A proposal to lift the immunity of opposition leader Sam Rainsy should not be used in a case over unpaid election fines, a senior rights official said Monday.
“The method of lifting immunity should not be used in this case,” said Lao Monghay, a researcher at the Hong Kong-based Asian Human Rights Commission. “There will be public concern, especially among opposition supporters.”
The National Election Committee has ordered Sam Rainsy to pay 10 million riel, or $2,500, in fines, following remarks about the ruling Cambodian People’s Party during campaigning last year, but the opposition leader has refused to pay.
Justice officials are considering a request to lift his parliamentary immunity in the National Assembly over the refusal.
However, Lao Monghay said the case was civil, and refusal to pay should lead to the seizure of property, not a penal prosecution.
He disagreed with a Sam Rainsy proposal to seek a pardon from the king if an appeal over the fines fails in the Supreme Court, saying it would be unfair to others who face similar charges.
CPP lawmaker Cheam Yiep said Monday he had not seen a proposal to lift Sam Rainsy’s immunity yet, but said if Sam Rainsy paid the fine, the matter would be over.

Sometimes I feel Dr. L Mong Hay's understanding of the independence of the Cambodian Court/Justice system bizarre......He should know that the CPP court is useless for anyone other than the CPP.

Immunity is dangerous and it should be abolished. For all that matter, Sam Rainsy could be shooting people in broad day light, and no one can do anything about it.

I agree with Dr Lao Mong hay that lifting immunity for member of parliament is not right and not demoacric. The same for asking pardon from the King is not appropriated either. If Sam Rainsy is wrong for making wrong allegation without proof, he should be fined. But the Natinal election committee must prove themselves first to be neutral and reliable. They should also making a list what are legal and what are illegal during election campaigns. example-During election Campaigns each candidate or each party leader shouldn't
1-personal attack.
2-Using intimidation tacticts
3-Buying opposition members before or after election campaign
4-Bribery to voters
5-threat by warfare or by force
etc.. and etc..
The NEC itself must solve all the problems complained by each party. If the NEC itself was not neutral and reliable to solve problems suggested by each party, all complains made that NEC are also irrelevent and all NEC members must resigned for incompetent. AReak Prey

Dr Lao is a hypocrite. I doubt that he will be in favor of keeping the immunity for the CPP members as well if they were charged for non-payment of a fine.
At any rate, more importantly, Dr Lao have been preaching Rule-of-Law, Equality, and all, but at the same time, he's for keeping some people exempt from rule-of-law and equality using immunity as a shield. Isn't that a a bit silly?

I assume that you have been a member of CPP and you are blaming Dr Lao for his vision. I believe that he is right to protect people right. Each member of each party has been elected to Parliament by a general election. Therefore only each general election, a member can be re-elected or be rejected by the people. They cannot be rejected by their other member of Parliament at all. If they are going to resign then their party should replace them by their own party according to their ranking list in their party. But if they have committed a crime ( stealings and killings) and their party have suggested them to resign for full investigation, then their party will replace them by their party list member too. In this case of Sam ransy, he has not committed a crime. He has just misled his campaign. But he can also challege the Neutrality of the NEC. If this NEC is not Neutral by way of avoiding complain made by Sam ransy, then all members of NEC should be resigned themselve. All members of NEC should be approved by all members of Parliament and they all should be not affiliated with any political party. AReak Prey
