Civil society to monitor Mu Sochua’s trial

Several civil society officials will monitor the 24 July 2009 hearing of the lawsuit brought up by Hun Sen against SRP MP Mu Sochua.

Several officials from human right groups and civil society organizations in Cambodia plan to monitor the trial brought up by Cambodia’s top politician Hun Sen against Mrs. Mu Sochua. In this lawsuit, Hun Sen accused Mu Sochua of defamation, and the latter will show up in court by herself without the representation of any legal defense lawyer.

Rong Chhun, President of the Cambodia Independent Teachers’ Association (CITA), said that he is concerned about this case because he is worried that the court will not provide justice for Mrs. Mu Sochua. “We are concerned about any injustice that affects the people, whether it is Mrs. Mu Sochua or not,” Rong Chhun said.

Chan Saveth, an official of the Adhoc human rights group, added that there will be several human rights monitors present during the trial day, and he hopes that the county will provide a fair trial. “Because the law is the law for all, and lawsuits constitute the freedom for all in the use of the rule of law,” Chan Saveth said.

Opposition MP Mu Sochua claimed that she will show up by herself to clarify the court hearing in this lawsuit, following an unsuccessful last minute intensive search for a defense lawyer, after Kong Sam Onn, her former lawyer, decided to drop her defense because Hun Sen’s lawyer sued him.

Sok Sam Oeun, the director of the Legal Defense Group in Cambodia, declared that there are several cases in the world where the defendant refuses to have a defense lawyer representation, but in these cases, the defendants are provided the same rights as those of a lawyer. However, in the case of Cambodia, Sok Sam Oeun said that he is concerned that the court will not provide proper rights to Mu Sochua, as is usually done in other countries.

Sok Sam Oeun commented that in the case of Mu Sochua where no lawyers are willing to defend her, this situation shows that there is no safety for the legal community in Cambodia. “This means that there is no safety for the legal community in Cambodia,” Sok Sam Oeun said.

In the past, Mrs. Mu Sochua tried to sue Hun Sen for defaming her, after Hun Sen said without naming her directly that there is a “Cheung Khlang” (Strong foot, equivalent to “thug”) in Kampot who tore her blouse by herself, and she went to hug someone else, then she turned around and accused the other person of unbuttoning her blouse. Hun Sen also called her: “This woman is a thick-skinned woman”.

In her attempt to sue Hun Sen, the latter turned around and sued her back for defamation because he said that he did not name her.

Mrs. Mu Sochua’s lawsuit was dropped by the court which claimed that there is no proof to her case, however, the court still considers Hun Sen’s lawsuit against her, and the National Assembly [controlled by the CPP] voted to lift her parliamentary immunity on 02 June.

The disgrace Mu Sochua, her day as a free woman will be end today. No matter what Civil Society officials and IPU's official come to monitor the trial, it won't change the verdict or save her from jail time at all. Last night, she told SBS Radio (Khmer language) that Phnom Penh's Court won't dare to jail her because this case is defamation and unlike the case of Mr. Meoung Sorn and editor Horng Chakra. Having said that she should remember that her boss Sam Rainsy used to get fine 10 million Riel and 18 months in jail (By absentie) when PM Hun Sen sued him for defamation.

Please wait and see that after finished the trial "Will she able to go home or going to Prey Sar?"

As I am aware the disgrace Mu Sochua can go home after finished trial today but she has to wait the Court will give the verdict on 04 August 2009. From now until 04 August 2009, she can ask herself that what will her future hold?? Will she going to jail or not guilty?? The delay verdict of the Court today doesn't do a good thing for SRP and people who come to light on the candles.

If we think about positive thing, at least Mu Sochua can go home, a nice shower and sleeping warm with her white husband for another 10 days. After that, who knows what is going to happen to her?? Despite the verdict of Court sends her to jail, she has no reason to be afraid at all because she always said all along that she's not afraid in going to jail.

The waiting game is still go on...

Since this case is involved an opposition politician that makes it hard for some people to oppose the verdit. But we should see this as an example of how the justice system in Cambodia works. Fucking people like 12:06 never want an impartial court system in Cambodia. Maybe because he can benefit from the current system.

Given the backdrop against this milestone trial for a remarkably stupid and unwise lady who thinks she can get away by breaking the law--now, she has her chance to prove herself in court.

Rest assured, she'll get a fair trial; however, the rights group and news media -- and this cheap KI site -- have already exculpated their iconic criminal EVEN before the trial begins.

Well, we'll wait what will be the outcome of the trial. If she's innocent of all charges, then she'll skip her jail term--no behavior modification required. Conversely, if she found guilty, she'll need to serve her time--just like those who have been found guilty. Folks, no preferential treatment here--the court will enteprete the charges in accordance with the law--nothing more or less.

If you want to know that "What law says defamation can put people in jail?" my answer to you is the defamation law which created by UNTAC in 1992. Is it clear for you?? Please find out about it before you come and speak up louder. Hahaha

you stupid Cherrs , the lawsuit is about defaming , not criminal acting . there is no law in cambodia that will send people to jail by defaming. if the corrupted court found her guilty. all she has to do is pay the fine .

Cambodia's Court has sole right to decide that Hun Sen should be in Court or not. UNTAC laws in 1992 gave authority to the judge to decide. Is it clear for you?? If you don't know about laws in Cambodia, don't speak too louder. It's embarrasing to the nature surrounding your dirty house. Hahaha

I do remember very clear that whenever the Cambodia's parliement has lift Parliementary immunity of Sam Rainsy, he always ran away to overseas and skipped his trial. That is why Sam Rainsy didn't go to jail. Later on, he has bowed his head and sent letter to APOLOGY to PM Hun Sen for forgiveness and allow him to come back to Cambodia.

As what you mentioned about Sam Rainsy didn't go to jail when he lost the case to CPP for insulting Hun Sen, Chea Sim and Heng Samrin during the last general election because Sam Rainsy just breached the rule of the election campaign. So, he got only fine 10 Million Riel. Sam Rainsy refused to pay fine for a while but when the permanent committee of the Parliement lift his immunity, he agreed to pay that fine. That is why he didn't go to jail. This issue is so easy to know it, but you and other SRP supporters has very low education, let alone be able to understand about laws in Cambodia. All you guys can do is just blind suppport the Cambodia's trouble maker Syrain Sammmmm.
