The Phnom Penh Post
EIGHT people have been summoned to appear in Svay Rieng provincial court today and Wednesday for questioning in connection with an October incident in which opposition leader Sam Rainsy joined local residents in uprooting posts marking the border between Cambodia and Vietnam.
Pov Pheap, second deputy chief of Samrong commune in Svay Rieng’s Chantrea district, said Monday that he and two officials from nearby Bavet commune – Sok Sam Ien and Suk Korn – would appear at the court, though he maintained the innocence of all who have been summoned.
“We will not escape; we must appear in court in order to avoid arrest,” Pov Pheap said. “We are not afraid of being summoned because we have not done anything wrong.”
All three commune officials are members of the Sam Rainsy Party, Pov Pheap added.
In addition to the commune officials, five villagers from Chantrea district will also appear for questioning. The commune officials and the villagers joined Sam Rainsy in his October protest over what they said were continued encroachments on their land by the Vietnamese.
Sam Rainsy has been summoned to appear in Svay Rieng provincial court on Monday, though he remains abroad in Europe and it is unclear whether he plans to attend.
A citation issued last week by Judge Long Kesphyrom stated that the opposition leader was charged with racial incitement and the destruction of property, and that a warrant would be issued for his arrest if he did not appear as ordered.
Meas Srey, one of the villagers summoned to the court, said there were many more than five people in her community who had lost land to the Vietnamese, but that most of her neighbours did not dare to complain publicly.
“I am not afraid. I have not done anything wrong. I saw the poles planted on my land, and I uprooted them,” she said.
Another villager summoned to appear, Prom Chea, said he was nervous about his day in court, though he also maintained that he and the others who participated in the protest had done nothing wrong.
“I’m worried about losing land, so I complained. I relied on the government to resolve the situation, but they did not resolve it,” he said, adding that he and his family had lost between 4 and 5 hectares of land to Vietnamese encroachment.
Judge Long Kesphyrom could not be reached for comment Monday.

Sok Pheng warns human rights organizations not to help SRP officials, accuses the SRP of spreading fear among CPP officials
Friday, March 21, 2008KI-Media
Sok Pheng, a recipient of Hun Sen’s nomination reward as government advisor for his defection from the SRP, issued a warning to human rights organizations in Cambodia not to provide help to SRP officials accused by the CPP of illegal detention of Tim Norn, a former SRP commune councilor from Kampong Thom who defected to the CPP with Sok Pheng. The Cambodia Daily reported that Sok Pheng’s statement was read on local Cambodian TV stations, calling human rights organizations not to help Men Vannak, SRP Sralao commune councilor, and Thorn Rithy, deputy chairman of the SRP Kampong Thom province council. The Cambodia Daily quoted Sok Pheng as writing: “If the human rights groups protect [the SRP officials] it means that they have actively participated in the abuse against the people’s rights.” Sok Pheng, seemingly forgetting that he now works for the ruling CPP party which controls power in Cambodia, went on to accuse the SRP of spreading fear among CPP officials.

SRP: Immediate and Unconditional Release of SRP Pong Ro Commune Chief
SRP Commune Chief Tuot Saron (L) seen here distributing help to one of his poor constituents, was arrested from false chargePhnom Penh March 20, 2008
IMMEDIATE AND UNCONDITIONAL RELEASE OF SRP COMMUNE CHIEF
Sam Rainsy Party calls on the Kompong Thom court to unconditionally and immediately release Mr. Tuot Saron, a commune chief of Pong Ro, Kampong Thom province, who was charged and jailed on 19 March, 2008 for a crime he did not commit.
Mr. Tuot Saron was arrested in Kompong Thom a day after the Prime Minister openly ordered the court to take action against him. In the same speech, other SRP members were mentioned by PM as possible targets for arrest. For the court to act under direct order made by PM without proper investigation is clearly explain the power of the Prime Minister Hun Sen over the court, judges and prosecutors as identified by the UN special envoys for Human Rights in Cambodia.
The use state and private media to disseminate orders for arrest members of opposition party is not just an abuse of power, but also an attempt to spread fear among voters and members of political opponent who are rejecting the CPP. Such action is seriously violating Human Rights, particularly the political rights of our citizens which is one of the most fundamental human rights stipulated in our Constitution and UN Conventions.
SRP is gravely alarmed by the current political environment which is not conducive to free and fair election to be held on 27 July, 2008, just four months from now.
SRP strongly urges the International Community to call on the government and the National Election Committee to take all measures to immediately stop these political harassment and threat so that the 2008 election can and will be held with free and fair environment.
SRP calls on the International Community not to delay sending observers to monitor the upcoming election and to seriously take note of the recent political development as a threat to free and fair election.

SRP: Kampong Thom Authority Must Release Mr. Tuot Saron
Translated from Khmer by Socheata
SAM RAINSY PARTY
Kampong Thom Authority Must Release Mr. Tuot Saron
Kampong Thom Authority Must Release Mr. Tuot Saron
At about 9:30 AM on 18 March 2008, Mr. Tuot Saron, SRP Pong Ro commune chief, Baray district, Kampong Thom province, was arrested by the Baray district police and he was taken to the district police station without any warrant issued by the tribunal. Mr. Tuot Saron was arrested while he was traveling to participate in a meeting at the Baray district office.
The arrest and the taking of Commune Chief Tuot Saron were orchestrated by the police authority after Mr. Hun Sen issued a declaration on Sunday 16 March 2008, regarding the accusation alleging that SRP activists threatened and detained Mrs. Tim Norn.
Mrs. Tim Norn was a former SRP party member in Baray district, she joined the CPP on 14 February 2008. On 16 February 2008, at about 10:00 AM, Mrs. Tim Norn contacted Mr. Thorn Rithy, the deputy chairman of the SRP council committee from Kampong Thom province, and Mr. Men Vannak, the SRP deputy chairman in Baray district, to help her because she decided to leave the CPP. After hearing Mrs. Tim Norn’s insisting pleas, Mr. Thorn Rithy asked Mrs. Tuot Saron, the Pong Ro commune chief and SRP party chairman in Baray district, and Mr. Men Vannak to fetch Mrs. Tim Norn from her hiding place in Kampong Thmor village, Balaing commune, Baray district, and bring her to Phnom Penh where she stayed for a night at the home of Mr. Thorn Rithy on 16 February 2008.
Because Mrs. Tim Norn was scared and concerned about her safety, at 08:00 AM on 17 February 2008, Mr. Thorn Rithy took Mrs. Tim Norn to meet with Mrs. Tioulong Saumura, Phnom Penh SRP MP, at the SRP party headquarters. Afterward, Mrs. Tioulong Saumura told Mr. Thorn Rithy to accompany Mrs. Tim Norn to the Licadho office in Phnom Penh so that this organization can provide her with safety protection. At the Licadho office, Mrs. Tim Norn spoke about her concern over the personal safety of her husband and children in front of the human rights organization officials, and she even asked for help to bring her husband and children to meet her at the Licadho office. During that occasion, Mr. Men Vannak volunteered to bring Mrs. Tim Norn’s husband and children to come and meet her at the Licadho office on 18 February 2008. From that date on, Messrs. Tuot Saron, Thorn Rithy and Men Vannak, as well as other SRP officials, never contacted or met with Mrs. Tim Norn and her family anymore.
Therefore, the arrest made against Mr. Tuot Saron and the attempt to arrest other SRP activists by the police under the accusation that these activists threatened and detained Mrs. Tim Norn, is done with ulterior political motives orchestrated by the ruling party to frighten and discourage SRP activists who refuse to join the CPP.
The SRP asks the Kampong Thom police and tribunal to end the accusation made against Mr. Tuot Saron, and unconditionally release him immediately, and that a proper investigation be conducted in this case to reveal the culprits who invented these charges against innocent people for their personal political benefit.
