Dam Sith’s Apology is Evidence of Government Campaign to Silence the Opposition

DAM SITH’S APOLOGY IS EVIDENCE OF GOVERNMENT CAMPAIGN TO SILENCE THE OPPOSITION

The Cambodian government has, in recent months, increasingly targeted members and supporters of the opposition Sam Rainsy Party (SRP). The recent news that Mr. Dam Sith, editor-in-chief of the pro SRP Moneaksekar Khmer newspaper, has written a letter of apology to the Prime Minister and offered to close the newspaper in return for the cessation of criminal charges against him, raises grave concerns. These actions come just two days after Mr. Kong Sam Onn, a lawyer who had been representing two SRP members of parliament, submitted an apology letter to the Prime Minister and joined the ruling Cambodian People’s Party (CPP) in order to have the law suit against him dismissed and to avoid being summons to a disciplinary hearing by the Cambodian Bar Association. The Cambodian Center for Human Rights (CCHR) is profoundly disturbed by the implications of these latest events and the threats they pose to democracy in Cambodia.

Although there are currently five political parties represented in the National Assembly, the CPP has been the ruling party since 1998 and the SRP is the only opposition party to hold a substantial number of seats in the government. The parties represented in the 123 seat National Assembly are: the CPP with 90 seats; the SRP with 26 seats; the Human Rights Party (HRP) with 3 seats; the National United Front for an Independent, Neutral, Peaceful, and Cooperative Cambodia Party (FUNCINPEC) with 2 seats; and the Norodom Ranariddh Party (NRP) with 2 seats.

The actions of the government in the past few months indicates that it is directly and systematically trying to dissolve the main opposition party by filing unfounded criminal lawsuits against its leaders or forcing its members and supporters to join the CPP. In April and June, editors of two other pro-SRP newspapers, the Serei Pheap Thmei and the Khmer Mchas Sork respectively, were charged with defamation and disinformation, the editor of the latter publication, Mr. Hang Chakra, was convicted of disinformation and sentenced to one year imprisonment and a fine. SRP parliamentarians Mrs. Mu Sochua and Mr. Ho Vann had their parliamentarian immunity lifted by the National Assembly on 22 June so they could face defamation charges. Sam Rainsy himself was accused of defamation earlier this year. These actions clearly suggest an active campaign on the part of the Government to curtail the actions of the Sam Rainsy Party and to silence the opposition.

On 7 July 2009, Mr. Dam received a summons to appear in court to answer charges of defamation, disinformation and incitement. In his apology letter released last week, Mr. Dam explained his concession to the government on the grounds that he has “nothing else to depend on to escape the court charges against me”. Mr. Dam has been sued by the government twice before: once in 2006 and another time in 2008. The latter incident led to pre-trial detention. Both incidents were also related to his professional work at the Moneaksekar Khmer newspaper.

The CCHR echoes the fears published in the Khmer Sthapana and Deum Ampil that Mr. Dam, as a well-known critic of the CPP, will be pressured to follow Mr. Kong in joining the ruling party. We strongly urge the Government to stop these unfounded attacks on against opposition leaders, members and supporters. Cambodia needs active opposition parties to provide a stable, multi-party democracy. The CCHR fears that this campaign is evidence of a policy aimed at creating a one-party system in Cambodia thereby ending democracy in the kingdom and seriously eroding the rights and freedoms of Khmer citizens.

OPPOSITION newspaper publisher Dam Sith has issued a "sincere apology" to Prime Minister Hun Sen after a government lawyer filed defamation, disinformation and incitement lawsuits against him at Phnom Penh Municipal Court on Tuesday.

In a letter dated Wednesday, Dam Sith apologised to the prime minister for "serious mistakes" committed while at the helm of the opposition-aligned Moneaksekar Khmer, pledging to cease publication of the newspaper if he receives a pardon from Hun Sen.

"In the past, I repeatedly failed to act properly and seriously affected the honour of Samdech [Hun Sen] and the CPP leadership through my Moneaksekar Khmer newspaper," Dam Sith wrote.

"I am asking for the highest permission of Samdech to forgive me so that I can escape the court charges against me."

He added: "In exchange for the generosity of Samdech and the CPP leadership, I promise to discontinue the publication of Moneaksekar Khmer after I receive a pardon from Samdech."

Dam Sith received a summons Tuesday from Phnom Penh Municipal Court Deputy Prosecutor Sok Kalyan, asking him to appear July 14 for questioning over a series of articles published in the newspaper earlier this year.

Sok Kalyan declined to comment when contacted on Thursday. But Long Dara, the government lawyer who filed the lawsuits, said the letter had reached Hun Sen, who ordered him to withdraw the complaints against the publisher.

"He has written a letter of apology acknowledging the mistakes he has made.... We will drop the complaint today [Thursday]," he said.

He said that since February, Moneaksekar Khmer had continually published articles that sought to "incite" conflict between government leaders.

Sam Rainsy Party lawmaker Eng Chhay Eang said he was unsurprised by Dam Sith's appeal to Hun Sen and did not blame him for requesting a pardon.

"The government is now using the court to silence freedom of expression. We are not disappointed with [Dam Sith] - we have pity on him," he said.

'Critical phase'

But following the apology, and subsequent pardon, of Sam Rainsy Party lawyer Kong Sam Onn on similar charges Tuesday, civil society groups say the country is entering a critical phase in its democratic development.

Kong Sam Onn had filed a defamation lawsuit against Hun Sen on behalf of SRP lawmaker Mu Sochua in April, prompting accusations of professional misconduct by the Cambodian Bar Association and a defamation lawsuit from government lawyers.

"I think this is the beginning of the end for press freedom in Cambodia," said Moeun Chhean Nariddh, director of the Cambodia Institute for Media Studies.

He also expressed fears the fate of Moneaksekar Khmer - one of only two opposition newspapers in Cambodia - could parallel the fate of former opposition newspaper Sralanh Khmer, which went over to the ruling party after its editor Thach Keth defected to the government in 2006.

He said, "If the editor-in-chief has apologised to the government, it is very likely he will receive a pardon from the prime minister and then either the newspaper will be shut down or it will [start] publishing as a pro-government newspaper."

Ou Virak, president of the Cambodian Centre for Human Rights, also highlighted the Sralanh Khmer situation, but said that civil society activists were unsure about when the current crackdown will end.

"It's a growing concern that any of us could be charged and potentially thrown in jail or be pressured to join the CPP," he told the Post.

"That would be a new low, a terribly new low. The question is when it will reach the point of no return."

In the statement Dam Sith issued on Thursday, Dam Sith declared his support for Hun Xen’s policy. Dam Sith’s change of heart took place in his apology letter to Hun Xen and he asked Hun Xen to help him escape the court charges. This request for Hun Xen’s forgiveness took place after the Phnom Penh municipal court issued a summon asking him to come to court on 14 July to clarify the lawsuit brought up Hun Xen’s government lawyers. Dam Sith’s apology letter diffused a tense situation.

Cambodian editor gets pardon in return for apology and closure of his newspaper

The case against Dam Sith, editor-in-chief of the "Moneaksekar Khmer" newspaper, has been dropped by order of Cambodian Prime Minister Hun Sen, after the editor issued a letter of apology on 8 July 2009 to the premier and agreed to stop publication of his newspaper, media sources said.

"Khmer Sthapana" said Dam Sith was jailed in 2008 after he quoted in his newspaper a speech by opposition Sam Rainsy alleging that Foreign Minister Hor Namhong was a former Khmer Rouge leader. He was released as a result of international pressure and an apology he issued to the minister.

Despite his release, however, criminal charges against Dam Sith remained. The editor was charged of violating Articles 62 and 63 of the Cambodian Penal Code.

Both "Khmer Sthapana" and "Deum Ampil" quoted Dam Sith in his letter of apology to PM Hun Sen as saying, "I have nothing else to depend on to escape the court charges against me," hinting at the hopelessness of his case in Cambodian courts.

Both publications said political analysts in Phnom Penh predict that the editor will be forced to join the ruling party.

Not only media but civil society is also feeling the pressure in Cambodia. Human right groups have expressed concerns over a recent surge in legal actions against members of civil society and opposition activists.
