Sam Rainsy lost his immunity [through illegal tactics by the CPP-controlled NA permanent committee]

Sam Rainsy contests the decision of the National Assembly permanent committee to lift his parliamentary immunity, and he plans to write to the king to ask for a pardon.

The NA permanent committee showed its fast zeal in deciding on Thursday 26 Feb to lift Sam Rainsy’s parliamentary immunity at the request of Hang Vong Ratana, the minister of Justice. The opposition leader now becomes a citizen just like anybody else because he was sentenced by the NEC to pay a 10 million riels fine ($2,500) for disparaging CPP leaders during the July 2008 general election.

CPP MP Chheang Vun, a member of the NA permanent committee and chairman of the foreign affairs committee, had confirmed this decision. “According to the constitution, during the NA vacancy period, the permanent committee can make this decision and then inform the MPs during the plenary session,” he told Cambodge Soir Hebdo. Nevertheless, Article 80 of the Constitution stipulates the need for an additional step: “Decision of the permanent committee must be submitted to the following plenary session for an adoption by a 2/3 majority of its members.”

The permanent committee plans to write to the justice minister to inform him about its decision to lift Sam Rainsy’s immunity.

On the other hand, Sam Rainsy is protesting: “I did not lose my immunity because the NA has yet to pronounce (its decision) in plenary session, the permanent committee has no right to take this decision.”

Sam Rainsy criticized the tactics: “I am asking for some time because I made an appeal to the Constitutional Council to study if the decision to sentence me abides by the Constitution.”

Sam Rainsy plans to get out of this imbroglio through a maneuver: “I will write to the king to ask for a pardon and I will send the 10 million riels to the Kantha Bopha hospital instead.”

In 2005, Sam Rainsy also lost his parliamentary immunity for defaming Norodom Ranariddh.

This kind of politic has proved to the world that Cambodia is too premature to engage with multi-party system. All leaders of the CPP are still ignorance of the system and cannot accepte the system of anti-government decision where they have ran since 1979-1993. I believe that all CPP members should change their present old members who are too old to learn. In multi-parties system, the national assembly should respect the right of the opposition and the Neutral Role of National committee for the election. All rules and regulations of the election shouldn't set up the national assebly and a selected committee in which each party has their equal members to input to ideas and then put forward for the National assembly to approve. During each election, if the NEC has failed to their duty, they have also be sacked. I am lucky that I have not involved with these kind of people. They are worst than animal. Areak Prey

You must understand that Cambodia is belonging to every single Cambodian. It doesn't belongs only to CPP. Cambodians people have fought each other to nearly to extinct 1991. Until UN opened up for all Cambodian to reconcilliale for peace by UN assistance. From 1993, Cambodia should promote multi-parties system and open up for democracy. Without these opportunities, Cambodia would be a place for all wild animals such as you, your families and all CPP.
Pol Pot was driven out from Cambodia in 1979 by Vietcong general Be Binh and was not by CPP at all. I was one of the victims of the Khmer Rouge and I haven't seen any CPP shit there at all. All army were all from Vietnam soldiers. THe suppliers of foods to that group was one of my friends. Therefore I knew these stories very well. I hope that if CPP think they have 2/3 majority and they can do everything they like, they should remove all SRP members and all HRP member so that they don't have any opposition voice in the Parliament.
But that decision is not simple. As I have said before, only National General election can terminate Sam Rainsy immunity. He hasn't committed any crime( Stealing or killing ) at all. THe killers and the stealers should have been removed by the court. Areak Prey

Regarding HE Sam Rainsy's immunity, why so much a hurry to lift it during the Parliament's recess? His crime is not very serious and he endangers no one.

Lifting parliamentary immunity in a democracy is a very serious matter, and there are alternatives to it to force an MP to pay a fine.

With a little bit of imagination, the court could and should issue an order ordering him to pay the fine and another order ordering the National Assembly to deduct the sum from his remuneration. With that order, the the National Assembly's finance officer could deduct that sum and transfer it to the NEC's bank account.

HE Sam Rainsy could go to court to contest this deduction.

Furthermore, politicians should stop resorting to the royal pardon. If they believe in the rule of law, they should not think they have any more privileges than their fellow countrymen. All are equal before the law and are equally protected by it. There are others who have the smae troubles with the law as them. Why can't they have the same royal pardon?

A FRIENDLY COMMEMT---I always like to read news and discussion about Cambodia and the khmer people online. Sometimes I feel happy with good news and sad about bad news. I believe that most of you may feel the same as I do. Sometimes this sadness can turn to be frustration and anger because of how we feel about things and the way we react to them accordingly.

Sometimes I feel worse not about the issue itself but the derogatory language and the profanity in the discusions, comments and insults. I understand that we all have felling and we all have good heart and compassion because we seem to care about our Khmer people including ourselves. However, I feel regretful that we (some of us)can't respect each other differences. In the context of our Khmer history, there is a myth that we Cambodians don't get along and the Angkor Empire had collaped as a result. Take a look at the comtemporary Cambodia now. I guess we can tell that the myth has clearly become a reality. And also take a look at some of the comments on this blog. All of these reflect our characters. We all love (all)Khmers. There is no question about that. So please voice our opinion in a constructive and respectful way. There is no gain if we keep fighting and hating each other. I know that some of you care so much about your politicians, but don't lose your conscience of who you are. Don't let ourselves be obessed by those leaders' influences and forget about our Kmher nation.

Let me give some suggestions: opinion vs. fact

Opinion is no rigth or wrong and fact is true. So from what I see here on the blog is opinions. We can agree to disagree, but we cannot express our hatred at something that is different from what one believes.

Sometimes I feel ashamed of myself as a Khmer person (former country boy) not because of my race, but of what has happened to us Khmer until now --violence, hatred, and so on. Foreigners may laugh at us or YOUN may be happy because we KHMER don't get along...or YOUN may push a botton so KHMER can kill each other.

Please respect our differences with compassion. We cannot afford to fight one another anymore.

My opinion in this forum is also to help our Cambodian people to understand the value of democracy and the value of our bilateral respect. But as you have seen in this forum, there are some guys who are not prepare to read and to digest other opinion but have always insult others. Example, they have even insult Mr Sam Rainsy who is also an elected member of Cambodian parliament. He is also a leader of a party just as the same like Hun sen. I don't care really who is the leader of Cambodian Government. What I care is to see Cambodian can get out from poverty and from suffering I am not a propanda of any political party at all. In Cambodia, the laws comes from Hun Sen's mouth. What Hun Sen said is the laws. Rainsy didn't say he will not pay the fine, he said he will pay when he exhausted all avenue of appeal. Now he is appealing to the High Court. Why can't Hun Sen wait. Anyway, this has nothing to do with Hun Sen and the CPP. It is about Rainsy vs. NEC only. What Hun Sen did by lifting Rainsy's immunity is interferences with the judiciary. This we called the laws of the jungle.

Sam Rainsy has paid the fine on 26th Feb, yesterday. The lifting of his parliamentary immunity is unconstitutional. The parliament should wait until he has exhausted all avenues of appeal. Currently he is appealing to the High Court.
