002 against Senior KR Leaders Nuon Chea, Khieu Samphan, Ieng Sary, Ieng Thirith


In light of the HISTORIC (!) start of MOST COMPLEX (sic!) trial hearings beginning on   27 June 2011 and again ANOTHER HISTORIC (!) START of this same MOST COMPLEX (sic!) on 21 Nov. 2011 of Case 002 against the surviving Khmer Rouge senior leaders Nuon Chea, Khieu Samphan, Ieng Sary and Ieng Thirith, KI Media is posting installations of the public document of the Closing Order of Case 002 (or, Indictment). The Closing Order of the Co-Investigating Judges forms the basic document from which all the parties (co-prosecutors, lead co-lawyers for all civil parties, defense lawyers) make their arguments before the Trial Chamber judges (one Cambodian President, 2 Cambodian Judges, 2 UN judges). Up until now, the hearings involving these four surviving senior Khmer Rouge leaders have been in the Pre-Trial Chamber over issues of pre-trial detention and jurisdictional issues. Beginning in June November 2011, the Trial Chamber is hearing the substantive (sic!) arguments over the criminal charges   (genocide against Buddhists, genocide against Vietnamese, genocide against Cham Muslims, crimes against humanity at the 200 prisons, mass crimes in countless killing fields, Eastern Zone purges, penal code of 1956, etc.) of only the Phase I Movement in April 1975.

III. KHIEU SAMPHAN
1570.       Khieu Samphan alias "Haem", "Hem"5365, "Khang"5366 or "Nan"5367 was born on the 27 July 1931 in Svay Rieng.5368 His father's name was Khieu Long and his mother's name was Ly Kong.5369 His father was a civil servant and his mother, who was of Chinese origin, became a vegetable merchant when her husband died in 1947.5310
1571.       In 1953 Khieu Samphan went to France to pursue university studies.5371 In 1959, Khieu Samphan completed his doctoral thesis, entitled "Cambodia's Economy and Industrial Development".53'2 While in Paris he began to participate in political activism.
1572.       In 1962, after returning to Cambodia, Khieu Samphan was elected to be a Member of Parliament in Kandal Province and appointed Secretary of State for Trade.5374 In April 1967, after a period of instability in the government, Khieu Samphan faced arrest and prosecution by a military tribunal. This prompted him to flee Phnom Penh on 22 April 1967.5315 He sought refuge in Chieng Tong village in Kampong Speu Province with Ta Mok5376, where he remained until 1970.5311
1573.       Khieu Samphan's political activities between 1975 and 1979 are set out in the section of the Closing Order regarding the Role of the Charged Person.
1574.       Following the fall of the CPK regime in 1979, the flight of CPK leaders and the advance of Vietnamese troops, Khieu Samphan continued to support the activities of the CPK. Khieu Samphan remained in Cambodia with Pol Pot and assisted in directing the conflict with the Vietnamese.5378 His involvement included visiting and distributing supplies to troops, and representing DK as the President of the Presidium.5379 As President and Prime Minister of DK and Provisional President of the Patriotic and Democratic Front, Khieu Samphan instigated efforts to establish a coalition between other resistance groups, the Khmer People's National Liberation Front and the Royalists.5380 With the formation of the CGDK in 1982, Khieu Samphan became Vice President in Charge of Foreign Affairs of Democratic Kampuchea.5381
Between 1979 and 1986, he conducted diplomatic missions, and represented Cambodia at the United Nations, presenting KR interests.5382 In August 1985, when it was decided to create the Party of Democratic Kampuchea, Khieu Samphan was named as President. In 1989 he attended the Paris International Conference representing Democratic Kampuchea, and in 1991, he was present, along with Son Sen at the signing of the Paris Peace Agreements.5383 As such, he carried out an official visit to Phnom Penh in 1991, during which he was attacked by a group of demonstrators.5384 He maintained political alliances with Pol Pot until his arrest in 1997 by the Khmer Rouge.5385 Although generally denying any association with the crimes committed under the regime of Democratic Kampuchea, Khieu Samphan admitted that the CPK "made some mistakes" in April 19 8 6.5386
1575.       Khieu Samphan lived along the Thai-Cambodian border until his inclusion in the Cambodian government together with Nuon Chea in December 1998. At the time of his arrest he was living in Pailin.
1576.       Khieu Samphan refused to meet the psychiatric experts in charge of examining him to issue an opinion on his fitness to stand trial, instead he informed them that he was not suffering from any psychiatric problems and that he refused to undergo any examination. The experts were therefore only able to note that his medical records did not show any history of mental
disorder.5387

khiev sampham and his stupid KR gangster killers showed sign of their psychopath way since the 1960 when everyone in cambodia were driving cars, etc, they stupid, primitive, psychotic KR leaders preferred to ride on their bicycles and live primitive life in the thick jungle of cambodia. that's why cambodia should turn all of our rainforests or jungles into national parks system, etc so potential criminals or psychopath like these stupid, primitive, ignorant, incompetent KR leaders cannot use the jungle to hide and do their illegal activities like terrorism, communism, etc against cambodia again, you know. god know i hate these stupid, primitive KR outdated people, really.

what a waste of time, energy and money. They are not worth it at all. Hun Sen is also one of the criminals that is why he is playing with the court system as a show case and is trying to mock the international court system as well. He is playing with fire and he surely will be burnt for sure. So, keep going, time will catch up with him and his family very soon. he is another Gaddhafi for sure.

in the beginning hun sen thought he was fighting for a good cause lead convinced to join by the then sihanouk. but now 30 plus years, at least hun sen and like others redeemed or reformed themselves already. that's the difference. good people like to see people redeemed or reformed, it is the diehard, non-reformist, the radical, the extreme one like that run away scam rainsy that people have to be wary of, really. i like mr. hun sen and his cpp part for their redemption and their reformation and good work so far, so i can forgive their small mistake becasue they thought they fought a good cause led by sihanouk then to join force, so can't use that brief biography to chastise mr. hun sen now, ok. hun sen redeemed and reformed a long time ago, we know the stupid, ignorant run away scam rainsy and his opposition stupid, primitive party are hypocrites and stupid beyond repair, that cambodia do not want, really! god bless my country cambodia always.
