NEC wants to make Sam Rainsy pay a fine

The National Election Committee (NEC) sent a proposal the National Assembly president in order to cut opposition leader Sam Rainsy’s salary.

According to the NEC, the SRP President contravened the election law during the general election and he did not pay the fine imposed on him. The NEC sent a letter to Heng Samrin, the NA president, on this subject on 24 October.

The NEC recalled on that occasion that people sentenced by the NEC council have up to 30 days to pay off their fines and if no payment is made during that period of time, legal actions will be taken. Sam Rainsy was sentenced by the NEC for insulting 3 CPP leaders and he did not pay his fine during the period allotted. This fine was set by the NEC to 10 million riels ($2,500).

“For the good progress of justice, the NEC wishes to obtain the cooperation of the NA president to cut Sam Rainsy’s salary and use it to pay the fine for the NEC account,” the NEC communiqué dated 27 October explained.

NEC should go to court and get a court order to order HE Sam Rainsy to pay the fine. If he does not pay, then the court can issue another to seize his property and sell it to recover the fine due to NEC. This is an aspect of the rule of law.
When I was running CMAC, a partner of a contractor requested CMAC to suspend a payment due to that contractor because of a dispute between them. I told him (the partner) I could not do it unless he received a court order ordering me to suspend that payment.
A few days later, that partner presented me with a court order to that effect. I suspended the payment until I received another court order ordering me to pay the contractor. The contractor could not complain against this supension at all.
That partner has expressed to me his deep gratitude as the suspension of tha payment compelled the contrator to settle their dispute in his (the partner's)favour and he did not have to pay a penny for my advice to him.
But I did not ask him how much he had paid the court to get that order. I did not want to know.
This is one of the benefits of the rule of law.
The National Assembly should advice NEC to secure a court order ordering it (NA) to deduct the fine due to NEC from HE Sam Rainsy's parliamentary allowances.

Mr. Hay, did you just wake up? Or have you been living under the rock for the last decade? This is Cambodia. If you want the rule of law, go elsewhere. What difference does it make if it a court order or not? I am sure a court order can be obtained in no time anyways if they want it, so it make no difference at all.

Cambodian people need the rule of law in Cambodia so that they can live in a just society.

Though the court is not perfect and biased, the order from the court would be the notion of legal strengthening.

But what NEC is doing is just to make a favor to the order of CPP's master. CPP is Youn by origin. It has been structured by the Youn and Youn still overpower in this organization. Those CPP's top leaders can think to escape from this mechanism if they want. But the new breed of Youn like you is going to bolster this puppet organization solely.

Dr Lao got the right idea, but for people like Ah Scam Rainxy, I would used the most expensive lawyer in the country to collect from him, but I will do it slowly and let the bills and interests compound until just before the statue of limitation kick in. That way, the litigation worth hundreds of thousands instead of a few thousands.

to remove over a million voters from the voting list because CPP
sure that those people will not vote for them.

Another thing NEC has no right to remove any name from the voting list.

From my perspective, this general election is completely fraud.
Real number that CPP won is only around 50 seats.

Dear Dr Lao, Can you read Cambodian constitution again
-Article 76
The deputies shall be elected by a free, universal., equal direct and secret ballot.
-Article 77
The deputies of the Assembly shall represent the entire khmer people, not only khmers from their constituencies.
-Article 80
No Assembly member shall be prosecuted, detained, or arrested because of opinion expressed during the exercise of his or her duties.
I don't know how NEC wanted to fine Sam Rainsy during election campaign. But they cannot fine him for telling Cambodian people that most CPP leaders were thieves as they were >Areak Prey

Dr Lao M Hay with due respect I think you know very well about the rule of law in cambodia. There is Non. NEC/NA/CPP/CPP's affiliated bodies are the LAW in cambodia. NEC only pursues things that are beneficial to CPP.....NEC never consider seriously of the complains submitted by the oppositions in regard to the electoral irregularities. It's a one way street and two sets of rule of law. Look I understand you're trying to promote the rule of law in cambodia....you and others can try as much as you want, as long as we have the same leaders at the steering wheel we cannot expect different outcome. Cambodia is still Cambodia on paper.
