Lawyers for Brother No 2 Nuon Chea have filed a request calling for summary action against Minister for Foreign Affairs Hor Namhong for recent remarks in and to the media about witness testimony in Case 002, which the lawyers consider wilful interference with justice and “chutzpah indeed”.
On July 31, witness Rochoem Tun testified under oath that Namhong “was in charge of the Boeng Trabek detention centre”, a statement he later recanted in local media reports.
The ruling Cambodian People’s Party minister issued a public statement on August 2 in which he criticised unnamed persons for trying “to deflect attention from themselves and their cases, by way of stirring up controversy around public figures like myself”.
In the filing, Nuon Chea’s lawyers frame Namhong’s remarks as an attempt to unduly interfere with justice and request a public condemnation of Namhong’s actions as well as a warning that future actions would be met with strict reprimand.

Nuon Chea’s defence team will file a complaint to the Khmer Rouge tribunal this week, alleging that Minister of Foreign Affairs Hor Namhong’s comments published at his insistence in the Post last week amounted to government interference, the defence announced yesterday.
In the letter, which ran in the August 3 edition, the minister hit back at witness testimony last week that alleged that he was in charge of Boeng Trabek detention centre by stating, without refuting the testimony, that he was a prisoner there, and lambasted the defence for “stirring up controversy around public figures like myself”.
The letter ended: “My greatest hope is that one day justice is done and the legacy of the Khmer Rouge is given its proper place in the dustbin of history—without defence or controversy.”
The attempt by Nuon Chea’s defence counsel, Jasper Pauw, to explain the complaint abruptly ended when the court president shut off his microphone.

Brother No 2 Nuon Chea’s defence lawyers had exhibited a “pattern of disregard” for their duties at the Khmer Rouge tribunal amounting to professional misconduct, Trial Chamber judges said in a decision on Friday.
The judges had compiled enough “egregious examples of misconduct” by Dutch lawyer Michiel Pestman and American lawyer Andrew Ianuzzi to refer to the bar associations in Amsterdam and New York respectively for “appropriate action”.
Both lawyers are now working on the case from abroad.
Particularly “egregious” acts include Ianuzzi’s reference to Dr Dre lyrics when filing a motion for New Zealand Judge Silvia Cartwright to keep all her responses open and on the record after she was allegedly caught by the team mouthing the words “blah blah blah” while they were making submissions.

Foreigners working at the Khmer Rouge tribunal were responsible for embroiling the court in chaos that was akin to incitement, government officials said yesterday at a snap news conference.
Press and Quick Reaction Unit deputy president Keo Remy called the conference to attack criticisms of alleged public statements by Prime Minister Hun Sen about the guilt of one of the tribunal’s three elderly accused, who are being tried for crimes against humanity and war crimes.
“There is nothing wrong in expressing that Nuon Chea is a killer and was involved in genocide during the Pol Pot regime,” Keo Remy told about 10 journalists.
“[Nuon Chea defence lawyer Michiel Pestman] is taking the opportunity to bring in political issues at the KR tribunal to cause chaos,” he said, adding: “I found that the chaos was always made by some foreigners [at the tribunal].

Ongoing tension between the Khmer Rouge tribunal trial judges and defence counsel for Brother No 2 Nuon Chea erupted yesterday, with the former Khmer Rouge ideologue’s counsel accusing Trial Chamber president Nil Nonn of rude and inappropriate behaviour.
Dutch lawyer Michiel Pestman addressed Nil Nonn before substantive proceedings began and accused him of using the Khmer words neak eng (អ្នក ឯង) to refer to Pestman during court.
“I understand the language is inappropriate, if not rude, and could be misinterpreted as intimidating not just me, but also my client,” Pestman said, adding that Nil Nonn used the word 12 times in court last Wednesday to refer to him. “It further undermines the integrity of the court and could give the impression of bias.”
Nil Nonn thanked Pestman for his “observation” before turning to the prosecution, who were introducing a selection of documents to the open court.
Cambodian legal expert Sok Sam Oeun agreed use of the Khmer word neak eng in court is impolite and could give an impression of bias, but added that it is not unfamiliar in the Kingdom’s courtrooms. “I think the judge should set a good example for the Cambodian courts,” Sok Sam Oeun said. “Local court judges commonly use this word – and much worse!”

Despite repeated attempts by Brother No 2 Nuon Chea’s defence lawyers to prove the Khmer Rouge tribunal may be relying on biased documents from the Documentation Centre of Cambodia, lawyers were rebuffed by the Trial Chamber at nearly every turn yesterday, creating a delicate legal dance that seemed to end only in futility for the defence.
“I’ll now conclude my part of the questioning, because there are too many questions I want to ask that I can’t because of your concerns,” Nuon Chea’s co-defence lawyer Jasper Pauw quipped to the Trial Chamber, after more than three hours of questioning DC-CAM director Youk Chhang, who he referred to as “the most important gatekeeper of all evidence”.
During Youk Chhang’s last day on the stand, Pauw attempted to raise concerns about the impartiality of DC-Cam’s records, which he said were a core part of the case against his client.

A lawyer for former Khmer Rouge Brother No 2 Nuon Chea yesterday named two suspects in the court’s fourth case while cross-examining a witness in Case 002, prompting the Trial Chamber to order him to suspend his line of questioning.
Michiel Pestman, co-defence counsel for Nuon Chea, asked 67-year-old former district secretary Prak Yut about previous testimony in which she named fellow former members of the “Sector 35 committee” in Kampot province.
Prak Yut repeated some of the names, stating that one among them was still alive, before then testifying that all the members had died.

The political objection to cases 003 and 004 have been an ongoing issue for the court.
Judges at the Khmer Rouge tribunal cut short questioning by a defense attorney of a witness at the court who sought to mention confidential suspects in another case.
Michiel Pestman, defense for jailed leader Nuon Chea, began a line of questioning about former leaders Ta An and Im Chaem, two suspects the court has kept confidential despite repeated press mentions in Case 004.
Nil Nonn, head judge of the Trial Chamber, stopped him and reminded him to keep his questions limited to the case at hand—No. 002.

The Trial Chamber’s decision to reject defence counsel’s petitions to have New Zealand Judge Silvia Cartwright removed and investigated was published by the Khmer Rouge tribunal yesterday.
In a decision dated December 2, the Trial Chamber dismissed defence motions to have Cartwright investigated and permanently disqualified due to a perception of “bias” stemming from ex parte meetings between Cartwright, international co-prosecutor Andrew Cayley and the deputy director of administration at the tribunal.
Nuon Chea’s defence counsel believed these meetings gave the appearance of “bias” by Cartwright towards Cayley and his office.

Lawyers for two Khmer Rouge leaders accused of genocide in Cambodia have demanded that former New Zealand Governor-General Dame Silvia Cartwright be stood down as a trial judge.
They accuse Dame Silvia - New Zealand's first woman High Court judge before she was appointed to Government House - of having secret meetings with prosecution staff over the past year, a Phnom Penh news site reported.
But Nil Nonn, president of the special international court, has rejected the lawyers' request, saying the issue will be addressed "in due course''.

Legal counsel for “Brother Number 2” Nuon Chea yesterday told Phnom Penh Municipal Court deputy prosecutor Sok Roeun they did not trust him, did not believe him, and were of the view that he was receiving instructions from suspects in their recently filed criminal complaint, which includes Prime Minister Hun Sen.
The premier, along with 13 other high-ranking government officials, has been accused by lawyers Michiel Pestman and Andrew Ianuzzi of contriving a common criminal plan of interference in the Khmer Rouge tribunal.
Pestman and Ianuzzi were summoned by the municipal court’s deputy prosecutor, Sok Roeun, for quest-ioning yesterday, after filing a complaint last Monday requesting a judicial investigation into the actions of a group of high-powered officials that includes Senate president Chea Sim and National Assembly president Heng Samrin.
