Appeal Court upholds Hang Chakra’s sentence: Travesty of justice perpetuated

In the morning of 11 August 2009, the judge of the Phnom Penh Appeal Court handed down the decision on the lawsuit against Hang Chakra, the Editor-in-chief of the Khmer Machas Srok newspaper. In its decision, the appeal court upheld the sentence handed down to Hang Chakra, namely 1-year of prison sentence and 9 million riels ($2,250) fine.

Chuon Chou-ngy, Hang Chakra’s defense lawyer, said: “If my client wants to appeal his case to the Supreme Court, I will do as my client orders me to.”

In the hearing, Hang Chakra (allegedly) acknowledged the mistakes he has committed as he was accused.

This has been a remarkable, yet preposterous, coincidence of the sentences of the opposition leader Aung San Suu Kyi and Mr. Hang Chakra that were rendered by these arbitrary judges. How ironic and absurd can the event be?

Yes, I would rather work as a janitor cleaning the restrooms in foreign countries than joining the “de facto” government.

Someday Hun Sen and his groups will face the Cambodian Court as the same as Khmer Rouge, Pol Pot, Ieng Sary, Khiev Samphan, Duch, Ta Mok and Noun Chea. The Cambodian people never forget K-5 under Hun Sen and the current situations under Hun Sen and his gangs. The history will tell the truth.

Speaking of addicted to stupidity of the de facto government, the verdict came with no surprise whatsoever. In fact, the "guilty" verdict was expected, undoubtedly.

I'm happy to be toilets cleaners for foreign country rather than joining the de facto government.

Cambodian authority should come up with a more benign and inclusive way of dealing with dissidents and internal opposition generally.

Cambodian people have experienced abuse at the hand of the state over the last 40 years and are therefore inherently conscious of illtreatment or perceived injustice.

Draconian measures do not always offer the best way forward, particularly, in relations to acts of conscience of this variety which is threatening not just the tenuos foundations of civil society, but political stability itself. All Cambodians have a right and a potentially positive role to perform in the rebuilding and safeguarding of their country, sometimes not to the taste of the power that be, but the punishment must of necessity, and for wider national interest, reflects the nature of the crime committed.This includes the purported lack of professionalism on the part of those dissenting elements as such.

Further, it should be borne in mind that regimes and governments come and go with the passage of time, and that some powerful figures in politics today have been drawn from less than civilised segments of Khmer society.

Citizens should also be equally conscious of the fact that of all the crimes committed against humanity, the State has been the most prolific perpetrator of such offences, and that relying on a minority - even one democratically elected - to exercise their wisdom and knowhow in the execution of their proclaimed 'national interest' will not necessarily result in their own genuine interest or those of their nation being accentuated and accommodated.

It would not be suprising if individuals with talents and abilities decide to avoid direct involvement with their country's development or politics knowing the manifest risk to their personal and family safety is unacceptably grave. But, who knows, perhaps, this maybe just what the regime is deliberately inculcating in their perceived opponents and subjects at large.

While government are like busy bees on stinging the dissident to silent them for being critical of the current regime, the country (Cambodia) is heading toward catastrophic changes in the coming years.

The global climate change is already affected the Cambodia weather pattern. Has anyone noticed of drought, hotter temperature, and low yield in rice plantation. The current ruler of Cambodia MUST step to the plate to solve these problems. The more trees and slash/burn tactic of farming will not sustainable for long for Cambodia. As the Natural resources are being clear by illegal/tied to the govenment irresponsible.

Cambodia will sooner or later will turn to a Desert country. Facts: 6000 years ago the Sahara of Africa was once a lush green country. What does one see now. The soil needed moisture to country ambien Temperature to maintain the natural water cycle. The rain will fall less and less when the trees are no longer there.

The Cascade Effect takes place. The trees withered and rices withered and DIE. The food becomes scarce. The WAR WILL BREAK OUT WHEN CAMBODIA NO LONGER CANNOT FEED THE 15 MILLIONS MOUTH.

IN APPROXIMATE TIME, 40 YEARS FROM NOW -- CAMBODIA WILL DOUBLE ITS POPULATION. WILL IT ABLE TO FEED THE 30 MILLIONS PEOPLE.

We have an arrogant government (CPP) body right now. They are utmost undereducated bodies in the system and nobody of the CPP clan has moral principle.

Cambodian People's Party Hun Sen Khmer Rouge Regime had committed acid attack.
"On December 5, 1999, Tat Marina, age 16, was severely disfigured in an acid attack in Phnom Penh. The attack was allegedly committed by Khun Sophal, the wife of a senior government official, Svay Sitha, because she was angry her husband had a sexual relationship with Tat Marina. Neither Khun Sophal nor those suspected of being her accomplices in the attack were brought to justice. Intense media publicity compelled the Phnom Penh Municipal Court to issue an arrest warrant for Khun Sophal for attempted murder, but the police claimed that they could not locate her, although journalists reported that she was living at home as usual."

TORTURE AND MURDER ON PRAK SITHA WHILE IN CUSTODY BY MISNISTRY OF INTERIOR OFFICIAL
Cambodian People's Party Hun Sen Khmer Rouge Regime had committed torture and murder.
"On the night of January 16, 2003, a street youth named Prak Sitha was beaten to death at the Ministry of Interior (MOI) headquarters after he was arrested and detained by off-duty MOI officers on suspicion of theft. His body - bearing numerous injuries to the head, torso, arms, and legs - was dumped at a Phnom Penh pagoda the following morning by ministry officers, in violation of police regulations regarding deaths in custody. No criminal charges were filed in connection with this death. In December 2004, the case was cited by the UN secretary-general's special representative for human rights in Cambodia - who stated that Prak Sitha died at the ministry "following beatings by a known police officer" - as an example of a "consistent and continuing pattern of impunity" in Cambodia."

PUT SAMPHORS WAS SHOT DEAD BY MEAN SOKCHEA, A RCAF MAJOR WORKING IN BRIGADE 70.
Hun Sen's personal Bodyguards Unit (Brigade 70) is a terrorist organization.
Hing Bunheang is a March 30, 1997 Grenade Attack suspect identified by the FBI.
Cambodian People's Party Hun Sen Khmer Rouge Regime had committed murder, again.
"On September 4, 2008, Mean Sokchea, a RCAF major working in Brigade 70, shot dead 21-year-old waitress Put Samphors at a restaurant in Kandal province. Mean Sokchea, in a drunken stupor, fired his gun and apparently mistakenly hit Put Samphors in the stomach. She was taken to a hospital but later died of her wounds. Mean Sokchea was detained by the police overnight but was then released, allegedly after intervention by Hing Bun Heang. Put Samphor's family received US$2,700 from Mean Sokchea, and the police told them that their daughter was shot while authorities were chasing robbers."

I tried to save Hang Chakra to avoid jail time, but I failed because the bail out will cost me for court fee about $15000 to $20000 U.S dollars to free him. Sorry Guys.

The fact is that the law of Disinformation is a law written by European/Western lawyer when the UNTAC Criminal Law was drafted. The new penal code should be written so that so-called Disinformation is not a crime. Also to the PM credit, he called for the decriminalization of the crime of Defamation-a law also contained in the same document.

Rest assured, the case will be reopened when Prime Minister Hun Sen's days are numbered. Remember: the current leader can hide his ignorance and stupidity, but his egregious complicity in which he has perpetrated cannot be hidden from the public's eyes, and the US can certainly give him the assurance.
