David Meas And Hor Namhong Threatened To Sue Khmerization

After threatening to sue Sacrava for drawing political satirical caricatures of Mr. Hor Namhong, Mr. David Meas, presumably under instructions from Mr. Hor Namhong, is threatening to sue Khmerization. Khmerization believes that this kind of litigation threat is an intimidation against Khmerization into silence and an infringement on Khmerization's freedom of speech. The articles published at Khmerization are published and posted at The Cambodia Daily website, The Phnom Penh Post website, Everyday.com.kh website etc. Unless David Meas and Hor Namhong can successfully intimidate these websites to remove the articles in question from their sites, Khmerization has no obligation to remove them from this site. Also, I wish to inform Mr. David Meas that I have no obligation to elect any lawyer to represent me in this matter as has been requested by you. And thank you Mr. David Meas and Mr. Hor Namhong for giving this blog prominence.
The following is a letter from Mr. David Meas to Khmerization:

Dear Sirs,

I am acting as French counsel for Foreign Minister of Cambodia, Mr. Hor Namhong.

I have noted that on your web site, named Khmerization.blogpost.com, the following articles are advertised, namely:

- “Hor Namhong , his wife and his son were chiefs of Boeng Trabek prison” (May 4, 2008);

- “Hor Namhong vs. Sam Rainsy, Defamation vs. Crimes against Humanity?” (May 6, 2008);

- "Sam Rainsy plans to sue Hor Namhong" (May 5, 2008);

- “Let’s Battle it out: The Defamation Case of Hor Namhong vs. Sam Rainsy” (April 18, 2008).

The content of those articles could be sanctioned by a court of law, as being in particular libelous, slanderous and defamatory for Mr. Hor Namhong.

In this respect, I draw your attention to the fact that in a 1991 judgement, the Paris courts ruled that similar allegations were defamatory for Mr. Hor Namhong.

Therefore I put you on notice, on behalf of Mr. Hor Namhong, to immediately take all measures so that those articles, and other articles which would be in the same vein, be deleted from your web site.

Mr. Hor Namhong obviously reserves all his rights against you and any other participants or contributors to this matter. Please indicate me the name of your attorney-at-law in this matter.

it is a nice template. Mr. David Meas should make many copies of the same template and send each to individual who (posted article)discuss about the former chief of Boeng Trobaek prison.

PM Hun Sen usually says "Meas sot min klach ploeng". what is the problem here? People say what the record stated and what he himself confessed. be cool and be strong like PM Hun Sen. if it is neccessary, go all the way to Khmer Rough Trial in order to clear up your name, which is what you should do, not forbid media from broadcasting your record.

ah Hor Nam Hong must be in jail with Noun Chea, Ieng Sary, Khieu Samphan in KR tribunal because ah Hor Nam Hong was the chief of Boeng Tra Baek prison during Khmer Rouge regime (1975-1979).

11:32AM,if you find out about the backgrounds of this "attorney-at-law" please don't forget to share it with us here in ki.media. He said he graduated from a law school of Colombia University. Could someone check with Colombia University to find out if he really got his "degree" or diploma from there. By the way he writes a letter it doesn't seem like he is a lawyer because the level of English is so simple.

Well, the 'attorney' is French, so his English might be a little inadequate. Second, this is a 'cease and desist' letter. Anybody can write this. If he indeed is Hor Nam Hong's counsel he could sue anybody for libel/slander if that person accused him of acts he did not commit based on the French judgment. Khmerization called him a 'perpetrator of crimes' in an editorial. This is not covered by freedom of speech. Khmerization is not an accredited news organization, so freedom of press does not apply either. If he only quoted other people or news media, he can't be touched but an allegation is dicey. This is what courts are for.
Everybody might think that the identity of Khmerization would be a problem. But if that attorney is serious about this, he can sue Khmerization in an Australian court, I believe, Sydney would be the venue. Once he filed his papers there he can subpoena Google to locate Khmerizations IP-address and from there it is very simple to get a name and an address. In Australia this would be a civil matter, but could still entail a stiff fine. Hor Nam Hong certainly has the money to pursue this if he wants to. It is doubtful whether Khmerization has the money to defend himself. Don't anybody forget that the anonymity of these blogs and forums is no safeguard against legal action.

Many lawyers in the US write old fashion (slang) English but what the hect this guy is so pissed with the Lawyers' English?
He needs to learn to understand the laws how much freedom he can have going around vomitting on other people reputations. I don't defend Hor Nam Hong but I think Khmers get to learn to be civilized instead of being stupid.

If people want to defy David Meas and Hor Namhong, they can create 1,000 or 10,000 or 1,000,000 blogs that carries the same subjects about Hor Namhong, then let him sue 1,000,000 people in the world and see if Hor Namhong have the resource to sue everybody.

Therefore your scare tactics does not make sense in this day and age.

David Meas do a lot more damage for Hor Nam Hong by bullying the related press around the world. This inturn will force more witnesses to come forward. More evidents collectively will be found. Threatening the media is another nail to Hor Nam Hong's coffin. You can get away with it in Cambodia where the judicial branch is not independant and can be gaged by the sign of the $$$. To your part David Meas, your unproffessional conduct telling us alot about you and your capacity in law. Can't Hor Nam Hong afford a real lawyer? Shonky lawyers does not serve the interest of their clients. David Meas is bluffer looking to make a buck, which i can understand where he is comming from. For Hor Nam Hong, he will be surely losing the case if it were to be conducted outside Cambodia. This will seeing him in jail for both, the alleged crime and for theatening the medias. The more threatening letter he sent, the more charges will be laid against him if found guilty.

What you have said is true. For instant, an activist in Chaina was behind bar, when the Chinese Government pressured Yahoo to provide IP-adress of the person and Yahoo felt that they must oblige under the term and condition under the business agreement between Yahoo and China, to release the name of user.


In Australia this would be a civil matter, but could still entail a stiff fine. Hor Nam Hong certainly has the money to pursue this if he wants to. It is doubtful whether Khmerization has the money to defend himself.

Do agree that H.E Hor Nam Hong certainly has the money to pursue this if he wants to. However, if Khmerization doesn't have the money to hire a lawyer, should there'd be a lawsuit, then the Australian court oblige to appoint him a lwayer and in this case may be an asttue lawyer from the Legal Aide - is free of charge to Khmerization but out from the national coffer - Australian taxpayers.

But if that attorney is serious about this, he can sue Khmerization in an Australian court, I believe, Sydney would be the venue.

Don't believe that Khmerization is living in Sydney, and therefore can't see that Sydney court would extradite anyone from interstate to face court in Sydney.

One possible way for H.E's lawyer to do is through dimplomatic channel - Australian Embassy, however, whether the Ambassador or realted authority based at the embassy would think it is appropriate for them to involve in the case.

The letter has no substance. Indeed as said "cease and desist letter" Infact the law does not prohibit anyone from sueing the world at large. Win or lose is another matter. Next time if you are looking to sue someone for fun, don't hesitate. There are no proviso.

Could anyone check David Meas' qualification? Previously in ki-media he claimed that he received his degree from Colombia University, but in his website he claimed that he received his qualification from University of Paris. We can check his records from these universities.
