Defense Seeks Release of Nuon Chea, Khieu Samphan [... only if they can bring those who were killed by the KR back to life?]

" ...any detention beyond Jan. 15 is unlawful."
Defense lawyers for Nuon Chea and Khieu Samphan have launched separate complaints to the Khmer Rouge tribunal, claiming their clients have been detained beyond legal limitations as they await trial.

The defense teams say continued detention of the two senior Khmer Rouge leaders is a breach of the internal rules of the UN-backed court.

Son Arun, a defense lawyer for Nuon Chea, the regime’s chief ideologue and “Brother No. 2,” said Internal Rule No. 68 requires a hearing within four months of the closing order by investigating judges.

That date, Jan. 15 in both cases, has passed, he said, making Nuon Chea’s continued detention “an abuse of him by the law.”


Nuon Chea and Khieu Samphan are to stand trial along with Ieng Sary, the former foreign minister of the regime, and Ieng Thirith, his wife, former social affairs minister. They are charged with atrocity crimes, including genocide, with a trial expected later this year.

Sar Savann, defense lawyer for Khieu Samphan, the nominal head of the regime, said any detention beyond Jan. 15 is unlawful. Khieu Samphan should immediately be released, he said.

Tribunal spokesman Reach Sambath confirmed that the court had received the complaints and would make a legal decision accordingly. Experts say the internal rules on the matter have some room for interpretation.

Without them, viet already annexed Cambodia.

Free them as part of national reconciliation, justice and peace..

I read the above link and it was so interesting with so many twists like Chinese movies.

I know every things happened in Cambodia always involved with Viet Cong armies and their spies.

When the war started in 1970, there were Viet Congs every where where I lived.

The Lynching and killing of Lon Nol' s brother in Kpg Cham was instigated by Viet Cong spies.

The bombing that destroyed Chroy Jong va bridge was done by Viet cong not by Khmer rouge army.

On the evening of the bombing, there were two Yourn civilians who live at the base of the bridge were arguing, screaming, fighting and yelling at each other like crazy. No body knew what they were fighting about.

When mid night approached, they were still fighting and yelling at each other.
The Lon Nol' s soldiers who guarded the bridge, could not stand it any more. So, they went to investigate.
As soon as they left their post, another Viet Cong who were waiting close by, saw the opportunity and set of the blast to destroy the bridge. Those two who were fighting must be working as distraction.

Professor Ben Kiernan, director of the Program puts the causalities figure from bombing at 150,000 deaths, while Edward Herman, a professor of Wharton School, and Noam Chomsky put the toll at 600,000 using figures provided by a Finnish Commission of Inquiry."

Thai government who accomplished of killing Cambodians by allowing base 52 flew from Thai territory to drop bombs in Cambodia must bear responsibility of mass killing, too.

Khmer Rouge Tribunal must balance and makes fair judgment. Otherwise, there is no fair, and no justice for Cambodian people.

SALOTH SAR ou POL POT + KHIEV SAMPHORN + IENG SARY+ NUON CHEA +...= ANGKAR LOEUR = criminels.
Ils n'ont pas rendu ni justice , ni motifs de l'assassinat de ma famille ,ni le massacre de mes 1 700 000 compatriotes cambodgiens , à leur époque 1975-1978 .
Il faut plus les juger.On perd du temps avec ces malades .
Il faut les pendre pour rendre justice aux victimes .

Khiev Samphan is still a good man I agree with you 11:33AM.

The truth are :

Not every single one of CPP is a killer.

Not every Khmer Viet Minh are killer.

Not very Khmer Rouge leaders are killer.

Not every in FUNCINPEC is bad.

Not every one in Sam Rainsy Party is good.

So there are good and bad persons
everh single regime running the country .

Another good example is looking at yuon CPP regime running the country there are good persons and bad persons.

Even Pol Pot himself to Khmer he was wrong but to yuon and Siam he was rihgt in term of Pol Pot fighting against yuon and Siam to protect Khmer border, Khmer sea.

All I want to share some view with our fellow Cambodian not to judge every leader, every regime is bad.

There are always good people in bad regime.

Khiev Samphan has no money ( dollars )in Cambodian and oversea bank.

He had many chances to corrupt but he never do so .

So Hu Nim, Hu Yun.

Even David Chandler agree that many Cambodian agree with David Chandler about this.

All I want to share some view with our fellow Cambodian not to judge every leader, every regime is bad.

There are always good people in bad regime.

About Pol Pot regime between 1975-1979.

1. Khieu Samphan.
2. Hu Nim.
3. Hu Yun.
4. Sihanouk they all are nominal leaders of Pol Pot regime .

Even personally I do not like Sihanouk but it is truth and the truth is a good part of our history.
