Svay Rieng court officially sues Sam Rainsy

The Svay Rieng provincial court brought a criminal lawsuit against Mr. Sam Rainsy, charging him with uprooting the border stakes between Cambodia and Vietnam in Svay Rieng province.
The Svay Rieng court officially sued Mr. Sam Rainsy and accused him of perpetrating two criminal offenses: destruction of public properties for the uprooting of the border stakes between Cambodia and Vietnam in Svay Rieng province, and also for racial discrimination.

Chuong Chou Ngy, opposition leader Sam Rainsy’s defense lawyer, told RFA on Saturday 12 December 2009: “(1) for the destruction of border post No. 185 between Cambodia and Vietnam, and (2) for racial discrimination. The accusations leveled by the prosecutor are officially opened for investigation, and the case has moved to the investigation judge. Currently, the case is under investigation.”

Chuong Chou Ngy said that he is prepared to confront this sensitive lawsuit: “This is a sensitive case, therefore, you have to understand me because I cannot talk in depth about it. I am thinking of preparing witnesses to clarify that the planting of this border post is not right.”

sVar Kim Hong, chairman of the Cambodian joint border commission, said that he wants to see the Svay Rieng provincial court holding its hearing on this case as soon as possible.

sVar Kim Hong said: “The sooner the lawsuit brought up by the Svay Rieng court can be decided, the better it will be so that it can be clearly known.”

Yim Sovann, SRP MP and SRP spokesman, reacted by saying: “It was not public property destruction. The wooden stakes do not even cost $2. Those who destroyed forest by the tens of thousands hectares of land, and those who caused the loss of several millions of dollars, they are the ones who should be rightfully lifted of their immunities so the court can sentence them.”

The official court lawsuit was undertaken recently after the Chantrea district authority brought its lawsuit to the Svay Rieng court, and accused Sam Rainsy of destroying public properties at the end of October.

Subsequently, opposition leader Sam Rainsy saw his parliamentary immunity lifted by the National Assembly on 16 November so that he could face the investigation and the questioning by the Svay Rieng provincial court under the charges above.

Mr. Sam Rainsy, along with Cambodian villagers in Svay Rieng province, accused Vietnam of planting these border posts through encroachment on rice fields belonging to local Cambodian farmers. Cambodian border experts denied this charge by claiming that both the Vietnamese and Cambodian parties have agreed on that particular location.

About 20 SRP MPs plan to visit Svay Rieng province at the beginning of this week to check on the local border condition.

CAMBODIAN GREAT WALL


Vietnam has, in the past 30 years, implemented two brilliant strategies that present a mixed blessing to Cambodia. The first one is the military intervention to depose the Khmer Rouge regime and occupation of Cambodia; the second is the recent thrust of investments into the Cambodian economy. Cambodia has survived, and perhaps prospered, but it is at the mercy of Vietnam.

The 7 January – in 1979 when Vietnam succeeded in installing a new government of Cambodia – has become a wall that divides Cambodian people. Some regard it as the day of liberation, others the day of subjugation. The Cambodians often clash in the streets on the day to manifest their conflicting beliefs. Hence, there have always been two incompatible interpretations of whatever interactions between the two nations. The ultimate cost of this stubborn divide is a weakened Cambodia that remains in Vietnam’s dominions.

Cambodia has been burnt many times for depending on foreigners. In the 60’s, it sanctioned US bombings of Cambodia with an expectation that Vietnamese communists in the country would be curbed; but the communists thrived while the bombings killed Cambodian villagers at the border. In the 70’s, Cambodia relied on the US and South Vietnamese support against the Vietnamese communists. The support was later withdrawn as their best interest had shifted; the Khmer Republic died and Cambodians were left in agony. For helping the Vietnamese communists to win the war and relying on their goodwill, Cambodia received in return the murderous Khmer Rouge regime; over one million Cambodians died.

With a simple lesson that foreigners always act in their own interests, Cambodia needs to remove itself from the mercy of Vietnam, by securing a leadership that can flatten the wall.

Unfortunately, none of the current leaders are able, or willing to. Prime minister Hun Sen, who constantly reminds Cambodians to remain grateful to Vietnam for saving their lives, would be incapable of taking any actions that may upset Vietnamese interests. Given the extent of his personal gratitude, which perfectly conforms with a Vietnamese proverb: “Receive a plum, return a peach”, one wonders what the strongman has already done, and will do, for Vietnam at the expense of Cambodia.

On the other side of the wall, opposition SRP is also unlikely to knock down the Cambodian divide. It has exploited it by often engaging in politically charged but somewhat hollow gestures. The latest act is that president Sam Rainsy impetuously removed six temporary poles planted to mark border demarcation between Cambodia and Vietnam, which has subsequently sent him into exile again. He claims the removal is “just a symbolic gesture”, without realising how futile it is in terms of addressing the wall that weakens the country.

It seems the current leaders have done their best in their own ways to effect the divide for their own interest. Hence, Cambodia has no alternatives but to look to its younger generation for a fresh leadership that appreciates the need to level the wall before Cambodia remains forever weakened and exploited.

All this proves that Hun Sen doesn't not do his Prime Minister tasks but manages his politician futur using chess strategie.

First, exclude Sam RaingSy from his opponent list.

Second, help Thai to prevent military coup because if there is a military coup it would be from the west.

He mad a mistake, civil wars will be from inside because there is no opression without revolution.

If I were Sam Rainsy, I would countersue Svay Rieng governor for failing to protect Khmer Land. I am sure that the governor will tell his court to drop charge against Sam Rainsy.

Mr. Sam Raingsy is a Law maker and Member of the Cambodian Parliament, is able to defense himself. It is his responsibility to be on the court. We send him our moral support.

Like I say before stop punishing your own kind unless you are traitor. Cambodians love this land just as much you do, but please be reasonable to the cause. Sam Rainsy should be supported by the government to protecting Cambodia territory from the Vietnamese. If the government thinks he is breaking the law, the government should explain to him and the people lost the land to why the border posts are planted there. The government should punish people who cares for Cambodia interests....

According to sources in Phnom Penh
yesterday said, Hun Sen will not allow Sam Rainsy to return to Cambodia. Sam Rainsy must face criminal trail and serves time in Prey Sar at least 10 years before he could run the public office again.
Some of his followers start defect to CPP more and more every day for their safe and to avoid Ghos flag hanging in front of their house.
Hun Sen Added yesterday morning at the airport "Sam Rainsy's political life is over or finished in Cambodia".

I want to know the real GPS measurement of the location which claimed that Sam Rainsy uprooted some Vietcong bamboo wall made of 6 bamboo sticks and compare it to international Cambodian map!

I had been to Viet-Cambodian border! I notice that the Viet used the roads as a borderline but dirt poor Cambodian use farmland as borderline! Now as you can see because there are no dirt poor Cambodian population living along Cambodian border and the Viet keeps moving their border posts and soon to follow are their roads to keep dirt poor Cambodian people out! This strategy work well for the Thai along Cambodian borders!

Hey! AH HUN SEN is a Vietcong puppet and he can do no harm by giving more land to the Viet to walk on!

8:44PM, Countersue CPP? I don't think so. We all know that.... The whole judiciary stystem in Cambodia is only to punish the opposition and the poor citizens.

Hun Xen and CPP is above the constitution.

There is no government! There is no constitution! It's all Hun Xen and CPP....

Hun Xen and CPP are not Cambodian Government. If so, they would protect the interest of Cambodia.

They are Youn slave! Everything they do is to benefit Youn. Look at all the high officials. They are almost all Youn. A few of them are khmer but Youn head.

This people don't care. They kill their own poor people and destroying their own country as long as Youn keep them in power. What they haven't realize is when Youn finish using them they will kill them too, including their family, friends and pets. This peopole are idiot! They only interest in power and money....

This is stupid! I hate Cambodian government! They have no common sense!

It is ok for Youn to plan their post in our Khmer Citizens farm. But it is illegal for Khmer Citizens to pull out those post.

If anything, the farmer should be the one to sue the government for neglecting the complaints for decades.

Also they keep saying it is pulic property. This is stupid! It's on the Khmer farm, the facts is the government violating the farmer rights.

Without Sam Rainsy, Hun Sen will not last another 10 years. But with Sam Rainsy as a head of the opposition, Hun Sen will last at least another 25 years.

Ah Svar Kim Hong should be trial as soon as possible for signing off Khmer land to Hanoi. Ah Svar Kim Hong used to be a bank teller in France before he jointed Ah Hun Sen to work a dirty job. He didn't use his brain that one day he will see the hell by Khmer people. We need to execute him as soon as we liberate Khmer from Hun Xen. He is a real traitor.

More press thanks. A person could have made a big press event about the border markers without taking them out, but more press and a public display in which one can claim unjust persecution my be the real story.
