Yash Ghai Will Raise the Issue of Lawlessness in Cambodia

UN human rights special envoy to Cambodia, Mr. Yash Ghai, planned to raise the issue of lawlessness in Cambodia in a meeting of the International Human Rights Council which will be convened in Geneva, Switzerland, on 19th of March 2008. Mr. Ghai’s plan came in the form of an email interview with Radio Free Asia.

The UN envoy said that he planned to release a detailed report to the meeting on 19th of March. Those important issues which he planned to reveal to the meeting includes the absence of the rule of law in Cambodia and the impacts resulting from such failures.

He further said that he regrets the fact that the Cambodian prime minister, Mr. Hun Sen, had constantly attacked him but he understands that he is not the only one who is constantly attacked by Mr. Hun Sen.

Mr. Yash Ghai said that he received good co-operations from local non-governmental organisations regarding the issues of human rights and he would like to discuss those human rights issues with the government officials as well.

The government spokesman, Mr. Khieu Kanharith, refused to make any comments regarding this issue because he is too busy.

But in December 2007 Prime Minister Hun Sen has strongly attacked Mr. Yash Ghai. Mr. Hun Sen said: “This long-term tourist whom I don’t need to mention his name. And please come back again but Hun Sen has the right not to receive him. If Secretary-General Ban Ki-moon wants to continue to use such a person, I don’t care.”

Mrs Pung Chiv Kek, president of the human rights organisation LICADHO said that the issue of the rule of law which Mr. Yash Ghai planned to raise in the upcoming meeting is important. She said: “if there is no rule of law in our country, anyone can do what they like.”

Mrs. Pung Chiv Kek further revealed that she and Mr. Thun Saray of ADHOC human rights organisation plan to travel to attend the meeting of the International Human Rights Council in Geneva as well. She will insist that the International Human Rights Council and the United Nations continue the mandate of the United Nations Human Rights Office in Cambodia because the Cambodian people need such office in Cambodia.

Mr. Yash Ghai visited Cambodia in December of 2007 to examine and evaluate the human rights situation in Cambodia, but Prime Minister Hun Sen and other government officials refused to talk to him.

Mr. Yash Ghai, on Tuesday, said through his email that he plan to visit Cambodia again in May or August of 2008.

the rule of law in cambodia is absence. lawlessness and abuses are widespread. it is a shame that it takes a great effort from foreigners and the international community to teach cambodian leaders how to respect laws and human rights. it seemed that foreigners care more about cambodia than the present cambodian leaders do.

Hun Sen and his blood-sucking parasites' CPP contemptuously and consistently try to cover a gigiantic death elephant of the rotten corruption with a tiny basket. Therefore, if the Cambodian people don't envisionally complain about it, why should be Mr. Yash Ghai? In order to look more innocent human beings, CPP and Hun Sen must be persistently attacked him, otherwise their stable jobs might be literally gone pretty soon!

CORRECTION:

The English phrase for the Khmer phrase "khmean nitiroth" should be "absence of the rule of law".

Lawlessness is commonly understood as anarchy, a situation in which there is no law and order. This is not what Prof. Yash Ghai meant.

In theory, Cambodia is governed by the rule of law, but in practice it is governed by the rule of men. The government that rules a country which is governed by the rule of law is called the government of laws. The government that rules a country governmend by the rule of men is called the government of men. Government of men is also called dictatorship.

A government of men can rule its country by laws, but these laws are not universal, not equally enforceible, whether they punish or protect, to the rulers and the ruled alike. They are most of the times made to promote and protect the interests of the ruling elite and therefore are unjust.

A country governed by the government of men is not necessarily a lawless country. It can and does have laws. Democratic Kampuchea had at least a written constitution.

Perhaps Buddha was also living in a dream world when he could have ruled his country and enjoyed power and riches.

It is a pity our nation does not encourage its people to have dreams and stand up for ideals, big or small!

Dr. Lao, Anyone can say and wish for anything, but whether or not mother-nature is willing to follow our beautiful words or grant us our wishes is a different story.

Stop living in denial, will ya? The truth is poor people will always be at the mercy of the rich everywhere, and only good moral can save them, not any law or system. Most people who make law are the riches, and they not going to make any law against themselves.

Thus, if you overshadowing our good moral with your law that is made by the riches, Dr. Lao, you are not helping us much, but to put us into deeper risk.
