RFA Khmer Update on 30 September 2013, [video Mr Sam Rainsy Mr Kem Sokha]



Simple recommendations:

1- Holding a general congress [samaj?] with the party supporters/ public to consult general public opinion prior to entering negotiation - the planned congress on 6th October is a positive step forward. This will forge and cement a mood of trust and transparency between the party and the electorate as well as paving the way for direct, participatory democracy to take roots and flourish.

2- Establish and agree a set agenda or specific outline of priorities to be explored or negotiated with the other party prior to sitting at the negotiating table.

3- Never deviate from step 2 under any circumstances, and if necessary defer back to the electorate/supporters by holding another congress to discuss and determine the best course of action prior to resuming the next phase of negotiation.

4- Establish a policy review/research unit [think-tank] to ensure the party is abreast of what is at stake on major policy issues of vital relevance from land rights, ELC and border infringements to constitutional violation. The think tank can act as the party's supreme committee of advisers; a soundboard for the party leadership to feel, reflect and detect against its own policy stance.

5- Demand that the negotiation be set up in a transparent manner with maximum involvement of independent observers, or at any rate, take a tape recording device with you to the meeting!

United States and European Union believed the election was held in Cambodia on July 28, 2013 is not free and fair, over one million names had been removed from the voter lists and about 200,000 names duplication votes

United States and European Union requested Cambodia government to create the Independent election investigations to satisfy Cambodian people.

Only two countries had sent letter to Hun Sen government to congratulating him which is Vietnam and China. The rest of the world they not recognize this election including United Nations.

To all Cambodian people keep fighting for your vote; don’t let this golden opportunity pass by. Stand up together joint with CNRP protest until your succeed.

I love those recommendations. I love steps 5 and 6 very much, the most! So-called enemies have many tricks. Lack of transparency, such as meeting behind close door would come to harm us, even if we are innocent. Most people believe rumors, without observing from all corners. This is the technology world. One could manipulate the recordings very easily, if transparency is lack.

being a non-khmer i just fail to understand whether it is the fear of the opposition party CNRP or its ignorance..

when mr.sam rainsy was kicked out of cambodia by dictator hun sen mr.rainsy toured all aroud the world collecting funds and money including australia,france,u.s, canada,philipines,singapore,thailand(he was not allowed to enter),mynamar saying that he will overthrow hun sen and will be the next prime minister promising people that he will bring change in governance and an end to hun sen.but once after the election which was obviosly rigged by cpp rainsy announced that he will have a nation wide demonstration and protests like mahatma gandhi did in INDIA but all of a sudden he turned demonstration into prayers which became useless. now as time is running out mr.rainsy is speaking of sharing power lolzzz i never know of mahatma gandhi sharing power with the colonial british...

i just feel sad for the people of cambodia who has been trusting nr.rainsy for the past 28 years and mr.rainsy keeps making the same mistake again and again and again.for gods sake mr.rainsy i am from the land of mahatma gandhi(INDIA) and my advise to u is stop making negotiation with the dictator hun sen because " its like sleeping with a venomous snake " the snake will bite u sooner or later when the times is right .call the cambodian people to the streets and demonstrate even at the cost of ur life only then u can kick hu sen and his cronies out of cambodia and my last advice is to ask u not to run away like a coward if hun sen arrests u !! stand and fight like a true leader the people of cambodia are behind u firmly and u will win :)

prime minister on next election wanted, qualities of a good prime minister:

you have probably heard the old saying tht "anybody can grow up to be prime minister. but, not everybody is cut out to be the prime minister. it takes a special kind of person, someone tough, smart, and driven, just to run for the job. it takes still more talent and character to hold up under the pressures of life in the government.

the prime minister must be a great motivator and smart enough t o select the absolute best people for the appointed positions the prime minister is responsible for filling. he also has to be humble enough to listen and act on the opinions of those smart people be selected. sorry for the us of that "he" pronoun but we havent's had a female prime minister yet.

while the history books glorify prime ministers who start wars that abuse their power, they truly great prime ministers are the ones strong enough to avoid using their power to attempt anything which is impossible. a truly great prime minister does not intervene in other countries except for defense and does not intervene in the economy because he realizes that such actions are counterproductive. a truly great prime minister also stays out of the people's personal lives, except for truly defensive purposes, i.e.,punishing violent crimes.

a great prime minister is not one who desires to roll other people, but one who desires to rule as little as necessary.

They are certainly simple, clear and logical recommendations that should form the basis for more discussion among the CNRP leadership to find the feasibility of putting them into practice if and only if the supporters do not want a full war and decide to settle for what they can get through a serious and fair negotiation with the devil. Of course, true bottom lines will never be discussed during this general congress since making the enemy guess hard is the art of fighting a good war and winning it.

It is not easy even with the holding of the general congress to gauge the number of true supporters, what their minimum conditions are, and how far they are willing to go in their fight for what is theirs since the CNRP cannot arrange a countrywide referendum to obtain truer consensus and determination; however, political calculation and deduction by CNRP strategists, of course, with risks involved, during this congress should be enough to allow the CNRP to formulate its minimum demands or a line below which they cannot go.

Taking an order from the people is a new, but worthy concept in Cambodian politics. CNRP may lose in its fight, but as long as it has the mandate of its supporters before the fight, its popularity will not decrease with defeat; in fact, it will even increase since the party has proven itself to be that of ordinary Cambodians. With people's support there will always be another good or even better battle to fight in the future!

Point to Remember: Once the bottom line is established, be prepared to stay outside the government, no matter how long it takes, if the bottom line is not met. Paralyze the whole country if you have to. Remember in medical surgery the physician cuts off the leg to save the life of the patient!

MISTAKE AFTER MISTAKE WILL ONLY EXACERBATE THE PROBLEMS

Before the election, the CNRP made a big mistake by not pressing the CPP hard enough to overhaul the NEC.

After the election, the CNRP made one more vital mistake by not sticking firmly with its demand inquiring about the electoral irregularities.

If the CNRP wanted to succeed, it must stick with what is RIGHT. One unfair concession will lead to failure. The CNRP must understand clearly about the repercussion of its action.
For instance, right now, the CPP refuses to respond to the CNRP’s demand about the election’s irregularities. The CNRP must stick with it and take the next step – the demonstration - to MAKE the CPP accept it.

The CPP knew that it had lost the election by a wide margin; therefore, refusing to accept that inquiry is absolutely the RIGHT thing for the CPP to do. But it is the WRONG thing for the CNRP to let the CPP gets away with it.

In addition, the CPP is the puppet of Vietnam. So, the majority of the CPP’s decisions were emanating from Vietnam, who always defied the international treaties it had signed.
For example, Vietnam’s refusal to leave Cambodia after Cambodia got its independence from France in 1953, Vietnam violated its promises to not attack the allies troop in 1968 Vietnam’s New Year, Vietnam’s failure to abide by the 1973 peace treaty with the US, Vietnam’s defiance of the 1991 Paris peace accord, etc…

Taking these facts into consideration, it is highly likely that the negotiation between the CNRP and the CPP will produce fruitless result.

Therefore, the CNRP will have no choice but to execute its objective decision and follow the necessary right steps to achieve its goal .It is a tough battle. The CPP and Vietnam must know that at least 100,000 Khmer people are ready to make the ultimate sacrifice to save Cambodia. And 100,000 is the psychological winning number for Khmer people to chase this pest Vietnam out of Cambodia for good. Also, the ICC’s door is waiting for the CPP and Vietnam too.

Cambodia National Rescue Party’s intention is to win the 5th Mandate of the National Election in Cambodia and it did win; however, it was stolen by the CPP and the National Election Committee. The people of Cambodia must hold CPP and NEC accountable for their crimes against the people of Cambodia.

There should NOT be any negotiation between CPP and CNRP. The will of the people has already spoken out loud; the people do not want CPP to rule for the next five years, thus CPP has no other choice but to submit to the will of the people. CNRP must continue to challenge CPP based on Rule of Law and they are the followings:

1. Cambodian Constitution
2. National Election Laws

Although the people has already knew NEC, CPP and Constitutional Council of Cambodia are all in this together, or at least they are from the same political party, thus there is no way CNRP will ever get a fair chance on the electoral ballot, but the Cambodia National Rescue Party has the people behind them if not all, at least 85% of the people will back CNRP. In this respect, CNRP has nothing to lose and to pursue CPP under the laws and bringing this attention to the World Community, United States of America, European Unions, Australia and finally, the United Nations.

My recommendation is for CNRP not to join CPP since CPP is the guilty party that stole this election from the People of Cambodia. If CNRP has decided to join this government, it means CNRP has sold their souls for CPP and CNRP does not care about the country, but their own personal interests.

Patrick Henry once said, “ Give me liberty or give me death.” He expressed himself on March 23, 1775 during a speech made before the Virginia House of Burgesses at Saint John’s Church.

Under the Cambodian Election Laws and responsibilities, the National Election Committee has violated most of the Articles in Election Laws. The only possible way that CPP can join and make it right for CNRP is for CPP to recognize the real winner and that is CNRP (63) while CPP (60). His Excellency Sam Rainsy will take a Prime Minister position, His Excellency Kem Sokha will be a Deputy Premiership and CPP can either put Sok An, Sar Kheng or whoever they think will be a better candidate for their own political party. This is one approach to solve this crisis, but I doubt that CPP will accept this idea. On the contrary, to accept the CPP (68) CNRP (55), although not a great idea, but ONLY IF THE FOLLOWING CONDITIONS ARE MET BY THE CPP AND AGREES:

1. To make His Excellency Sam Rainsy the Leader of the House of Parliament and His Excellency Kem Sokha the Vice Chairman of the House of Parliament;

2. To remove all current members of the National Election Committee and reform the Election Laws;

3. To replace all the Members of the Constitutional Council and be placed with the new four (4) members from CNRP and three (3) members from CPP;

4. To amend the Constitution pertaining to the Terms of Limitation of all government employees specifically the Prime Minster Position (Two Terms - Five Years Each Term) and can never be re-elected in any public offices); Both House and Senate members of representatives shall represent in the House of Parliament and the House of Senate of no more than (Two Terms – Two Years Each Term)and these members of the House and Senates can run for public offices at any given times, but through an electoral process.

If CPP agrees to this agreement CNRP will be able to join the new Opening Ceremony of Cambodian Parliament celebrates the 5th Mandate of the New National Assembly of 2013.

I hope this message will find its rightful owner and become key issues in solving this election problem.

It would be ideal if the composition of the Constitutional Council not made up of any members of the political parties and is made up entirely of competent individuals from the civil societies, law society, NGOs and academia, especially those individuals whose principles are deemed scrupulous enough to sit in such an important council. The term of the council is 5 years.

The nomination of names should also be done by non-political organizations and the political parties would have no choice, but to select the members of this council from the nominees presented.

The same can be applied to the National Election Committee.

Those are the ideas underpinning the concept of checks and balances or separation of power principle, and they are more or less implied or implicit in the wordings of the Constitution.

Unfortunately, the Hun Sen regime is not prepared to allow the functioning of any body/institution either outside or within the government that would impede upon and thereby lessen or undermine his total grip on power, and hence the current political strife facing Cambodians today.

I believe the opinions voiced in this forum is intended to help the CNRP whether it is in the form of praise or criticism or sometimes a sheer expression of anger out of frustration.

CNRP had better get used to it if it intends to be always a democratic party, which I think it is.

Cambodians are politically informed and ready to hold any political leaders accountable so let people express their minds before the leaders make serious mistakes.

The day of Hei Euh Hei Euh is gone. If you can't stand the heat, then you are not fit to be a leader that espouses democracy.

Anyone who has 100% faith in Mr. Sam Rainsy and Kem Sokha and do not want to make any comments, then can remain quiet, but make sure you don't desire to kill them later on when their mistakes are too big.

It is better to let people express their opinions. If you are not what they think you are, then time will tell and there is nothing to worry about!

With the negotiation, CNRP leadership would accept 55 Seat plus taken President of Parliament. This would be suicidal for CNRP. I thought Rainsy knew math, if not ask Ranarith because he was the President of Parliament in 1998. I have no faith in CNRP leadership for the ways they negotiate and to how they conduct their protests. Mark my words, CNRP will join the Hun Sen Regime in near future. Hope that I am wrong.

sometimes, khmer people use too much honorary title, makes the person feels important. i think that should be limited and leaders should be address as mr. or mrs. or ms. too much use of the words exellency or ak ah dom or whatever, i think cambodia should make the language more at ease. sometimes, just using sir or madame once or twice in the whole conversation is enough. if you know khmer language, most of the time, we khmer have many words for the same verb. take for instance the verb to eat, in khmer there are some 10 or 13 ways to say eat. the same with the words you, she, he, it, him, her, they, their, them, khmer language uses many ways to say the same word. i think khmer language should be modify just a little. although you and and you and others hate the pol pot way of killing people, i heard some people say the pol pot way in their usage of khmer language is very simply and uniformed and at ease. for example, they called everyone as "mit" or friend. they call the word "you" as "nhome", "nak", instead of the derogatory ones like ah, mi, vea. i think khmer language ought be de-derogatory. because in names, too, if we use mi or ah in front like ah youn, mi youn, etc, it becomes derogatory. but if we use it just youn by itself, then it's not. the same, too for personal names, if we say ah or mi or "kh" in front of all names, it can turn into derogatory name calling. in khmer, it is so true. don't you know?

If you all want CHANGE you have to CHANGE Rainsy FIRST! Rainsy is too WEAK! Guarantee you guys Rainsy will NEVER EVER be able to kick Hun Sen out! CRNP needs to have a STRONG PUSHY and DETERMINATION leader(Sokha not one of them either)Otherwise KEEP Dreaming it's not Going to Happen!

On the contrary, to accept the CPP (68) CNRP (55), although not a great idea, but ONLY IF THE FOLLOWING CONDITIONS ARE MET BY THE CPP AND AGREES:

1. To make His Excellency Sam Rainsy the Leader of the House of Parliament and His Excellency Kem Sokha the Vice Chairman of the House of Parliament;

2. To remove all current members of the National Election Committee and reform the Election Laws;

3. To replace all the Members of the Constitutional Council and be placed with the new four (4) members from CNRP and three (3) members from CPP;

4. To amend the Constitution pertaining to the Terms of Limitation of all government employees specifically the Prime Minster Position (Two Terms - Five Years Each Term) and can never be re-elected in any public offices); Both House and Senate members of representatives shall represent in the House of Parliament and the House of Senate of no more than (Two Terms – Two Years Each Term)and these members of the House and Senates can run for public offices at any given times, but through an electoral process.

Your above ideas sound rational, but not practical with this Vietnam puppet Hun Sen.

Once Hun Sen firmly held on to the power, he will bully his way to kick all CNRP's MPs around. Remember Ranaridht was the President of the National Assembly. Sam Rainsy''s fate will be the same. Consequently, the CNRP will start disintegrating.

Hun Sen will do again because he has never gotten punished for his horrible deeds that he committed in the past.

I am sticking with the winning formula: the CNRP must take concrete steps to MAKE the CPP concedes its defeat, starting with the inquiry about the election's irregularities, and go from there.

This is the time, maybe the only time, that the CNRP will win if it put up the fight with the CPP because the vast majority of Khmer people and the international community are backing the CNRP up.

Concerning the future election, 2018, if the CNRP won with the new NEC, the CPP will not transfer the power to the CNRP. We, as Khmer, should know well about Vietnam’s determination to swallow Cambodia. With this problem in mind, it is imperative that we solve the problem with the CPP and Vietnam right now while the CNRP is in a good position to win – take the necessary steps to claim the electoral victory. Don’t miss this once in a lifetime opportunity.

*The current stand-off between MM Sam Rainsy and Hun Sen would be: a
"HUGE FINANCIAL MATTER".
* I bet that everything will sort out in the near future, and Mr Sam Rainsy will take up position as the President of the National Assembly of Cambodia to legalise Hun Sen government. * Sooner or later, Mr Sam Rainsy will be stripped of his parliamentary immunity and will flee in self-imposed exile as he get used to it.

* Finally, he would have a luxurious retirement surrounded by young and beautiful girls.
It would be a happy ending for him.
