UPDATED: Constitutional Coup: STATUTORY INTERPRETATION (Commentary by Theary C. Seng)

Constitutional Coup
Statutory Interpretation
I notice that some Cambodians genuinely believe the law to be synonymous with justice, and equate it with being “official” and “the rice has been cooked” fail accompli mentality.  

Let me categorically disabuse this thinking:

First, the law is man-made and open to error.  The law can be, and here is often, used as a weapon against justice.  There exists manifestly “unjust law”, but we do not say, “unjust justice”.  

Even if we Cambodians are conditioned to accept the CPP’s modus operandi of “For my friends, everything; for my enemies, the law,” the truth continues to be that justice is eternal and uplifts human dignity.  And for human-made laws to be just must uplift dignity.

Second, what appears to be “official” or fait accompli is in reality subject to change if it manifestly violates the “supreme law of the land” and proves insupportable by the democratic process in a changing populous environment of the Cambodia Spring where citizens are the new fourth estate The thinking may be practical for a certain period of time, when the status quo appears to be eternal, but can be nonetheless erroneous.

Both my observations address a misunderstanding and misinterpretation of statutes.  An “expert” may have an opinion, but it must pass the “laugh” or absurdity test. 

Spirit of the Law 

If, after looking at the language or “letter” of the Constitution, the meaning of the statute remains unclear, we divine the intent of the law by looking at the history, process and other sources.  Generally, we disregard any interpretation that would create an absurd result which the original drafters and lawmakers did not intend.

Or, what one of my law professors posits: “Does it pass the laugh test?” 

With the present political impasse, the issue is whether the sole presence of the CPP satisfy the Constitutional intent of “a multi-party liberal democratic regime guaranteeing human rights and the respect of law” (Preamble, Art. 51) and the answer is a resounding NO!. [...]

Law is man-made, prone to error and manipulation; justice is eternal.   

Law—customary or written—evolves from a desire to order society for human flourishing, the welfare of human dignity, in short, for justice.   

The interpretation of the law must be toward justice.  Hence, it logically flows that interpretation must look at the letter of the law, the spirit of the law—the totality of circumstances—when conflict arises to divine the original purpose and intent for the establishment of that particular law or provision. Hun Sen and the King totally disregard the Supreme Law of the Land and can convert Constitutional Monarchy into Unconstitutional Anarchy. We shall see how some CNRP Members of Parliament will unconstitutional anarchically be stripped of their parliamentary immunity by "cooked-up flagrante delicto case" in the near future (let's say early 2015) according to or rather against Article 80 (Members of the National Assembly shall enjoy parliamentary immunity.

No National Assembly’s Member can in any case be prosecuted, arrested, kept in police custody or detained because of his/her opinions or of the votes expressed during the exercise of his/her functions.

The prosecution against, the arrest, the police custody or
the detention of any Member of the National Assembly is possible only when approved by the National Assembly or by the Standing Committee during the interval between sessions, except in flagrante delicto case. In this last case, the competent
ministry must urgently report to the National Assembly or to
the Standing Committee for decision.

In reality, we all are law breakers. Whether man made laws or the Supreme Law of the Universe.

In America alone there are over 2 million law in the books. I'm sure I've broken 100 hundreds of them each month. I confess, I can't be good enough to satisfy all that the laws demand of me; that is why they have prisons.

Governmental order exist because it was ordain of God as written in the Romans 13. But this does not mean all man made laws are right and just. To have the right and just law we must govern as God does, by his own law. Read Proverbs 8.

The Torah (Law) of God existed to establish peace on earth. Every king of Israel suppose to have a copy of the law of God to rule by. Israel simply means: He shall rule as God rules. The nation of Israel was establish for this purpose, but Israel failed their mission as a chosen people. But this doesn't mean the truth is invalid when it comes to the truth as written in God's Torah.

The Law of God spans over the boundary of the land of Israel, its for all people groups. All humankind are subjected to his Supreme Law to establish Peace on Earth. Messiah of Israel will accomplish this at his Second Coming.

This is why I look unto the God of Israel and not the UN to bring true peace to our humanity. I believe the UN is a false peace advocator for humanity. Israel doesn't sit well with their peace plan, proves that the scripture is sure and true.

The ONLY way I will advocate peace for Khmer people is to seek the peace of Jerusalem.

The Relation of Human and Natural Law

To define human law, a Thomist must refer to natural law. Thomas says that

it is from the precepts of the natural law, as from general and indemonstrable principles, that the human reason needs to proceed to certain particular determinations of the laws. These particular determinations, devised by human reason, are called human laws. (q91, a3, p. 21)
The natural law is law with moral content, more general than human law. Natural law deals with necessary rather than with variable things. In working out human laws, human practical reason moves from the general principles implanted in natural law to the contingent commands of human law.

Natural law is more perfect than human laws, because of the variable subject-matter of human laws.

Natural law is less specific than human laws, but human laws are applications of natural law and cannot deviate from what we might call the spirit of the natural law, as applied to the time and place of the human law's promulgation. If a human law does deviate in this way, if it is not a proper and rationally defensible application of the natural law, then it is a perversion of law, which is to say, it is a law in name only (q95, a2, p. 59).

Natural law holds that in general human life should be preserved and steps should be taken to preserve it. But laws governing automobile traffic so as, among other things, to preserve human health and life are applications specific to the era in which automobiles exist. A further specification, codified in human law, is that in the U.S. one should normally drive on the right and, in Great Britain one should normally drive on the left. At this level the human law is partly a matter purely of custom. Human law in one place differs from human law in another, but if they are laws and not perversions of law they all have the same ends, those contained in the natural law, which is an expression of eternal law.

Dear Theary,

I like the way you keep yourself inside the box. Just step outside of the box for a moment and examine this context.

You raised the issue that “the current political impasse, the issue is whether the sole presence of the CPP satisfy the Constitutional intent of ‘a multi-party liberal democracy regime guaranteeing human rights and the respect of law” does not satisfy the constitutional intent.

I have heard CPP’s response to this. They stated that no one excluded CNRP from participating in the government nor the opening session, it was CNRP’s choice not to participate. Therefore, they are not the one to bear the responsibility.

The problem with CNRP’s leadership is political communication. It is hard to communicate to people when the leaders speak a different language with CPP behind the closed door than they do with the people. People who pay attention can see that poker face every time. And that is sickening.

That is the hard fact that international communities began to understand the idiosyncrasy of Khmer politics. This is why, for example, you see Japan, and EU countries wish that CNRP participate in the government.

CNRP needs to get itself out of this debacle. The supports from international communities for CNRP’s claims dissipates slowly now.

Suggestion to the CNRP:

1- Common sense:

When the CPP ignored the Khmer people’s wills on the election day by NOT even counting their vote, and simply made up the numbers of the seats that they got 68 and the CNRP got 55, did the CPP ask the CNRP and Khmer people’ permission?

2- The CNRP will never achieve its ultimate goal if it kept acting always one step behind the CPP. The CNRP must execute its plan by using RIGHTEOUSNESS as the base for its decision. You cannot follow the law of the traitor Hun Sen and won.

3- The CNRP must know when to concede when not to.

For instance, before the election, you could not win without the new NEC. The solution for that, you made the nationwide demonstration after Sam Rainsy’s return demanding the NEC’s overhaul, and the CPP had no choice but to accept your demand because the movement of the people was so overwhelming favoring the CNRP. The CNRP must know how to take advantage of the momentum.

I had suggested in KI every day (after Sam Rainsy’s return) urging the CNRP to switch from campaigning to demanding the NEC’s reform until the election day, making the election impossible so that the CPP could not proclaim itself as the winner. Some readers in KI made comments saying that they have never thought about that and suggested to KI and the CNRP to adopt my idea.

After the election, you must stick firmly with your original demand: the inquiry about the election’s irregularities. Nothing else. Only after you have finished this step that you proceed to other areas. If the CPP refused, that would be the starting point of the fight. And the CNRP will be the winner because the vast majority of Khmer people and the international community support the CNRP.

The CNRP needs to strengthen Khmer people’s morale by stop saying that we don’t want people to die during the demonstration.
In effect, we make peaceful demonstration to demand for justice to find the thief who stole Khmer people’s votes. If the CPP violently suppressed the people, that would be good for the CNRP because the international community will intervene to help Khmer people and enforce the 1991 Paris peace accord.

On the contrary, the CNRP should inform Tea Ter Banh, Hun Sen, and the evil Vietnam that at least 100,000 Khmer people are willing to sacrifice their life to save Cambodia. And 100,000 is absolutely the psychological winning number over the traitor Hun Sen and Vietnam.

4- Personally, I do not want Sam Rainsy and Kem Sokha to march with the people in the field during the demonstration for security reason. We need these 2 leaders to lead the country after the fight with the traitor Hun Sen and the evil Vietnam is over. Can the CNRP ask the gathering in this October 6th about this idea? If the demonstration can go well without these 2 leaders, why should we risk their life?
The new technology has dramatically changed the way people do thing, we should
take advantage of it. Besides, we don’t know how the CNRP survive without these 2 leaders. The CNRP will be so vulnerable to the CPP’s attack.

You seem to be articulated enough, however your presence is only voicing for the intruder CPP.

Root of the problem is the real result of the election from pollings, rather than the result tabulated and claimed by NEC. Degree of distortion and manipulation of NEC is to be scrutinised by the independent committee . Participation from the UN, NGOs and both parties CPP and CNRP is a very sensible resolution. Please stop claiming that action is interfered by foreign body. UN is indeed global body to ensure the rights abuse can be avoided. Nonetheless , Cambodia , under the CPP is yet NOT independent governing nor economically.

I hope you can understand why CNRP does not wish to commit anything against Cambodian voter's wish.
You may well aware that there ha been some talk between CPP and CNRP high ranking officials, to come to fairness and to maintain Check and balance in implementation of so called DEEP REFORM claimed by self proclaimed PM. It is really a very BAD practice of launching package DEAL, rather than proper proposal and elected by democratic vote. It was not a smart exercise with package of the king, Naranaridh as senate president and HunSen as PM then, and it is not appropriate for the King to offer such a package DEAL, that only causes division in Cambodia. Manipulations avoiding constitutional practice is a disaster , not any benefit to Cambodians.

To walk into senate and accept what has been set up , is only walking into a trap to serve CPP, not Cambodians.

And you have a better comprehension about the matter.

I later hope to see you in a better frame of mind , if you wish to be part of helping Cambodian people, rather than a bunch of self served people.

It is useless, in my opinion, to talk just among ourselves without considering your opponent’s point of views. If considering your opponent point of view may seem as “voicing for the intruder CPP,” let it be. I simply tried to sharpen Theary’s argument here. One is much more effective in convincing others if one understands the opponent’s position and incorporating that position in a counter argument.

Without pointing out to the realities, Theary simply preaches to converts. I don’t see this argument would do any good for Cambodian People; unless, she is saying things just for the sake of saying things.

I like this (CNRP) movement because it challenges the status quo (CPP). I also try to make sure that all of us keep our status quo within the movement in check. Otherwise, we will replace one dictator with a new one.

BTW, I am always in good frame of mind. And I thank you for keeping me in check.

The CNRP has a gathering on Saturday October 6thn 2013 to survey people’s views about Cambodia’s current situation, especially the issue pertaining to the fraudulent election.

The big battle is ahead. This is going to be a tough one. The margin for error is minimal.
The CNRP must eliminate any unforced errors. Something that the CNRP can control, it should not make it.
For example, the CNRP’s decision to follow Preah Reach Damress Preah Maha Ksath Ting Moung Sihamoni has surprisingly shocked Khmer people. People just wonder where the CNRP’s leaders have been in the last few years, not knowing that Sihamoni has been a tool for Hun Sen to use to solidify his power and strengthen his master Vietnam‘s policy of Vietnamization of Cambodia.

For the betterment of the CNRP, it must STOP TOUTING these 2 Kings: Sihanouk and Sihamoni.
In effect, in 1970, Sihanouk was in the same position as Hun Sen today. Sihanouk was perceived by Khmer people, especially the people who lived in the Capital and the big cities, as traitor.
While Sihamoni is simply a Hun Sen’s puppet. Sihamoni would ratify and promulgate whatever Hun Sen told him to.
Moreover, right after the election, the CNRP sent a letter to Sihamoni asking him to intervene to resolve the electoral fraud, and what did the CNRP get? Nothing.
Look when Hun Sen asked that dumb king, he got every thing.

Khmer people don’t want to dwell on something in the past but we don’t want to see the same mistake reoccur.

If some of the CNRPs leaders are very close to the King Norodumb family, keep that closeness to yourself. Your stupid closeness has screwed the CNRP up.

What will happen in the near future?

After the gathering on October 6th 2013, the CNRP must go back to do the right thing by mounting a peaceful nationwide demonstration, firmly demanding the inquiry about the election’s irregularities – nothing else.

If the CNRP refused, that would be the starting point of the fight for justice. The CNRP must know that its back is against the wall, the only way to survive is fight through it.
And the time for Khmer people to sacrifice to save Cambodia is right here. Only when the killings committed by Hun Sen and his master Vietnam were so huge that the international community would intervene and punish the neo colonialist Vietnam and its puppet Hun Sen.

The hypocrite Vietnam did not win the war by itself. It got tremendous help from China and the Soviet Union. One factor that made Vietnam the winner was the sacrifice of its people.

And if Cambodia wanted to survive, its people must sacrifice NOW. This is the right time, and maybe the only time. I put the number at 100,000 people, which is the psychological winning number. It is NOW or NEVER. The CNRP is the winner of the election. It must take the necessary steps to get it.

Later on, Khmer people’s sacrifice will produce nothing because Vietnam’s grip is getting tighter and tighter as time goes by.

Vietnam said it fought the colonialists France and the US, and now it is Cambodia’s turn to fight the neocolonialist Vietnam. Cambodia will win at last.

Mu Sochua was more aware of the King and Hun Sen's strategy than Sam Rainsy. She delivered what she can do and sticks to her promise. She even abandoned the Royalist Party and the King's shade to help the poor and commit to the reforms. That is the real leader!

King and NEC are under Hun and Hun is under Viets/vc and VC's plan is to take over Srok Khmer. Viet/vc have created one problem after another e,g created Pol Pot to fight against Lon Nol/ Sirik Matak and created Heng Sarin and Chea Sim to fight against Pol Pot, created Hun Sen to fight against Heng Sarin and Chea Sim and then created a nation full of corruption against Hun Sen.

Wake up everyone, this is what they are good at, their aim is to destroy us and our nation. They have helped to kill all of our educated ones and then, they went on to say that 'khmers are racists, dumb and lazy', while they continue to rob and kill us on a daily basis. They then went on to fool the international community not to interfere in our internal affair, while they do. They continue to exploit our poor nation to get more donations, but only to fall into their hands, how?

Because they already have full control of our political system, which means we are under their controlled. They did this before and they will continue to do it again and again. They did it to Laos, Champa, Khmer Krom and now, the whole Srok Khmer, if we let them.

They are very good at lying, decieving and manipulation. But in the end, everyone knows who they are what they capable. So for now, they can run but they can't hide. For life is too short might as well do it.

For Hun Sen, there are 1.3billion Chinese, 90million Viets, and 80+million Thai, have you ever ask why are they getter bigger and better all times? because they have conformed well and they are working for the benefit of their nation, not for personal interests whatsoever, why? because money is not everything, doing the right thing is everything.

So please have some good moral for yourself and for your nation. It is time to wake up and see a bigger picture of what went wrong and why? In Japan, leader know that they are not good enough, they would cry and apologie to the people in term of 'not competent' enough to work to benefit its naiton.

Hun Sen, so far, you have put us khmer nation in shame, because you are allowing yourself to be used by the VC and Chinese (e.g through land concession) and they are working the benefit of their national interest e.g to get our all of our natural resources and donated goods to feed their big nation.

They are love their people and making sure, they have enough to eat, while at the same time they rob from yours and making sure your people have nothing to eat, in order for them to further exploiting them for their own benefit. Please wake up before it is too late. It is time for change, just look at Abisith and Yanluck, ok.

I believe you when you say you will make incredible reforms in Cambodia.

I believe that you have real leadership experience and not just simulate on Xbox.

I believe that one day I will read one of these international news and actually get something for my time and energy that all Cambodian leaders promise aren't just a party propaganda pitch but rather a genuine effort to help Cambodians be better citizens living out of poverty.
