Phnom Penh Municipal Court has held an abortive hearing into a two-year-old defamation charge facing embattled opposition leader Sam Rainsy.
The move comes just a week after the court sentenced him to 10 years prison on unrelated charges.
The opposition Sam Rainsy Party leader was summonsed to answer questions relating to a lawsuit filed by Foreign Minister Hor Namhong in connection with a 2008 speech made by Rainsy.
During the speech Sam Rainsy accused Hor Namhong of running the notorious Khmer Rouge prison at Boeung Trabek.
The opposition leader is living in self-imposed exile in Europe. SRP representatives said the politician and the party were “uninterested” in any case that was not heard fairly.
“Excellency Sam Rainsy and the party are not interested in the courts, because the government is using the courts to destroy the Sam Rainsy Party,” SRP spokesman Yim Sovann said.
In a summons issued on September 9, investigating judge Duch Kimsorn said that if the politician failed to appear at the hearing, the court would issue a warrant for his arrest.
Sam Rainsy has already been sentenced to 12 years prison on a number of charges stemming from his claim that Cambodia has ceded border territories to Vietnam – the country’s eastern neighbour and former political patron.
Yim Sovann said the SRP would survive the current legal offensive, because it was based on “real principles” and had pledged to defend the country’s territorial integrity.
Sam Rainsy’s lawyer Choung Choungy declined to comment in detail yesterday, and Duch Kimsorn could not be reached.
Deputy prosecutor Ek Chheng Huot said no new date had been set in the case against SRP lawmaker Chea Poch, who was originally summoned to appear in court today in relation to another old defamation suit.
The lawsuit, filed in August 2004 by former royalist heavyweight Prince Norodom Ranariddh, was apparently dropped after a political settlement was reached between the SRP and the government, but a September 2 summons unexpectedly put Chea Poch’s case back on the court’s agenda.

This case is slam dung. French court already convicted Sam Rainsy to making false statement and defaming HorNam Hong. SR cannot accuse French court to be a kangaroo court like he so fondly accusing Cambodian court. So Hornam Hong getting smart, he sue the same case in French and once the French court proven that SR is guilty, then HNH can move to the next step to sue SR under Cambodian law.

Keo Bunthouk who was detained with her husband, former diplomat Ieng Kounsaky, at the Boeng Trabek camp (Section B32 presided over by Hor Namhong) from 1977 to 1979.

i think sam rainsy is wasting the money on hiring the US lawyer to sue mr. hun sen which by the way is not under any US jurisdiction. he's a cambodian prime minister, not a US citizen, hello! sam rainsy is running out of option as france won't do it, US now won't do it, the last i heard he look to spain to do it. his case is not gullible and unproved as there is not case against the prime minister of cambodia who stands firm by khmer law of cambodia. sam rainsy disrespect khmer law and defaming the prime minister by all names in the book. shame on him for having an ambition to be a cambodian prime minister but fail miserably due to lack of support because of his unwised and unskilled style of doing so! when it is so one-sided in his story, smart and highly education people aren't going to buy it that easily again. i'm sure people both inside cambodia and outside of cambodia can analyze and see for themselves without sam rainy so much misinformed them or used bias to tarnish the very good name of cambodia and its ruling party. sam rainsy can still be opponents who contested the khmer general election at mandate time, however, to continue to struggle to no avail or no end in sight is fruitless and does not benefit cambodia at all, to say the least! so, don't quite your day job, sam! perhaps your party too needs a new face to represent your party at the next national election. i think most khmer people will do fine without your troublesome penchance!
i think the US will ignore and question sam rainsy motive. there ought to be a law in cambodia to prohibit a poltician from engaging in activist activity which create conflict of interest. one will understand better when they hear the other side of view as well, but no, so far sam rainsy took all the credit for himself. bad leadership trait for sure! cambodia needs a skillful statesman(s), not an ineffective, coward-like individual, really!
The truth about Hun Sen and his regime is already known no one can deny it, the question is what can we do about it aside from bagging other to listen even then no body gives a damn.
