Cambodian seeks to stop deportation
New Straits Times (Malaysia)
KUALA LUMPUR: Former Cambodian police chief Heng Pov yesterday filed an application of habeas corpus (wrongful detention) at the High Court here.
He is also seeking an order to prevent the government from deporting him to Cambodia.
Heng Pov, who was also a former adviser to Cambodian Prime Minister Hun Sen, was arrested on Tuesday at an undisclosed location in the Klang Valley for overstaying in the country.
In his application, he named the Inspector-General of Police, the director-general of the Immigration Department, the Internal Security Minister and the government as respondents.
Counsel Nik Mohd Ikhwan Nik Mahamud, who represented Heng Pov, said the court could not hear the application immediately or grant an interim order preventing Heng Pov from being deported.
Judge Datuk Abdul Kadir Musa will hear the application today.
"He is seeking asylum in this country and there is a real risk that he may be tortured and killed if he is deported," Nik Mohd Ikhwan said.
"We have also asked the ministry to extend his stay until another country agrees to accept his diplomatic asylum application."
Meanwhile, Inspector-General of Police Tan Sri Musa Hassan said police were preparing to extradite Heng Pov.
He is also seeking an order to prevent the government from deporting him to Cambodia.
