Sam Rainsy to appeal France's verdict and will send more evidence to the court

A French court on Tuesday fined opposition leader Sam Rainsy and a French publisher $12,500 for public defamation of Cambodian Foreign Minister Hor Namhong.

The court found libelous one passage in a book written by Sam Rainsy and published by Jean-Etienne Cohen-Seat in May 2008, “The Roots in the Stone,” which accused Hor Namhong of collaboration with the Khmer Rouge and the deaths of “numerous” people, to a court announcement.

The costs include more than $5,000 for publishing a correction in two French newspapers.

The court order also included the deletion of one page of the book, which includes the sentence, “A few years later, the Minister of Foreign Affairs would be a collaborator of Khmer Rouge power, suspected for having caused the death of numerous persons, among them members of the royal family.”

Sam Rainsy said he lost the case because the French courts were not able to properly examine the case in Cambodia, and he planned to appeal.

This is just a first step,” he said. “We will appeal and send more evidence to the court.”

During the April 2008 anniversary of the fall of Phnom Penh, Sam Rainsy said both the Minister of Finance, Keat Chhon, and the Minister of Foreign Affairs, Hor Namhong, had been members of the Khmer Rouge.

The editor of an opposition newspaper, Dam Sith, was jailed for one week in June 2008 for publishing Sam Rainsy’s remarks. Dam Sith was released on bail and later met with Hor Namhong, who then said he was dropping his suit against the editor to prevent clouding the upcoming national elections.

“This is the second round of justice given to me in France, and for the second time in Cambodia,” Hor Namhong told VOA Khmer.

Mr Sam Rainsy should write to French court to recongise the reality of the history of a sovereign country and to dismiss the complain made by Hor Nam Hong'layer and to ask Hor Nam Hong to refer his complain to Khmer Rouge Tribunal in Cambodia in which is sponsored by UN.
At the same time, Sam rainsy should tell the court that both of him Sam Ransy and Hor Nam Hong are Cambodian public servants elected by Cambodian people. Therefore French court should interfer justice of public servants of a sovereign country. Sam Ransy has also need to tell the court of French their decision may create a conflict of interest of the court set up by UN in Cambodia. Areak Prey

samraingsy lawyer should ask the france court to dismiss the case b/c the france has nothing to do with khmer problem and should not interfere with khmer at all. by the way hor namlorch should take a lie detector to see if he is really tell the true about what he had done in the past with pol pot.

One euro a day plus 4,500.00 euros and removal of a paragraph from the biographical memoir is clearly a victory for Hor Nam Hong. Sam Rainsy words have been tested by a COMPETENT COURT OF LAW in France, and the results were not in his favor.

This should strike in heart of his credibility as a politician.

What else in Sam Raisy's words that we could not trust?

I know one thing for sure he likes to incite riots and mass demonstrations on something that has no basis in the law. The results are factories being closed down, continuing illegal settlements on lands that belong to someone else who has been there much longer with proper land title. One other thing that always borders me when he started the party of which I was a member.

He promised that he would surround himselves with knowledgeable and educated people.

Now 14 years later, people who populate his party ranks are high school/college dropouts with serious attitude problems. Most of them from France are taxi drivers (not the highly educated Cambodian-French that we expected them to be), and those from the US cannot spell any English words correctly (regardless of what educational backgound they claim). He and his wife are always exhibiting repulsive attitudes that no Khmer members of his party can rise above their intellectual prowess. His party's inner workings are in such tatters due to mismanagement.

One has to wonder why people risked death to joint his party in the first place just to defect to the opposing party a decade later?

Why couldn’t they stay on?

My answer is: his words cannot be trusted and appointments to important posts are mostly done for his feel-good allies who clearly lack merits. As a result you have a fragile inner workings, and defection would continue despite his repeated claims of "democratic reform at the grassroots level".

Had he honestly and genuinely acted by his words to reform his party, NO ONE would defect to the CPP. And I repeat NO ONE would defect to the CPP. I speak of this issue from experience of having been a member of the party for almost a decade and a half.

LOL, hahaha, LOL, Ah Scam Rainxy think he could win on an appeal, hahaha.

He doesn't even know what an appeal court is. They don't take any new evidence, unless it was rejected by the lower court unjustly. All the appeal court do is review the lower court for error. However, is the litigant failed to present evidences, that is their own fault.

i'm not surprise at all. The french afraid they would upset the CPP government......Sam Rainsy does not hold any power thus is expendable. Remember justice belongs to those in power.....it's how the world is run. Most Khmer know Hor Nam Hong and Keat Chhon were high ranking KR, and you know during the KR period even a common soldier or a peasant can send you to death......what about Hor Nam Hong?

How can a loser can be happy, except Sam Rainsy? How does a true man wait till he is convicted that he submits more information?
A loser has always sth to say: he lost the case because the French courts were not able to properly examine the case in Cambodia, and he planned to appeal.

Does he not have a skillful lawyer?
Or he is just an unscrupulous liar?

There is no proof, that Minister of Finance, Keat Chhon, and the Minister of Foreign Affairs, Hor Namhong, had been members of the Khmer Rouge.
Because, These two ministers were members of Vietminh.

The above statement is very striking and reflecting a few scenarios:

1 . Country's political climate is deadly risky for SRP's members

2. Those SRP's defectors to the opposing sides used SRP as the stepping-stone to gain acknowledgement from the opposing so that they will be accepted and rewarded with pride being position in the government ......
3. Those SRP's defectors are really treasure-hunter

Sam minsy lost the case b/c he presented to the court only his personal problems, not for all khmer who killed by Hor 5 hong.

This is only a trivial civil case. You don't have to be a rocket scientist to examine any evidence.
