Nhiek Bun Chhay, Funcinpec secretary-general, sent a complaint to the Phnom Penh municipal court to sue the editor of the Samleng Yuveakchun Khmer (Voice of Khmer Youth) newspaper – which currently supports the NRP – for defamation because the newspaper published articles which affect his honor and reputation, and also those of the Funcinpec party. The articles brought up Nhiek Bun Chhay are (1) titled as “ Nhiek Bun Chhay involved in the investigation of drug in Kompong Speu”, and (2) titled as “ Where is Chea Chung, the leader of the drug production?” In his lawsuit, Nhiek Bun Chhay refutes the information published by the newspaper, and he accuses them of being untrue and constitutes defamation. He requested the court to sentence the newspaper. Keo Sothea, the newspaper editor, told the Rasmei Kampuchea newspaper that he did not know about this lawsuit yet, however, he said that whatever he published was not slander against Nhiek Bun Chhay. He said that he receive information from various sources which provide these information.

Cambodian are being scared by defamation proceeding by powerfull individuals. Each time, they made mistake or committed any crimes, they have thread other for defamation. In reality, they don't understand at all what is defamation means.
Who has the fame? Who is famous?
As I have said before. If they are a Doctor, a professional, a businessman, An artist, an author or a movie star or a singer star or a comidian etc.. and etc.. They have now earn a lot of monies through their fame because they are very famous. But if you have committed anything to damage their fame and will impact their potential to earn monies, they can use their evidences of much they have lost through your actvities their potential income, then you are liable to pay compensation through the court defamation.
All politicians are not being protected by this defamation rules because their decisions have impacted to other people lives. Only the King has been protected by the constitution. Government officials can also be protected their private life by defamation because their job and position can be at risk by untrue stories. But if they are being alleged of criminals actvities, they must be asked to suspend from their position while full investigation are underway. If they found to be committed with criminal actvities, they must be sentenced through court. With the case of Nhek Bun Chhay, he cannot sue the New Papers yet until he can prove to the court that he is an innocense first. If the court said that he is innocense, then he can take the New papers to court for his damage but not defamation. What are his damages? All his salary lost during his allegations, his legal costs, his traumas and stress. His family problem caused by fault allegations. He cannot claim for defamation because Nhek Bun Chhay is not a famous individual.
Go to ask Mr. Te Bunthy (012899755), vice gorvenor of Phnom Penh's Chamkarmon district, a brother of Mr Chea Chung, then he will tell you that Mr Nhek Bunchey ordered his brother (Mr Chea Chung) to do all the drug trade. Mr. Bunchey took Chea Chung to hide in a place along Cambodian-Thai border. However, Mr Chea Chung is fear that Mr Bunchey may kill him. So now he escaped from Bunchay's radar. Bunchay is very worry that one day Chea Chung may be arrested or comes out to confess to the police. Bunchay is the owner and the mastermind of the drug producing factory in Kompong Speur.
