“We have decided to arrest Sam Rainsy and order public forces to search for and detain him and bring him to Phnom Penh Municipal Court for legal action.”Phnom Penh Municipal Court issued an official arrest warrant for opposition leader Sam Rainsy on Tuesday.
He is accused of distributing false information on his party’s website, which accuses the Cambodian government of ceding land to neighboring Vietnam.
The charge, for distribution of false information, carries a penalty of up to 15 years in prison.
Sam Rainsy, who remains in exile after an earlier conviction in absentia for uprooting border markers near Vietnam, claims the courts are being manipulated by the ruling party to damage the opposition.
Border issues are a political flashpoint in Cambodia, and the government claims that a map posted on the Sam Rainsy Party website, which purports to show current border demarcation and previous borders, is a falsification and crime.
Meanwhile, villagers in Svay Rieng province’s Chantrea disrict say they have lost farmland to Vietnamese encroachment.
“We have decided to arrest Sam Rainsy and order public forces to search for and detain him and bring him to Phnom Penh Municipal Court for legal action,” Oeung Seang, an investigating judge for the court, told VOA Khmer Tuesday.
Choung Chou Ngy, a legal representative for Sam Rainsy, confirmed receipt of an arrest warrant and said Sam Rainsy was aware of it.
He declined to give details on how he would defend his client against the charges.
Government lawyer Ky Tech said he had requested the arrest of Sam Rainsy “in conformity with the law.”
Ky Tech, who was also Prime Minister Hun Sen’s lawyer in a defamation case against opposition lawmaker Mu Sochua, said the map on Sam Rainsy’s website had been falsified.
“His falseness made border markers outside of the correct or real place, where the Cambodian-Vietnamese joint border commission is still working,” Ky Tech said.
Var Kimhong, head of the Cambodian border commission, said in a May 26 letter to the court: “The map that Sam Rainsy produced and published is a false map.”
Speaking from Paris, Sam Rainsy told VOA Khmer the map “helps to protect Cambodian territory from Vietnamese invasion.”
“I don’t care about the arrest warrant, because this is not only the problem of Sam Rainsy or the Sam Rainsy Party, but it is the problem of all of Cambodia against the Vietnamese invasion,” he said. “We are uniting together to protect our Cambodian territory.”
All 26 of the National Assembly Sam Rainsy Party lawmakers have complained to the UN about the alleged Vietnamese encroachment, he said.

The grenades killed over 10 people at the Pagoda. Sene Sane's son was injured by the grenades including 10 other people. I did not know that they would be using the hand grenades against the innocent demonstrators. I was not a party to it. When the grenades exploded, I was at the office of Net Sa Veun talking to him about how Hun Sen had met Hoc Lundy. After that the police were alerted to the explosions and that is when I knew that something bad happened. I only found out that after the grenades exploded. The police were called upon to investigate who was responsible for the bombing, but they did the investigation superficially and were trying to cover the track than to find the person responsible.
During my time at the Anti-Narcotic Bureau, I discovered evidence showing Hun Sen's people being involved in drug trafficking. I went to see Hun Sen with a view to bringing it to his attention. He took me to the cellar of his house which was nicely decorated. Hun Sen asked me whether I knew the names of the people who were into the drugs. I replied that I knew and I told him one name Mon Routy whom I was sure was involved. I suspected other men of Hun Sen were also involved, but I was not 100% sure. Hun Sen did not make any comments. Then Hoc Lundy then arrived with Huy Piseth, Chief of the Hun Sen's bodyguards and distracted my discussion with him. We then talked about the opposition party's protest. Hoc Lundy said to Hun Sen, ' why don't you use hand grenades.' Hun Sen said that it was a good idea... "I can send Seth to do it and he is a good operator." He authorized Hoc Lundy to pay for Huy PiSeth to do the job. Hoc Lundy answered that he would put together the money to pay them. He suggested that I met with Seth. After that, Hoc Lundy ordered me to find the money (US$ 100000) to give to Huy Piseth. The money came from the police.
On 30/3/97, the opposition leader Sam Rainsy led a demonstration calling for the reform of the justice system in Cambodia. The demonstration was held in front of the Assembly of the Nation. I was near the Pro Tom Pagoda and witnessed what happened. My staff took me on his motorbike to see the big protest outside the Assembly. 2-4 minutes after we arrived, I heard a big explosion and people crying and screaming. Then I saw four men running away from the scene. I recognized only two of them that were: Mr Phan Sary Colonel and Mr Ourn Cham Nane Commander; both of them were Hun Sen's men. I did not know the other two. They ran towards the Prime Minister' house. I followed them there to see what they ran away like that for. I talked to General Huy Pheseth and told him that I saw four of his people running away from the scene and that they should not have thrown the grenades. He told me to keep quiet and don't talk to any body. But I was angry and upset. I need to speak to somebody about it. I went to see Hoc Lundy who I considered at the time as my friend. I felt that I had to report to Hoc and could not understand why Hun Sen chose to kill so many people. But he told me the same thing to keep quiet and not to tell anybody about it. Amongst the people who were killed or injured was an American. I understand the American Government sent people to Cambodia to investigate.
In 2003 Phan Sary came to see me in my office. He admitted to me that he was the person who threw the grenades. He said that he was very sad because he killed so many people. He complained that Hun Sen used to pay him money to have things done. When he was in trouble nobody seemed to care about him He said that he did what he did because Hun Sen ordered him and he had to please him. He acknowledged that he killed a lot of people before. He said that he now did not even have money to support his children. I recorded the conversation.

But now after the CPP has succeeded in getting rid of those voices, the CPP will be eliminated by the Vietnamese imperialist eventually.

Bou Thong: A Vietnam-trained revolutionary from Cambodia’s
northeast and a member of the Tapuon minority, Bou Thang returned
to Cambodia in the early 1970s and joined the Khmer Rouge military
before fleeing back to Vietnam in 1974.
CHAN SI : Trained in Hanoi, Chan Si returned to Cambodia in
1979 as chief of the Political Department of the army and a member of
the Politburo. In 1981 he became minister of defense, replacing Pen
Sovan. Chan Si served as prime minister from December 1981, after
the arrest of Sovan, until his death in late 1984.
CHAN VEN: A teacher, Chan Ven lived under the Khmer Rouge
until 1978, when he took refuge in Vietnam.
CHEA SIM: A former Khmer Rouge Eastern Zone district chief, Chea
Sim fled Pol Pot’s purges in 1978 and went to Vietnam.
CHEA SOTH: A Hanoi-trained revolutionary, Chea Soth served as the
PRK’s first ambassador to Vietnam
and as a member of the Politburo.
HENG SAMRIN: A former military officer in the Khmer Rouge Eastern
Zone, Heng Samrin fled Pol Pot’s purges in 1978 and went to Vietnam.
HUN SEN: A former military officer in the Khmer Rouge Eastern Zone,
Hun Sen was among the first to flee to Vietnam, in 1977.
KAEV CHENDA: A Vietnam-trained revolutionary, Kaev Chenda
served the PRK in many capacities. As minister of propaganda and information,
he presided over the trial of Khmer leaders Pol Pot and Ieng Sary in absentia
in . He also served as minister of industry, in which position he was
reportedly linked to a corruption scandal. After being recalled to Hanoi for
“education,” Chenda returned as mayor of Phnom Penh, where he exhibited a
level of independence and a tolerance of market economics that annoyed the
more ideological members of the leadership. Chenda was removed from power
in late 1984 or early 1985 and died in 1989.
NHEUM VANDA: A former militia chief in the Khmer Rouge Eastern
Zone, Nheum Vanda fled to Vietnam in 1978.
PEN SOVANN: The most important of the Vietnamese-trained revolutionaries,
Pen Sovan served as secretary-general of the Party, vice president of the
KPRC, minister of defense, and, in 1981, prime minister.
ROS SAMAY : The Vietnam-trained cousin of Pen Sovann.
SAYB PHOUTHONG: A Vietnam-trained revolutionary, Say Phouthang
returned, in 1970, to his native Koh Kong province in southeast Cambodia.
There he joined the Khmer Rouge military and, in 1973, rebelled against Pol
Pot. Phouthang, who is ethnic Thai, spent most of the Khmer Rouge period
in Thailand or along the border. Brought back to Phnom Penh by Vietnamese
agents in the spring of 1979, he served as a member of the Politburo and as chair
of the Central Organization Committee of the Party. Following the arrest of
Pen Sovan in December 1981, Say Phouthang was perhaps the most powerful
Cambodian leader.
SIN SONG: A former Khmer Rouge Eastern Zone cadre, Sin Song fled to
Vietnam in 1977. As deputy minister of the interior, he defended the interests
of the police against Uk Bunchheuan’s Ministry of Justice. Temporarily exiled
to the powerless Ministry of Inspection, he returned as minister of the interior
in 1988. Working closely with Chea Sim, Sin Song presided over the expansion
of the security apparatus during and immediately after the withdrawal of the
Vietnamese army. He died of cancer in March 2001.
TANG SAROEUM: One of the few Vietnam-trained revolutionaries to
have remained in Cambodia after 1975, Tang Sareum fled to Vietnam in 1978
with the Eastern Zone cadres.
THUN SARAY : An economist who survived the Khmer Rouge regime,
Thun Saray participated in the 1979 trial of Pol Pot and Ieng Sary but remained
doggedly independent of the PRK.
UK BUNCHHOEUN: A former Khmer Rouge Eastern Zone cadre, Uk
Bunchheuan fled to Vietnam in 1978. More suspicious than many of his comrades
of Vietnamese authorities, he received a political education in Vietnam
up until 1980, when he returned to Cambodia to take over the drafting of the
constitution from Ros Samay and to serve as minister of justice.
UNG PHAN: A former military officer of the Khmer Rouge Eastern Zone,
Ung Phan fled with Hun Sen to Vietnam in 1977. Appointed minister in charge
of the Council of Ministers, Phan promoted pragmatic economic policies
while helping Hun Sen develop a patronage system within an expanding and
increasingly technocratic bureaucracy.
VANDY KA-ON: A French-trained sociologist who survived the Khmer
Rouge regime, Vandy Ka-on became a symbol of the PRK’s inclusion of noncommunist
intellectuals in the government.
