“INCITEMENT TO RACIAL DISCRIMINATION”: A POLITICALLY MOTIVATED AND GROUNDLESS ACCUSATION AGAINST SAM RAINSY
The text below is a Letter from parliamentary opposition leader Sam Rainsy to the Editor of The Cambodia Daily, which published it today.
In your article “Rainsy says ‘Definitive’ Maps Point to Innocence” (March 26, page 23) you wrote, “In January, Mr Rainsy, who is living in France, was sentenced in absentia to two years in prison for incitement to racial discrimination and destruction of public property after he uprooted six wooden stakes at a temporary border marking with Vietnam in Svay Rieng in October.”
I don’t need to add anything regarding the second charge (“destruction of public property”) because there was no public property involved that could be associated with any real and legal border line, and the legitimate owner of a private land has the right to dispose of anything that has been put on, or planted in, his land without his consent. In our case, we are talking about six commercially worthless wooden stakes.
But regarding the first charge against me of “Incitement to racial discrimination” which Article 61 of the 1992 UNTAC Law relates to “any person that provokes national, racial, or religious hatred that constitutes incitement to discrimination, hostility or violence,” I can say that it is totally groundless and politically motivated.
All I said and did on that day (October 25) in Svay Rieng province while meeting with villagers in the concerned border area, has been videotaped and can be viewed at http://tinyurl.com/yhwf289 and at http://tinyurl.com/yfmakb5. In the first document, I essentially listened to villagers’ grievances in the compound of a pagoda. In the second document, after following villagers to their nearby rice fields and analyzing with them the situation on the spot, we pulled out the “six wooden stakes at a temporary border marking with Vietnam.”
I challenge any government or court official to seriously prove, with concrete evidence, that I have said or done anything that could be related to “incitement to racial discrimination.”

Bravo Mr. Sam Rainsy for defending yourself. It is completely baseless for the CPP to make charges against Mr. Sam Rainsy. Mr. Sam Rainsy did not ever need to do this on his own behalf. He was protecting Cambodian farmer's grievances.

Thank you Mr Sam Rainsy for your clarification over accusations by provincial court regarding racial incitement.
Now it is clear that the incident took place inside Svay Rieng province, cambodia.If that had happened in Vietnam,vietnamese government would sue Mr Sam, possibly arrested Mr Sam Rainsy and the villagers,then refers matter to cambodian government.
In regarding being accused of destruction to public properties, on pulling out the wooden stakes
is GROUNDLESS.Quite obvious that land is belonged to the villagers, which is PRIVATE property.
These leave the argument that those ill intended posts belonged to Cambodia,or Vietnam?.
If these erected by cambodian authority,then this authority needs to explain that to cambodian government and the people.
But in the case of those posts are ercted by Vietnam, thus Vietnamese government has obligation to varify to the cambodian government and her people.
Regardless,the Authority is compelled to clarify to cambodians if it is competent or incompetent in adressing this sensitive issue.
Having used all power means to jail own citizens is blatant in cambodian's rights abuse.
And it is clearly indicates that the court,border authority and the RGC committed to an unjust act,to oppress its own people.
I believe that this case can be brought to the UN and the international human right body, if our KING cannot resolve that in the name of his kingdom.

SR was trying to protect our people from being robbed by our neighboring country but he unfortunately did not go through the process of the "diplomatic approaches" which in turn led into the political conflicts. This situation however no needs to condemn our own citizen for his wrong doing but should at least discuss about the issue and come up with an agreement to what need to be done as a "khmer gov't" to prevent situation like this to ever happen again. In this case however, if you want something done, you need to talk to the "Master" that is Viet "PM". or otherwise if khmer gov't had a secret deal with the viet, they should at least let the whole nation know what they, So, that they don't have to pay the price for gov't's action. Again, Viets and khmer have always had a good relationship with each other for thousand of years until the white colonial and into the 21st century where Viets have helped to rescue khmer from Pol Pot regime unlike Thai people helped to kill us by dumping us on the foot of the mountain full of mines. CPP government members use laws to harm Khmers exactely like Pol Pot's did it with the word ANGKAR. These criminals are touching their ends. They already forget how they felt while they were under other regimes in the past. Oppression will not last brothers...
Sam Rainsy and Sam Rainsy supporters, don't be so stupid. The Viet do not need to steal a few hundred meters of land. If they want, they can swallow the whole country slowly, by just sending more and more of their people to live in Cambodia. After a few generations, they just take over the government and slowly turning Cambodia into Vietnam. Intelligent wise, the Vietnamese are much smarter than Khmer, they are cool headed and they can think and plan long term, Khmer only think short term, hot temper, make a lot of noise but accomplish nothing.
i think it is true to some degree to say that sam rainsy was creating racial incitement. it's stupid to say it's not, really! that say, that goes to show that cambodia is not very fond of viet/youn, however, politician like sam rainsy have use racial incitement as on of their campaign in khmer politics which i thinkis so outdated as cambodia has move beyond that. i mean, nowadays, there's no reason to incite racial slur, either, whether viet/youn, siem, and so forth. we all know when we hear racial slur of any kind to mean politics, really! i think in cambodia most people moved beyond that already. there are more concern issues like healthcare, education, trade, businesses, reforms in lands ownerships, justice, the creation of the rule of law, than just some racial slur often used by some overseas politician to incitement hatred, disturb peace, all in the name of political campaign and so on. it's getting old after a while and people like me are sick and tired to hear politics using it as a pretext based on groundless accusation, etc... i mean, of course khmer people will stand up if there are overwhelming evident that viet/youn and siem continue to steal or claim lands from cambodia, given that khmer land were much bigger a few hundred years ago, let alone during the khmer empire era and so forth. well, that was a historical lesson that khmer leaders of the olden time were weak and ineffective and perhaps were ignorant and stupid as well for them to not able to do anything about it. i think it was all about attitude and mentality that contributed in a way to cambodia's past shrinking of lands to particularly viet/youn and siem and to some degree lao too, i mean khmer lost lands and territories to all three neighboring countries of cambodia, really! why? i think it was partly due to the frog in the well mentality, the ignorance, the weak, ineffective leadership of that time, the lame attitude, etc... wake up people, get good education and learn from everyone, ok! move on and from now on teach our people and encourage them to be more competitive with neighboring countries, to think and act aggressively when it comes to lands, territories, business, and don't be laziness again, ok! be industrious, this way, it is called competitive, smart, and do reform that outdated mentality of the frog in the well, ok! no more ignorant and abuse!
Xam is a lonely guy only confesses what he thinks over the Internet or online chatting, sound pathetic to me. On the next year, people will ask: "Who is Xam Rainsy?? A publisher of Khmer News in Paris??"
