Cambodian opposition leader loses immunity again

Phnom Penh - The leader of Cambodia's main opposition party lost his legal immunity for the second time this year following a vote Monday in parliament that was boycotted by the opposition.

Sam Rainsy, who leads the Sam Rainsy Party (SRP), is accused of involvement in uprooting boundary markers along the country's eastern border with Vietnam. A provincial court had requested that his immunity be stripped so it could investigate the alleged offence.

The vote was boycotted by the SRP and its ally, the Human Rights Party, which together hold 29 seats in the 123-seat assembly. The vote required two-thirds of the legislators vote in favour, an easy task for the ruling Cambodian People's Party (CPP), which holds more than two-thirds of the seats.

Opposition legislator Son Chhay, who stayed away from the vote, told the German Press Agency dpa that 87 lawmakers had attended the vote, and that all had voted in favour.

'When it comes to the opposition, the government will (remove immunity) straight away,' he said. 'I wrote a letter to the speaker when I heard what they intended to do and said we should have a high-level multiparty committee set up to investigate the case, but they refused.'

However CPP legislator Hou Sry said the vote to suspend Sam Rainsy's immunity was simply following the law.

'It was a request from the court, so we have to do it,' he said. 'We can't judge whether his actions were right or wrong, that's for the court.'

Sam Rainsy stands accused of overseeing the removal of wooden posts that mark the border with Vietnam in Svay Rieng province in eastern Cambodia. The opposition leader said he was standing up for villagers in the area who claim Vietnamese authorities are moving the border posts onto their land.

Sam Rainsy is currently in Europe. Son Chhay said the party leader was determined to return to Cambodia, adding that the case is 'very sensitive.'

'This case is related to Cambodian sovereignty and the border issue,' he said. 'I don't think it will benefit the CPP if they continue to punish Rainsy for fighting for Cambodian sovereignty.'

The vote marks the fourth time this year that MPs from his party have been stripped of their immunity. Critics charge that the ruling party is using the courts to move against opponents in politics, the media and civil society. The government has won a string of legal cases this year.

All the opposition MPs must go to the border with VN and pull out the border markers and let the NA strip their immunity, it's no use to hold the MP immunity in this NA.......it's clear they are not working for Cambodia's interests.

overnment don''t care about border of khmer land. Sam Rainsy is a person who pity and he meet difficult problem should not loses immunity again. He does right thing why need to loses his immunity again what kind of the government in cambodia? I think it is very crazy and very corrution,we should not have government in cambodia because always they never take care of our land forthermore khmer people who suffer at the border... ?

I have never support SRP but This is so rediculous!!! ,khmer punnish khmer for trying protected its boder line from neighbor encroachment, why so fear of VN?this would give a signal to khmer people that something wrong behind cpp and vietnam with this border issue.

I am khmer my feeling is khmer my life is khmer everything khmer but i am not happy that everything happen to Sam Rainsy is not right. He is a person who so pity and nice always he has too much care about khmer peopel problem, but Hun Hen never care.....If Hun Hen care only political or play game ..

RFA asked Xam RainXy a simple question that "Will he come back to Cambodia to face the Court if Parliament lift his immunity?". He didn't answer the question but at the same he tried to say something which irrelevant to the question, aim to cover up his coward act. What is a funny politician?

Since he pulled off the six poles near Vietnam's border, he always says all along that he doesn't afraid at all if the government sues him, but right now, he can't even step his foot in Cambodia.

As I am often said that Xam RainXy is brave only in front of microphone but in real life, he likes a rat runs around asking other people to help him whenever his political stunt get backfire.

Xam RainXy should go to Thailand and asks his ally (Abhisit and PAD) for helping him.

Who are Cambodians?

This question is being asked to everyone who are reading this message.

- Sam Rainsy Party and members are Cambodians
- CPP party and members are Cambodians

So it makes sense that these two parties have to bear Cambodian heart. But the CPP's parliamentarians who raised hand to show their vote of lifting Sam Rainsy's immunity because of his concern with border demarcation with Vietnam showed us strange and super strange thing in Cambodia politics.

SRP party and CPP party have been working to bring benefits and interests for Cambodia. But when Sam Rainsy dare to check with eyes the border point demarcation and the farm owners pulled out those simple wood-sticks, CPP has taken this issue seriously to the parliament to bully Sam Rainsy. (Note: Sam Rainsy didn't pull out those sticks but as a leader he has to protect those weak farmers by accepting his act in pulling those sticks). But the craziest thing is that parliament members didn't firstly investigate the case properly by using its most ability to respect the voice of voters (people) and minor party.

For Chheam Yeab, he is over-stated the act of Sam Rainsy as "Security Concern" of the nation. Nguyen Tan Dong accused Sam Rainsy only vandalizing public property and undermine friend relations, but CPP's court of Svay Rieng accused Sam Rainsy more than that as racism. But all those accusation is even worse, the worst is Chheam Yeap who accused Sam Rainsy of "undermining national security". This accusation is really unrealistic and not different from Pol Pot.

When Pol Pot wanted to kill someone, they would create a case and accused them as "undermining national security" or "being traitor" etc. Now, under Chheam Yeab, it has become worse than that because to try the case of Sam Rainsy and accused him in that felony verdict it means to threaten Cambodian people in the whole country. Pol Pot killed people they suspected but took firm stance to protect border land in both Vietnam and Thailand. But current government, may be under Chheam Yeab's policy, Cambodia will be easily integrated into Vietnam; or at least in the name of Cambodia but every main policies and leadership must be guided by Vietnam as same as in Lao.

Who is Chheam Yeab?

1. Since the Cambodia-Vietnam supplemental border treaty, to Khmer Monk Tim Sakhorn, to 22 Khmer military PhDs, to allying with Thaksin to slap Abhisit's cheek, and to current bullying of Sam Rainsy etc illustrates the "hell policy of CPP" which has undeniably lost its integrity, independence and self-determination. CPP can use 99% ownership of mass media to manipulate the whole Cambodian people inside this country, but CPP cannot hide themselves from frustration of its self-destruction policy and final demise.

2. The answer must come out directly from CPP's members themselves. Do they want to live longer and pursue self-reliance or not? Many CPP's members and parliament representatives are actually patriotic but how can they untie themselves from this rapid fastening of neo-imperialism approach of Vietnam? Many CPP's members are wanting to defuse the Vietnamese power from inside should start to "walk the talk". However, I don't see they are doing that plan because from day to day, they are firmly becoming strongly tied in trap.

If CPP's members think that your leaders are doing the right thing and current mechanism to handle with Sam Rainsy is correct, I think you are lost in the abyss of ignorance.

Son Chhay is very correct if Hun Sen want to win the battle with Thailand, he must been seen as a nationalist not a hypocrite. He could win a war with SRP but he will lose the battle with Thailand and among his own supporters. Not to mention international criticism. We are here together and I do want to support Hun Sen for the conflict with Thailand. We must do politics against foreign countries and share the interest with our own kind. I agree to disagree but I don't agree to hurt each other.
