Cambodia's highest court rejects appeal by exiled opposition leader

Phnom Penh - Cambodia's Supreme Court on Tuesday upheld a two-year jail sentence against exiled opposition leader Sam Rainsy for tampering with demarcation posts on the border with Vietnam.

The ruling confirmed the judgement of a lower court last year, which convicted Sam Rainsy of racial incitement and damaging public property after he uprooted several border markers.

Sam Rainsy's lawyer, Choung Chou Ngy, condemned Tuesday's ruling.

'It is not fair - I think this is a political case, not a penal case,' he told the German Press Agency dpa.

Sam Rainsy currently lives in exile in France.


Mu Sochua, a prominent parliamentarian with the opposition Sam Rainsy Party (SRP), said Tuesday the ruling was predictable since it had come from a judicial system 'totally shaped to silence the opposition.'

'We continue to condemn the form and quality of justice in Cambodia, because the courts are used as a political tool against Mr Sam Rainsy as well as other activists who are not in favour of the policies of the government,' she said.

Mu Sochua, who lost a defamation case against Prime Minister Hun Sen last year, has yet to have her parliamentary immunity restored.

The SRP has charged that the land rights of Cambodian farmers living near the Vietnam border were not being respected in the ongoing process to demarcate the 1,270-kilometre border. The process is scheduled to be completed by 2012.

The incident riled Hanoi, which is a close ally of Hun Sen's government. Vietnam has significant interests in agribusiness, aviation, telecommunications and banking in Cambodia.

The judiciary has long been criticized as being a pawn of the ruling party.

Last June, the United Nations human rights envoy, Surya Subedi, said some judges were not interested in upholding the law. The courts faced 'tremendous challenges in delivering justice for the people of the country, especially the poor and marginalized,' he said.

We can't say, that Sam Rainsy live in France as exiled or political refugee, because he has an European Citizenship, can live and travels all over the places.
In this case Mr. Sam Rainsy is not an exile.

It is not possible for a Khmer citizen from Cambodia to travel around, when and where they want to go ?

This Supreme Court's rulling is the last nail on Sam Rainsy's coffin. His lawyer can say whatever he likes, but at the end of the day, he has to respect the Court's verdict.

Fucking useless court I won't respected that slave court at all. Court in Cambodian is control by ah Kwack and his gangster CPP slave Youn, they do whatever ah Youn told them to do. So just kiss my ass stupid and fucking piss a shit court.

What's court? it's a kangaroo court presided by a corrupt judge not basing his/her judgment on the rule of law, but on directive from Hun Sen. The whole is watching this case and will condemn the decision.God may save Mr Rainsy, but nothing will save Hun Sen and his kangaroo court's judges when their time are up.

Kangaroo court just for the Kangaroo people like we all.

It is difficult to understand why they keep on going to the court when they know it is a kangaroo court. Perhaps they have no idea what they want and what else they could do.

4:45PM I hope you read the recent statement by UN envoy for Human Right in Cambodia, which criticised the Hun Sen govt for using law suite to clamp down on opposition. He even went further by talking about freedom of expression not being a crime. He referred to the attempt by the Hun Sen govt to try to block this very website and other website.Cambodia is an authoritarian state,where people are not given the chance to prove themselves beyond reasonable doubt that they are not guilty. You are guilty even before you appear in court.

Well, we all knew that Hun Xen regime using jungle laws. Thats why they named kangaroo court. A kangaroo is an animal. The curt name said it all. And when his son become a next prime minister, that'll change to a Monkey court, and this gona be tougher than a Kangaroo court. So in the future khmer people have nothing to eat, especially no bananas.
