The Special Representative of the Secretary-General for human rights in Cambodia, Mr. Yash Ghai, concludes his third official visit to Cambodia

The Special Representative of the Secretary-General for human rights in Cambodia, Mr. Yash Ghai, concludes his third official visit to Cambodia

The Special Representative of the Secretary-General for human rights in Cambodia, Yash Ghai, issued the following statement today:

Phnom Penh 31 May 2007 - The Special Representative of the Secretary-General for human rights in Cambodia, Yash Ghai, conducted his third official visit to Cambodia from 29 to 31 May 2007. The main objective of the visit was for the Special Representative to get feedback on his latest report to the United Nations Human Rights Council and to update himself on the human rights situation in the country. In this regard, he very much appreciated the opportunity to meet and discuss with H.E. Deputy Prime Minister Sar Kheng during his visit. However, he regrets that none of the other senior government officials he had hoped to meet were available to see him. While in Phnom Penh, Mr. Ghai had fruitful discussions with representatives of civil society, political parties, the National Election Commission, United Nations agencies and the diplomatic community.

The Special Representative welcomes the imminent adoption of the Code of Penal Procedure, after many years of preparation. He hopes that the Code will overcome many of the problems that have dogged the Cambodian justice system and the Government will give priority to its implementation.

Impunity for human rights violations continues to pose a threat to the rule of law in Cambodia. The Special Representative again expresses deep regret over the decision by the Appeal Court on 12 April 2007 to uphold, despite strong exculpatory evidence, the conviction of Born Samnang and Sok Sam Ouen, who in 2005 were sentenced by the Phnom Penh Municipal Court, following fundamentally flawed proceedings, to 20 years imprisonment for the murder of trade union leader Chea Vichea in January 2004. The upholding of these sentences is a grave injustice and the Special Representative reiterates his calls for a thorough, impartial and credible investigation into the murder of Chea Vichea, and for the prosecution of those responsible. He also supports the appeals for a Royal Pardon for Born Samnang and Sok Sam Ouen.

The Special Representative notes with alarm the continuation of attacks and intimidation against members of the workers' movement in the course of the last year. Serious restrictions have been placed, illegally, on their right to assemble and carry out their responsibilities. He is appalled at the assassination of trade union leader Hy Vuthy on 24 February 2007. There must be no impunity for the murderer this time.

While welcoming Cambodia's economic growth, he warns that human rights and equity must not be sacrificed in the pursuit of growth. He will shortly release a report presenting a human rights perspective on economic land concessions. The report shows that economic land concessions, as presently granted, have compromised and destroyed the livelihoods of rural communities in favour of the enrichment of a few connected to the political establishment. He is deeply concerned about the continuing alienation of indigenous land through 'land grabbing', illegal or coercive sales, and the grant of concessions, including mining licenses.

The Special Representative looks forward to the speedy adoption of the Internal Rules for the Extraordinary Chambers in the Courts of Cambodia (ECCC), and welcomes the agreement reached on the question of international defence counsel. He wishes to emphasize the importance of independent international monitoring of the trials and the responsibility of any monitor to bring matters of concern to public attention. In the interest of maintaining the integrity of the trial process, he endorses the calls for a thorough and transparent investigation of the allegations regarding irregular hiring practices at the ECCC.

The Special Representative is pleased to note that the commune council elections on 1 April were conducted in an atmosphere marked by less violence, threats and confrontation than in previous elections. He welcomes the assurance of the National Election Commission that the reasons for the drop in voter turn out will be investigated and every effort will be made to ensure that all those who wish to vote in next year's general elections will have full opportunity to register and cast their votes, and that political parties will be able to conduct their campaigns fairly and freely.

Your focus seems to target only Yash Ghai's professional backfround prior to his appointment as UN Secretary-General's Special Representative for Human Rights in Cambodia. By doing so, you'll intentionally omit all efforts made by Yash Ghai in his current position to improve human rights record of Cambodia since this country adopts according to the will of the overwhelming majority of Khmer people a free market economy, liberal democracy and pluralism after the signing on October 23, 1991 of the Paris Peace Accords and the last three general elections ensued. Why Paris Peace Accords? Because Cambodia was torn to shreds by more than 30 years of civil wars. Why free market economy, liberal democracy and pluralism? Because since its independence on November 11, 1953, Cambodia and her people never had a taste of real democracy. And why all reports by Michael Kirby, Hammaberg, Peter Leuprecht and Yash Ghai are needed? Because the Paris Peace Accords required that the UN play a major role in following up and closely monitoring as well as evaluating all kinds of progress in Cambodia whether they be economic, environmental, cultural and social. Social progress, in particular, can never be advanced without vigorously tackling the human rights issues.

Your support for the Government for its good deeds should not be criticised. But your unreserved support for both good and bad deeds done by the current government is unacceptable. Why? Because millions of Khmer people affected by the govenment's bad deeds such as corruption, deforestation resulted from illegal logging and non-transparent land concessions, land grabbing, selling of State assets, mistreatment, drug and/or human trafficking, persecution, rights abuses and arbitrary killings will feel victimised or unjustly dealt with by your support for the government's bad deeds.

What are you going to say to all those victims? Maybe you'll say nothing because you belong to the priviledged few.

8:36, Ah Chkout (Ghai) was mad,
corrupted, and incompetent in the
recent past to solve problem, and
clearly he haven't changed. So
how can we resolve any problem
with Ah Chkout? If he had improved,
then I would agree with you.

I never once claimed that cambodia
doesn't have problem, but cambodia
problem is mainly due to poverty
and lack of jobs among others.
I don't see anything unordinary
here. Can we fix the internal
problem? yes, but not overnight
because our prison is not big
enough to hold 10-15% of the
population who failed temptation.

Thus, Cambodia problem is much
more complex to solve than most
people think, and the government,
who know Khmer better than anyone,
had done their best to solve it,
and it will take time before we
will see any appreciable result.
It is extremely risky to try
to fix all problems overnight.
However, we'll always open to
any expert who can help to solve
the internal problem, but Ah Skout
has know relevant experiences to
solve this type of problem, not
to mention you need to work
bilateraly with the government if
you are to have a chance to solve
this problem. All Ah Chkout can
do is see the problem but he can't
solve it realistically. This is
not a text book case. There are lot
at stake.

Alright, to be fair about this,
let's take a land grabbing issues
that committed by some of your
own generals for instant. If you
were a Premier, how would you
tackle it?

We are Cambodian people would like to express deep sincere thanks and gratefulness to Yash Ghai who come to spread prosperity in Cambodia and to care as well as to protect our weak people from pandemic violation and oppression of the powerful individuals.

We cannot imagine how worse it is if we don't have UN, International Community as well as your spectacular mission to Cambodia. If we don't have your intervention, those powerful individuals of Cambodia will intentionally continue to oppress, suck and exploit the poor and weak Cambodian citizens severely.

The report that you have released in here is fair and accurate to the present situation of Cambodia. The current Cambodian government should express gratefulness and thanks to your report rather than outraging or hate with productive research. Your report is only tending to help government to have capacity in overviewing all those bad issues. Accepting this and deal with it immediately will assure the credibility and advantage of their executive implementation.

These following reports are really critical in Cambodia:
- The continuation of the culture of impunity
- The immediate release of Samang and Som Ouen to ensure the national law.
- Freedom of expression and demonstration
- Work union's activists
- Unusual land concessions
- Unusual mining licensing
- Land grabbing by high rank officials and business tycoons
- Procrastinating of KR trials

It is really intellectual to say from your word "Impunity for human rights violations continues to pose a threat to the rule of law in Cambodia." and "While welcoming Cambodia's economic growth, he warns that human rights and equity must not be sacrificed in the pursuit of growth."

appreciate virtual good deeds,

appreciate real good deeds.

Futhermore, Khmer people would
never wanted people with virtual
experiences like Ah Sam Nazi to
lead our country. Thus, I suggest

Please forgive my ignorance, but I cannot bear to ask that how could one complete a fact finding mission on a country in 3 days?
I am no pro Hun Sen, no pro human rights either. Nevertheless, please do not take Cambodia as a guinea-pig and make it as a joke in your lousy work...
I trust that the UN should hold good ethics in its professional duty...
