We, the undersigned, urge you to condemn the recent Cambodian Supreme Court decision against former Nobel Peace Prize nominee, long-time women’s rights activist, and Cambodian parliamentary member, Her Excellency Mu Sochua, in the alleged defamation case of Prime Minister Hun Sen.
The Cambodian Supreme Court’s ruling on June 2, 2010 exemplifies politically-motivated targeting of opposition leaders by Prime Minister Hun Sen, lack of judicial accountability and fairness in the proceedings, and a denial of Cambodian citizens’ rights to freedom of expression and holding of their public officials accountable in the event of perceived breach of the law.
Earlier this year, the Cambodian government also initiated a politically-motivated lawsuit against Cambodian opposition leader, His Excellency Sam Rainsy, on the charges of falsifying public documents and distributing false information. H.E. Sam Rainsy could face up to 18 years in prison if found guilty.
As a result of H.E. Mu Sochua's and Sam Rainsy's cases, local human rights groups have decried freedom of expression in Cambodia to be in a "perilous state."
We are deeply concerned by the silencing of long-time, well-respected, and democratically-elected leaders who could be prevented from running in the next parliamentary elections. This would be a deep blow to democracy in Cambodia.
With more than US $60 million in assistance given to Cambodia in 2009, including in the areas of democratic reform and governance, the United States Government has the responsibility to denounce the Court’s decision as a threat to freedoms of speech and expression and the rights to fair judicial process, transparency, and legal representation.
By failing to speak out against these rulings, the United States would undermine its long-cherished values of freedoms of speech and expression and the rights to an independent and impartial judicial process, equality before the law, and legal representation.
We urge you, Mr. President, to make a strong statement against the recent Cambodian Court’s ruling in defense of our democratic values that serve to empower so many around the world.

This effort is presupposing that she was not indeed in violation of Article 63 of UNTAC. As one who myself was charged with defamation when it was still a crime, as opposed to now which is civil, and who's case went to the Cambodian Supreme court last year but I was vindicated by that court, I think that the court is a serious judicial body and tries to render decisions based on the law. Just because she lost, doesn't mean automatically that it was a wrong ruling.

Disgrace Mu Sochua’s problem all along, is that she is trying to be a politician. She's not, never has been and quite obviously, never will be. She should have just been herself, provide alternative policies and show Khmer people what a great alternative MP opposition she would be. Instead, her foray into being a politician has been a disaster. She comes across as pretending to be something she's not. Now, her political career is on the line and herself also in the hot water.
While the nation is facing complex economic, social and environmental issues disgrace Mu Sochua tried to promote her political stunt, aimed to get media attention. If this wasn’t such a clear demonstration of her selfish pursuit of personal ambition it would be laughable. There is no doubt that Mu Sochua has no real regard for the best interest of the nation. She is driven solely by a desire to become a “Champion of Women or a new Aung San Suu Kyi” by any means available to her, even if that has the potential to destabilize the country. Even worse, she is attempted to make trouble after she lose her case in the Supreme Court against Prime Minister Hun Sen. Will she happy going to jail or pay the fine, everyone can bet for it.
People of integrity admit their faults, make amends and are judged fairly...Disgrace Mu Sochua is lacking in integrity and common sense and tries to change Cambodia into her own world. As long as Cambodia’s Court doesn’t issue any verdict which is fitted for her political stunt, she will screaming for the justice all day long.

No, I'm not one of PM Hun Sen bodyguards, I'm just a typical Khmer person who is a hard worker and earn a decent living.
This women is totally wrong. She was wrong to make false statements and she got sued for defamation. She could have won if she could show that was she said was true, because truth is a perfect defense. Obviously she was unable to show her statements were true and therefore lost her case. It would have been the same result in any country. She needs to understand that she just can't make false statements that she can't prove are true. If she hasn't learned that lesson, she will be in court again when she makes her next false statement-if she does.
Don't pay the fine and go to prison or third option, run away again to the US and make more money by giving guest appearances.

When I was in Cambodia, I could go fishing any where I wanted, as many I could keep (no limit).
But,when I came to the US, I can't do that any more. I need to have fishing license, a certain tool to use, a certain time to fish and each kind of fish has it own limit that I can keep.
What do you think about these two comparison ?

Most people don't even understand what constitutes defamation, and the real issues become lost in political rhetoric. Now it's being cast as a free speech issue. Nothing is the furthest from the truth. Every country has law about speech that makes false, or unsupportable statements that harms the reputation or honor of another.

1. The use by the government of the judiciary to settle essentially civil cases, suggests that the government is trying to hide something.
2. The fact that Ms. Sochua's case against the PM was not heard also suggests that the government is influencing the court, particularly when the PM's comments referring to the case are well known and well recorded.
3. I guess as Mr. Hun Sen is not a very subtle politician, he would be in court every other week if Ms. Sochua's case had been heard. In public, Mr. Hun Sen's speeches are loaded with defamatory comments.
4. The comments Mr. Hun Sen made are difficult to see who else they could refer to.
It is a pity that the government seems unable to build a country of unity. Constantly using public institutions to score political points undermines the validity of these institutions and increases the need for reform or reconstruction.
First of all we need to understand what Defamation is and what it is not. There are those that want to cast this as the judiciary being controlled by HS but this is just political rhetoric. She lost her case in the Municipal court, and she chose not to appeal. On the other hand, she would have won against HS if she simply could have shown that her defamatory words were true. Obviously she couldn't meet that standard and lost...again. Pay the fine and move on, and be thankful to HS for decriminalizing Article 63 of UNTAC otherwise she would be in jail now.

I don't vote for this because I do not support any party. But the truth is:
Most Cambodians in USA, Canada or Europe have access to internet. However, most of them are young people who don't care much about politics or don't care much about Cambodia. Most of old people who care don't know how to use computer. If they know how, the votes would not be 2000. I work with community and I know Khmer who have access to the internet.
The government of many countries are now realising that Hun Sen and his gangs are terrorist group. They are very soon be removed or be crushed by international communities.
At present they start to decline all Hun Sen cronies visa application. The fellings are there.

This is just a publicity stunt and maybe she will get a photo opp out of it. The US is not going to interfere with a court ruling- and it's not just one ruling it was made at the city court, the Appeals Court and the Supreme court.
