Fugitive cop applies for court order to stay his deportation

KUALA LUMPUR: Former Cambodian police chief Heng Pov has applied to the High Court here to stop the authorities from deporting him to his country.

He filed an application to get an interim order from the High Court here for a stay of the deportation.

The fugitive cop, whose name was stated as Heng Peo in his application, is also attempting to get a habeas corpus (wrongful detention) order from the court.

High Court Justice Abdul Kadir Musa, who met his lawyer Nik Mohamed Ikhwan Nik Mahamud in his chambers, will hear the matter today.

Heng Pov, who has been on the run since August, was arrested for overstaying at a luxury hotel in Subang Jaya on Tuesday. He is wanted in Cambodia in connection with two assassinations and three attempted murders.

He entered Singapore on July 23, was arrested on Sept 1 for overstaying and was deported on the same day to Malaysia.

Heng Pov filed an affidavit-in-support of his application through law firm Chooi & Company at the High Court (criminal) registry at 11.43am yesterday.

He named the Inspector-General of Police, Immigration Department director-general, Internal Security Minister and the Malaysian Government as respondents in his application.

In the affidavit that was affirmed by his wife Ngin Fotheavy, who is under the asylum of the United Nations High Commissioner for Refugees (UNHCR), Heng Pov claimed that he had entered Malaysia on Sept 1 using his diplomatic passport and that his entry permit had expired on Sept 30.

He claimed that his main reason for entering Malaysia was to seek asylum.

Heng Pov said he was also in the midst of consulting with several foreign countries to seek asylum on a permanent basis.
