Hun Sen had "a long history of trying to muzzle Cambodia's political opposition and undermine the independence of the legal profession": HRW

Court rules politician defamed Cambodian PM

2009-08-04
Associated Press

A Cambodian court found an outspoken opposition legislator guilty Friday of defaming Prime Minister Hun Sen, despite complaints from rights groups that the lawsuit was aimed at silencing critics.

During a closed door hearing Tuesday, Phnom Penh Municipal Court Judge Sem Sakola found lawmaker Mu Sochua guilty and ordered her to pay 8.5 million riel ($2,000) to the state and another 8 million riel ($1,882) compensation to Hun Sen.

Mu Sochua said the ruling showed that the courts were at the mercy of powerful politicians, an allusion to Hun Sen who dominates the country's political scene.

"I do not accepted the ruling of the court," Mu Sochua said before marching with supporters two miles (three kilometers) to the headquarters her Sam Rainsy Party. "I am a victim in the case. I will continue the fight until justice is provided to me."

Outside the court, about 100 supporters of Mu Sochua clashed with police, with witnesses telling reporters that several were beaten with batons and kicked. No one was seriously injured.

The case against Mu Sochua was filed after she attempted to sue the prime minister after she claimed he made defamatory remarks about her during two speeches.

In early April, Hun Sen referred to an unnamed lawmaker as a "strong leg," a term seen by some in Cambodia as particularly offensive to women. Mu Sochua has said the speech clearly referred to her. She also denounced his remarks in another speech.

The Phnom Penh Municipal Court rejected her lawsuit in June, saying it was groundless, but it moved ahead with the prime minister's countersuit.

Cambodia's Parliament then stripped immunity from Mu Sochua and another opposition legislator who was being sued for defamation by Hun Sen and senior military officers. The two accused Parliament of serving the prime minister's interests as colleagues staged a walkout.

In June, the office of the U.N. High Commissioner for Human Rights in Cambodia and New York-based Human Rights Watch criticized the lawsuits against the lawmakers.

The U.N. in a statement said the lawsuits undermine the constitutional freedom of opinion and expression.

Human Rights Watch said Hun Sen had "a long history of trying to muzzle Cambodia's political opposition and undermine the independence of the legal profession."

The verdict is out; the guilty one must respect the court's decision whether you like it or not -- it's the law -- and the court has found her guilty. Therefore, if she does not accept the court verdict, she's not respecting the law of the country. After all, she's one of the law maker (how ironic?).

The judge was judicially interpreted the law--not legislate from the bench. Therefore, it is not ignominiously to acknowledge the guilt, since the culprit one was the one who perpetrated this act.

See, as I said 10 days ago that "If the Court found the disgrace Mu Sochua not guilty, SRP and its stupid supporters will applause that the Court is independent and impartial, by contract, if the same Court found the disgrace Mu Sochua guilty, SRP and its supporters will point their fingers blame to the Court". Now, it becomes the reality. So, as long as Cambodia's court doesn't give any verdict which is disgrace Mu Sochua wanted, SRP and its supporters will condemn to the Court no matter what they have broken the laws in Cambodia.

If the disgrace Mu Sochua is brave as she always said all along that, she's happy going to jail rather than pay the fine, she should honour her word and don't need to pay fine 16.5 Million Riel and let see what will happen??

In my view, I am sure that she will pay the fine and uses SRP's policy which wants to end this defamation case as an excuse to cover up her coward act.

Question:

Why is she laughing? Bc now she is free and loaded with the leftover money from Khmer tool donors? Yes I think so. You've done well Sochua in exploiting those idiotic Khmer lop lop to give you not just enough money to pay the fine but even more to buy maybe a landcruiser 09 or something and ride around Phnom Penh handsomely. I should enter politics since there are so many idiots to use and extort the money from right in front of their faces and they don't even know it lol.

lesson: at the end of the day, dumb ass people pay while the politicians from any side play and benefit from them.

Real winners: Hun Sen, Sam Rainsy, and Sochua
Losers: whoever donated to pay the fines

Let me tell you something for those who read my comment. You are not doing anything good for the country by supporting any group of political party. You're just contributing to a clan of people that you want to be part of. So don't go around thinking like you have done so much for the country with your money when in reality all the money you spent went toward benefiting an exclusive group only.

Stop being a fucking political tool that feel the need to belong so much and be your own independent person. Stop giving money to politician and instead go to build and do shit for the people. That is what contributing to the country really means.

Justice of Hun Xen regime = Justice of Junta (Burma) = Justice of Hanoi regime (Vietnam) = Justice of Ahmadinejad (Iran) regime = Justice of Kim Jong-il (North Korea) = Justice of communist China

We all know these dictatorial and communist regimes live above the Law of the Land. These regimes are the Law and not the Justice System.

I call on donor countries and the United Nations to pay close attention to the miscarriage of Justice under Hun Xen rule. Hun Xen cannot and will be trusted to bring justice and freedom to the people of Cambodia.

Yep, the only way to defeat the CPP is a civil war. We should donate $$ and weapons to the group that opposes the CPP. There is no law in Cambodia.

Khmer Australian who lives in democratic country is very hard for him/her to see black and white or right and wrong or good and evil. So he/she must need help from a psychotherapist in Australia.

to khmer australian:

is australia a communist country?
i hope it doesn't have a court system like the one in cambodia. i believe that people (especially cambodians) living in a western democratic society are able to enjoy their rights and freedom and think critically and honestly about what freedom and human rights really mean to all people regardless who they are and what political party they belong to.

I strongly believe that freedom is the need and the want that people from all the world have been fighting for. We, cambodians, have escaped cambodia for the same reason, didn't we?--to search for fredom and peace.

Australia is not a Communist country but those monekys from SEA nations like from this whore little nation Cambodia want to show off that they are Australian.

It's not a surprise that Mrs. Mu lost this lawsuit. This is bad news for the CPP staffers. We all know that they run the show. Judge Sem Sakola is running the whole show whatever there were some international observers paid much attention in the courtroom before or some people throw a lot of shit on him. So in order to please Hn Xen and the rest of the CPP members, and he has to force himself to make believe that Mrs. Mu must loose this lawsuit. Otherwise this judge is not very stupid because if Hun Xen looses and this judje must loose his bench in the court room. Finally if Mrs. Mu refuses to pay the fine and it does mean the court system in Cambodia doesn't work at all.

What court in Cambodia are these peopel talking about?
Bullshit!! Cambodia really does have a court? Are people joking?

Anonymous said...

I think she should just pay the damn fines and move on. People are losing their lands, sue the hell out off the ministers or whatever department (s) that are granting these permits. Cant take the head off, chop all of limbs instead...the head will eventually die.

My beloved 10:22PM!

I unashamedly agree with ye about the Cambodian's court, justice, and constitution, because these unearthly systems are mockeringly and jokefully decoyed.

Pathetically confessing to lacking desire of Khmer's poliSick, I am implicitly respectful of Mrs. Mu Sochua's overwhelmingly positive attitude in leading the poliSickal life is a supreme moral duty, as she is the most direct way way of overcoming the evil of CPP!

She has the right to file in the Appeals court and then to the Supreme Court if she wants.

MP Mu Soc Hua is just one voice yet that exposes the entire CPP clique no shame nature.

Credit to her determination as a woman with no gun or death squad to challenge the evil in Hanoi installed stooge.

On one to one -mano to mano,Hun Xen is far less than a child but a big mouth of no shame to beg or borrow from foreign nations to credit himself as a nation builder.

Really,Hun Xen is no better than Pol Pot except he sold the country out to make name for himself.

I don’t agree with everything Hun Sen does, but to me and many other Khmers, he’s the most capable we have now. KI Media team, KY, and alike, are already upset with my statement – I can feel it! However, the truth is the truth either you like it or not. Look at how the SRP party and leadership handles this case? It makes me laugh when I think about it. SRP party and leadership may have all the best intentions for the country, but having the best intentions alone without the brain is not enough! That brings up another interesting point – where are the Khmer intellectuals and shining stars? Why don’t they come out and support SRP if Sam Rainsy is such a good leader and Hun Sen is such a bad leader? I leave you folks to decide yourself.
