Thai World Heritage panel chief expects positive response to plea

Thailand will ask Unesco to delay a decision on Cambodia's proposal to list Preah Vihear temple as a World Heritage Site, said Pongpol Adireksarn, head of Thailand's World Heritage Committee.

His statement followed the Central Administrative Court injunction on Saturday against the Thai government supporting Cambodia's bid.

The court said the position taken by the government "might undermine Thailand's future standing on the territorial dispute". The government communique gave Cambodia's bid "active support", the ruling said.

The Unesco World Heritage Committee is meeting from Wednesday till July 10 in Quebec, Canada.

Pongpol cited Unesco's Article 11, Item 3, which states that listing of World Heritage sites that straddle two countries' territories cannot be done without endorsement from both sides.

He expected the committee would respond positively to the appeal.

Pongpol said the proposal to Unesco to list Preah Vihear should be submitted jointly by both countries, which is similar to the position Thailand took on the issue last year. He said he would seek Cambodia's cooperation at the Quebec meeting.

"This temple should unite instead of divide us. This is why we are suggesting a joint application," Pongpol said.

Pongpol said the temple should be a major tourist attraction for both countries. "If there is conflict, no tourists will come to visit because they fear danger," he added. "We can both take care of the temples and of the tourists."

Separately, Foreign Ministry permanent secretary Veerasak Futrakul dismissed growing fears that the court injunction would send Thai-Cambodian ties into a tailspin.

Speaking to reporters after meeting Cambodian Ambassador to Thailand Ung Sean, he said bilateral ties had not been affected by the court's order and Phnom Penh considered the ruling, as well the raising of the issue during last week's no-confidence debate in Parliament, as Thailand's domestic matter.

Embattled Foreign Minister Noppadon Pattama remained tight-lipped over the ministry's next move, saying more time was needed to assess the situation in light of the injunction.

The director-general of the ministry's Legal Affairs Department, Krit Kraijitti, did not rule out appealing the injection.

Suwat Apaipak, a member of the legal team that succeeded in getting the court to overturn a June 17 Cabinet decision, urged Noppadon to inform Cambodia and the UN cultural body that Thailand could no longer support the listing bid.

The injunction has proved to be a major political embarrassment for the government. A clearer response should be revealed on Tuesday following the weekly Cabinet meeting, where the issue is expected to be high on the agenda.

Despite the government's insistence that the joint communique calling for the listing of Preah Vihear had no bearing on territorial claims by the two countries, Pongpol said the next move would have to come from the Cabinet.

His predecessor on the committee, Adul Wichiancharoen, said the earlier call for Thailand and Cambodia to jointly apply for the Unesco status was a way to depoliticise the thorny issues of territorial dispute and sovereignty.

Pipob Thongchai, a member of the anti-government People's Alliance for Democracy, said Noppadon should show responsibility by resigning from his Cabinet post.

Thailand is destroying the reputation from the world. Any country will sign treaty with them again? It shows the lack of responsibility and the weakness of the application of the convention on international treaty on part of Thailand. Thailand can change their constitution and treaty easily just just using the ruling of administrative course to nullify any treaty signed by the government

In the ICJ operative provisions of the judgment of 15 June 1962, the Court accepted Thai rebuttal Submissions 1 and partially 2. The Court found/ruled that:


1. "the Temple of Preah Vihear is situated in territory under the sovereignty of Cambodia;"[Cambodia's Submission 3]


2. "Thailand is under an obligation to withdraw any military or police forces, or other guards or keepers, stationed by her at the Temple, or in its vicinity on Cambodian territory"; [Cambodia's Submission 4]

to say that both people in the area depended on the tourists' dollars for their livelihood is one thing, but to want to steal preah vihear from cambodia is another whole issue to itself, isn't it? this is why the world has an international court of justice to prevent this kind of illegal and criminal intention of thailand on cambodia, isn't it right? so, keep on showing contempt of court and thailand and your siem people will soon lose all confident vote by cambodia and the entire world community of nations.

bottome line is thailand can not change or want to do whatever they feel like to cambodia, a legitimate, sovereigned member of nations of the world, and whether you sisagree with the treaties, the icj and so on, is very irrelevant in the court of laws of the international court of justice, not your self-serving, self-interest court of thailand or whatever! so there!

9:35AM: No one had let Ah Siamese to sit at the table, but they, Ah Siamese just invaded univited, alright? Not just recently had the PNH gvn't tried to get PVH temple listed, but since 2001.
For this application, we get the body of temple listed or we will wait longer, u get the picture? Wot's more, it'd be troublesome, technically, in decarmation. So, wot i'd like to answer your question is it is a wise move, we get the temple listed first and still not lose the territory, and will sort the border later.

Tribunal Khmers Rouges : un documentaire filmé pour l’Histoire

Les réalisateurs et documentaristes Jean Reynaud et Rémi Lainé ont été “choisis” par les CETC (Tribunal Khmers Rouges) pour réaliser un exclusif documentaire filmé racontant tous les étapes, procès et processus d’investigations de tribunal.

” Il n’y a pas d’histoire d’argent. Personne de paie personne. Les réalisateurs conservent leurs droits commerciaux et le tribunal fait son travail de communiquer son action auprès du public…” déclare le porte-parole.

Ils ont l’accès jusqu’aux coulisses normalement interdites à la presse par des raisons de secret d’instruction. Cependant, la réalisation et le film final seront “sousmis au contrôle permanent du service de communication et des juges veillant au respect des accusés, des témoins et de la valeur pédagogique…”

Le documentaire sera diffusé au public — “pour la pédagogie et pour l’Histoire — lorsque seront terminés tous les procès, y compris, les appels (certainement nombreux !)

Tribunal Khmers Rouges : une première reconstitution prévue les 26 et 27 février (MAJ#2)

L’un des porte-parole du tribunal, Reach Sambath, après la première journée de reconstitution des “scènes de crime” à Choeung Ek, le “champ de la mort”, raconte à la presse (interdite de présence) comment l’inculpé “Duch” a pleuré à deux reprises, a prié aussi devant “les ossements des victimes et l’arbre sur lequel les Khmers rouges avaient fracassé la tête des enfants…”

Remords tardifs ? Premier sursaut de l’humanité ?

Tribunal Khmers Rouges : une première reconstitution prévue les 26 et 27 février (MAJ)

Duch est présent à la reconstitution accompagné de ses avocats. Egalement présents : co-juges d’instruction, parties civiles et témoins. La presse et le public n’ont pas été autorisés à suivre l’événement.

Chaque partie participante apporte des preuves matérielles (photos, documents écrits,…) et d’éléments d’explication en dessin, modélisation informatique, etc. Les preuves seront confrontées. Des opérateurs vidéo filment la reconstitution. Le film sera versé au dossier lors de l’ouverture du procès de Duch prévu en juillet 2008.

Tribunal Khmers Rouges : une première reconstitution prévue les 26 et 27 février

Une reconstitution — “de la scène du crime” — sera organisée le mardi 26 février à Choeung Ek et le mercredi 27 février à Tuol Sleng. Le tribunal ne communique pas sur les noms des accusés, parmi les cinq en détention provisoire, qui seraient transportés sur les lieux. Cette reconstitution concerne sans aucun doute Duch, l’ancien directeur du centre pénitencier S21 de Tuol Sleng. Son procès est prévu en juillet 2008.

Cambodge - Khmer Rouge : Duch contre sa détention

La première instance du Tribunal Khmer Rouge examine l’appel contre la détention provisoire déposé par Kaing Guek Eav (Duch) aujourd’hui à 14h, heure Phnom Penh. Le prévenu estime d’avoir déjà passé plusieurs années en prison, “une durée trop longue en contrevenant aux principes des droits de l’homme…” déclarent ses avocats.

Cambodge : les dernières nouvelles du Tribunal Khmer Rouge

Ieng Sary et son épouse Thirith, en détention provisoire au Tribunal, ont choisi leurs avocats.

Ieng Sary aura pour sa défense le Cambodgien Ang Udom, un ancien pénaliste de l’ONG Cambodian Defenders Project and the Legal Aid of Cambodia. Le choix du co-défenseur étranger ne devrait pas tarder.

Son épouse, Madame Ieng Thirith, ancien ministre des affaires sociales sous le régime khmer rouge, sera présentée par l’avocat Phat Pouv Seang, professeur de droits et conseiller du Parlement cambodgien. La Britannique Diana Ellis prend la place de co-défenseur étranger comme stipulent les règlements du Tribunal. Maître Ellis est une habituée du Tribunal international pour le Rwanda.

Les époux Ieng disent “ne pas avoir de quoi payer leurs avocats”. Après l’examen de leur patrimoine, si c’est le cas, le Tribunal prendra en charge tous les frais.

L’autre protagoniste important, Khieu Samphan, sera défendu par deux ténors : Say Bory, doyen du Bareau, ancien membre du Conseil constitutionnel, conseiller du roi Sihanouk Père, et le Français Jacques Vergès, que l’on n’a plus besoin de présenter. Les audiences seront certainement riches en rebondissement !

Les audiences commencent le 20 novembre 2007. Elles sont publiques.

Cambodge - Khmer Rouge : Deux premiers témoins devant le Tribunal

Novembre à Phnom Penh sera riche en événements judiciaires.

Deux anciens cadres de la prison de Tuol Sleng seront les premiers témoins au procès de Nuon Chea, ancien haut responsable des Khmers rouges, inculpé de crimes de guerre et crimes contre l’humanité. L’audience aura lieu le 1er novembre prochain.

Il s’agit de Monsieur Nhem En, 47 ans, ancien chef photographe de la prison de Tuol Sleng, et l’ancien chef de la sécurité de la prison, Monsieur Him Huy, 52 ans.

Un autre protagoniste important, Kaing Guek Eav (alias Duch), verra son appel contre sa détention provisoire examinée par le Tribunal spécial entre le 15 et le 20 novembre.

Cambodge - Khmer Rouge : Nuon Chea a son avocat

Nuon Chea, accusé de génocide, toujours en détention provisoire, vient de choisir Maitre Michiel Pestman, un avocat néerlandais. Il rejoint donc l’avocat cambodgien Son Arun pour défendre Nuon Chea aux frais du Tribunal.

Monsieur Pestman est membre du cabinet Böhler Franken Koppe Wijngaarden basé à Amsterdam. C’est un habitué des tribunaux internationaux. Il a défendu la Bosnie-Herzégovine contre la Serbie devant la Cour pénale internationale et représenté les victimes des “seigneurs de guere” au Tribunal spécial pour la Sierra Leone.

Cambodge - Khmer Rouge : Le parti royaliste Funcinpec veut expulser le Tribunal

Le Prince Sisowath Thomico, du parti Funcinpec, vient de demander au Premier ministre Hun Sen de fermer le Tribunal spécial Khmer rouge. Il propose aux autres partis politiques de faire de même. Sa requête est refusée.



Le Roi Père Norodom Sihanouk manifeste depuis toujours sa méprise pour le Tribunal. Les observateurs s’en interrogent sur la raison ? Etait-il impliqué de près ou de loin auprès des Khmers rouges ? Pourtant, une partie de sa famille a péri durant le génocide.



Le désamour se trouve empiré quand le Tribunal laisse entendre que le Roi Père pourrait être cité comme témoin.

Cambodge - Khmer Rouge : Nuon Chea clame son innocence !

A la veille de son transfert vers la prison du tribunal spécial khmer rouge, le deuxième mis en examen, déclare devant les journalistes : “Je ne suis pas coupable des faits reprochés. Tout ce que j’ai fait c’était pour servir mon peuple contre ennemis étrangers !”

J’ai déjà entendu cela dans plusieurs parties du monde, de l’Histoire ancienne à la plus récente, du Rwanda à la Yougoslavie.

“Responsable (peut-être) mais pas coupable !” Et les millions de morts ?

you know sometimes you feel pity for people in crisis of identity. You willing to let them share a piece of your heritage because of that compassion and the next thing you know they want to take your own history. You we have a word for that in Khmer, Si bai bok chnang, si sach min skol kru etc. I can only guess these adages were left by our sage as warning for us against these very same people we're dealing with today...

The people who can't decide whether they're Thai or Tai, Chinese, Khmer or non-existence!

my pity just runs out on Preah Vihear issue.

Don't use Khmer surin as excuse for your selfish political gain. All Khmer who have pride to be Khmer wishes Khmer heritage be under Cambodian sovereign even if they are living in Thailand or Vietnam.
